WHEREAS,theAPPLICANThasagreedtosecurethesuccessfulcompletionofsaidimprovementsforthereferencedprojectpursuanttoRMC4-6-030andRMC9-10-5.NOWTHEREFORE,theAPPLICANTherebyagreesandbindsitselfanditslegalrepresentatives,successors,andassignsasfollows:1.TheAPPLICANTguaranteesthatconstruction,maintenanceandrestorationofroadway,site,drainage,retention/detention,water,andsanitarysewerfacilitieswill,tothesolesatisfactionoftheCITY,fullycomplywiththeapprovedconstructionplansandprofiles,includinganyapprovedamendmentsthereto,andfullyconformtoapplicableCITYordinances,standardsandspecifications.2.Ifthesubdivision,shortsubdivision,orsiteplanisnotrecorded,orthebuildingdoesnotreceiveanycertificateofoccupancyorfinalbuildingpermit,theAPPLICANTagreestorestoretherightofwaytoitsoriginalconditionorbetterANDstabilizethesiteorcomplywiththeconditionsofanypermitorapproval,including,butnotlimitedto,correctiveworknecessarytoprovidedrainageconsistentwithapprovedplansandconditions,andtoprotectthepublichealth,safety,andwelfare,includingeffectsonwaterquality.3.TheCITYmustapprove(inwriting)anyproposedchangesfromtheapprovedplanspriortotheAPPLICANTbeginningsuchwork.4.Priortobeginningconstruction,apreconstructionmeetingshallbeheldwiththeCITY,theAPPLICANTandtheAPPLICANT’Scontractor(s).5.TheAPPLICANTshallberesponsibleforthecostofanycorrectiveworkonoroffthesiteorwithintherightofwaytotheextentthatsuchcorrectivemeasuresareassociatedwithworkperformedand/ornotcompleted.6.TheAPPLICANTshallpayanyfeesrequiredinconjunctionwiththeprojectpursuanttothemostrecentlypublishededitionoftheCityofRentonFeeSchedule.7.IftheAPPLICANTfailstoproceedwithduediligenceandingoodfaithintheworkprovidedherein,theAPPLICANT,atitsownsoleexpense,shallremoveallorpartofconstructedfacilitiesandrestorealldisturbedareasofthesitetoitsoriginalorbetterconditiontotheCITY’Ssolesatisfaction.TheAPPLICANTshallnotstop,delayorabandontheprojectwithoutfirstrectifyinganydamage,stabilizingandrestoringtherightofwayand/orsitebygrading,hydroseeding,and/orlandscapingasmayberequiredbytheCITY.PublicAgencyAgreementforPerformancePage2of4 8.TheAPPLICANTshallfurnishtotheCITYasetof“finalcorrectedplans”(photoMylarquality)ofallrequiredpublicandprivatefacilitieswhenapplicable.9.TheAPPLICANTshallberesponsiblefortheproperperformance,safeconductandadequatepolicingandsupervisionoftheproject.ThisresponsibilityshallnotbelessenedorotherwiseaffectedbytheCITY’Sapprovalofplans,specifications,orwork,orbythepresenceattheworksiteoftheCITY’Srepresentative(s),orbythecompliancebytheAPPLICANTwithanyrequestsmadebysaidrepresentative(s).10.TheAPPLICANTshallindemnifyandholdtheCITYanditsagents,employeesand/orofficersharmlessfromandshallprocessanddefendatitsownexpenseallclaims,damages,suitsatlaworequity,actions,penalties,losses,orcostsofwhatsoeverkindornature,broughtagainsttheCITYarisingoutof,inconnectionwith,orincidenttotheexecutionofthisAGREEMENTand/ortheAPPLICANT’SperformanceorfailuretoperformanyaspectoftheAGREEMENT.Provided,however,thatnothinghereinshallrequiretheAPPLICANTholdharmlessordefendtheCITYfromanyclaimarisingfromthesolenegligenceoftheCITY’Sagents,employeesand/orofficers.11.IntheeventthatanypartydeemsitnecessarytoinstitutelegalactionorproceedingstoenforceanyrightorobligationunderthisAGREEMENT,thepartiesheretoagreethatanysuchactionorproceedingshallbebroughtinacourtofcompetentjurisdictionsituatedinKingCounty,Washington.ReleaseRequirements:ThisAGREEMENTshallremaininforceandeffectandshallnotbereleaseduntilalltermsofthisAGREEMENThavebeencompletedtothesatisfactionoftheCityofRenton.INWITNESSWHEREOF,thePARTIESheretohaveexecutedthisAGREEMENTonthedateandyearfirstabovesetforth.CITYOFRENIOjChipVincent,AdministratorofDepartmentofCommunityandEconomicDevelopmentSTATEOFWASHINGTONssCOUNTYOFKINGPublicAgencyAgreementforPerformancePage3of4
