Grantor, and CITY OF SEATTLE, a municipal corporation, hereinafter called the Grantee,

That the Grantor, for and in consideration of the sum of ONE AND N01100
DOLLARS ($1.00) and other valuable considerations, receipt of which is hereby ack-
nowledged, hereby conveys and grants to the Grantee, its successors and assigns, (sub-

Henry Meader Donation Clair to,the east line of the Northern
Pacific Railway Right of iiay, thence north along said right of
way to the south line of the Bow Lake Pipe Line; thence easterly
and northeasterly along said south line of the Bow Lake Pipe
Line to a point of intersection with a northerly extension in a
straight line of the -east line of'Government Lot 10; thence
southerly along said straight line. to .the point of beginning, all
situated in the north'1/2 of Section 25, Township 23 North, Range
4 East, W.M..
This easement is given to correct and replace that certain easement dated the
11th day of August; 1961, executed by the same grantor, to the same grantee, herein
named.
+ It is understood and agreed that the City of Seattle, Depart :t of Lighting,
shall at all times maintain its power lines at a height of not less than 30 feet above
the ground.
It is understood and agreed that this easement is given dyer and upon said
land as an alternate route for the City of Seattle's Transmission and Distribution Line
facilities to the use of that certain property oimed in fee by the City of Seattle, which
is Imo -.m as the City of Seattle's Pipe Line Right of Way, trhich lies within henry Meader
Donation Claid No. 46, bounded on the west'by the Northern Pacific Raill-my Right of Way
and bounded on the east by the production north of the east line of Government Lot 10
in Section 25, Township 23 North, Range 4 East, W.M., and it is hereby stipulated that
this easement shall immediately cease and all rights herein granted shall be revoked in
the event that the City of Seattle shall install Transmission and/or Distribution Line
facilities upon said Pipe Line Right of Way;,Provided, however, that the use of the
easterly 40 feet of said Pipe Line Right of Way by the Grantee for the installation of
guy wires and anchors shall be permitted without causing a cessation of the easement
herein granted as an alternate use by Grantee of the Pipe Line Right of I -Tay.
It is understood and agreed that this easement shall likewise cease and all
rights herein granted be revolted in the event the City of Seattle acquires, by con-
demnation, a Transmission and Distribution Line Right of Way over land owned in fee by

the Grantor, which lies within that portion of the Henry Meader Donation Claim No.
46 which is bounded on the south by the south margin of said Donation Clain; on the
north by the City of Seattle's Pipe Line Right of I -Tay; on the west by the Northern
Pacific Railway Right of Way; and on the east by the northerly extension in a straight
line of the east line of Government Lot 10 in the N1 1/4 of Section 25, Township 23
North, Range 4 Past, w.M.
Cf The rights, title, privileges and authority hereby granted shall otherwise
_ continue and be in force until such time as the Grantee, its successors or assigns,
shall permanently remove said towers and poles, wires and appurtenances from said lands,
lf; or shall otherwise permanently abandon said lines, at which time all such rights, title,
privileges and authority hereby granted shall terminate.
Together with the right at all times to the Grantee, its successors and
assigns, of ingress to and egress from said lands, across, adjacent lands of the
Grantor for the purpose of constructing, reconstructing, repairing, renewing, alter-
ing, changing, patrolling and operating said line upon the giving by Grantee to
Grantor of reasonable advance verbal or written notice of intention so to do, and
the right at any time upon the giving of such notice to remove said towers, poles
and appurtenances from said lands; Provided, further, however, that upon the notice
aforesaid being given by the Grantee to the Grantor, Grantor shall designate to the
Grantee the precise route over -&ich ingress to or egress from the adjacent lands of
the Grantor to the lands covered by this alternate easement shall be taken, and the
Grantee's rights of ingress to and egress from shall be confined to such routes.
It is understood and agreed that the City of Seattle, Department of Lighting,
(subject to the restrictions of this easement) may grant other corporations the right
and privilege to occupy and use jointly for other utilities the overhead facilities of
said transmission and distribution lines, towers or poles.
The City of Seattle is to be responsible, as provided by law, for any damage
resulting to the Grantor through its negligence in the construction, maintenance and
operation of said transmission and distribution lines over and across the property of
said Grantor.
The Grantor, its successors or assigns, shall not place,, construct or main-
tain any building, or other structure, within the boundary limits of said strip of
land; Provided, however, that trees, shrubs, flowers or landscaping placed within the
boundary limits of said.strip of land shall not be considered a building or other
structure; Provided, still further, that in the event Grantor permits any trees or
shrubs to grow to a point where there is a lack of 10 feet clearance between the top
of said trees or shrubs and the transmission and/or distribution lines, Grantee may at
its own expense, and upon reasonable advance, verbal or written notice to Grantor,
trim the offending trees or shrubs so as to maintain the 10 foot clearance aforesaid.
The Grantor, its successors or assigns, covenants and agrees that it will not
do any blasting or discharge any explosives within a distance of three hundred (300)
feet of said line without giving reasonable notice in writing to the Grantee, its
successors or assigns, of intention so. to do.
It is understood that Grantor, in granting this alternate easement, does so
by way of accommodation, and the amount paid by Grantee for this easement is nominal and
is not intended to represent and shall not be construed to represent the fair cash mar-
ket value of said easement, and the amount so paid shall not hereafter be used by
Grantee for the purpose of evidencing the fair cash market value of the alternate ease-
ment herein granted in any proceeding whatsoever, whether the proceeding be by way of
eminent domain, or otherwise, and whether the proceeding be against Grantor or others.

