C. Project Description / Background:
The applicant, Helen Orme of the Shekinah Glory Tabernacle, is requesting a Temporary
Use Permit to permit