between GLACIER PARK COMPANY, a Minnesota Corporation, and B. PI TF and NELLIE PLL -LE, his wife,
hereinafter called the Grantors, parties of the first part." and CITY OF SEATTLE, a municipal
corporation, hereinafter called the Grantee, party of the second part, WITNESSETH:
ai That the Grantors, for and in consideration of the sum of Toro Thousand Fifty -'dao and 00/7,(
Dollars ($2,052.00 ) and other valuable considerations, receipt of which is hereby ac-
knowledged, hereby convey and grant to the Grantee, its successors and assigns, the right,
privilege and authority to construct,. erect,- alter, improve, repair, operate and maintain
electric transmission and distribution lines, consisting of the necessary towers and poles,
with braces, guys and anchors, and to place upon or suspend transmission, distribution and
signal wires, insulators, cross -arms, transformers and other -necessary or convenient appurte-
nances, across, over and upon the following described lands and premises situated in the

Beginning at the point of intersection at the south margin of Henry Meader Donation
Claim No. 46 and the east margin of the Northern Pacific Railway Right of Way; thence
southerly along the east margin of said right of way to a point 40 feet south, measured
at right angles, from the south margin of Henry Meader Donation Claim; thence east
parallel to and 40 feet southerly from said Donation Claim. margin a distance of LO feet;
thence northerly parallel to and 10 feet easterly from the east margin of said Railway
Right of Way a distance of 25 feet to a point 15 feet southerly, measured at right
angles, from said southerly margin of said Henry Meader Donation Claim; thence east

ALSO a strip of land 30 feet in width lying 15 feet on each side of the centerline de-
scribed as follows:
Beginning at the point of intersection of the south line of Henry Meader Donation Claim
No. 46 and the east line of Government Lot 10 in the NEu of Section 25, Township 23
North, Range 4 East, W.M., thence westerly along said south line of the Henry Meader
Donation Claim to the east line of the Northern Pacific Railway Right of Way; thence
continuing westerly along said Henry Meader Donation Claim a distance of 42.65 feet to
a point on said.Nbrthern Pacific Railway Right of Way which,is the true point of be=
ginning; thence westerly on an angle to the right of 1050'40" to the east margin of
Secondary State Highway No. 5M, EXCEPTING the rights of way of the Northern Pacific
Railway, the Chicago, Milwaukee, St. Paul and Pacific Railroad and the Puget Sound
Electric right of way.
ALSO, a strip of land 10 feet in width lying 5 feet on each side of a centerline which
intersects the centerline of the above described 30 foot strip, at right angles, and
extends north therefrom 30 feet and .south therefrom 30 feet; said intersection being at
A point 190 feet west from the west line of the Northern Pacific Railway Right of Way,
measured along the centerline of said 30 foot strip, EXCEPTING therefrom that land de-
scribed in said 30 foot strip -
Together with the right at all times to the Grantee, its successors and assigns, of ingress to
and egress from said lands across.adjacent lands of the Grantors for -the purpose of construct-
ing, reconstructing; repairing, renewing, altering, changing, patrolling and operating said
line, and the right at any time -to remove said towrers and poles,, wires and appurtenances from
said lands.

Also the further right to clear said right of way and Iteep the same clear of brush,
timber and all fire hazards and the right to remove danger trees, if any, located'beyond
the limits of said easement area which by falling would endanger the transmission and 'di.s-
tribution. lines.
The City of Seattle agrees to revise and alter its facilities on the described
premises at its own cost and expense should railroad track construction in the future
require such revision and alteration as determined.by the Chief Engineer of Great Northern
Railway Company, or its successors or assigns.
In the event that the Grantee shall be required to relocate its power line, or any
part thereof, to provide for the construction of such railroad track, the Grantor hereby
agrees to provide the Grantee, at no additional cost to the Grantee, such.additional easement r
area as may be required for the relocation of the Grantor's power line facilities, or any
part thereof, from available adjacent land then owned by Grantor.
It is understood and agreed that the City of Seattle, Department of Lighting,
may grant other utilities the right and privilege to occupy and use jointly the said x
transmission and distribution lines.
The City of Seattle is to be responsible, as provided by law, for any damage re-
sulting to the Grantors through its negligence in the construction, maintenance and operation X
of said transmission and distribution lines over and across the property of ,said Grantors.
The Grantors, their heirs, successors or assigns, covenant and agree that they
will not do any blasting or discharge any explosives within a distance of three hundred
(300) feet of said line without giving reasonable notice in writing to the Grantee, its
successors or assigns of intention so to do.
The rights, title, privileges and authority hereby granted shall continue and
be in force until such time as the Grantee, its successors or assigns, shall permanently X
remove said towers and poles, wires and appurtenances 'from said lands., or shall otherwise
permanently abandon said lines, at which time all such rights, title, privileges and
authority hereby granted shall terminate.
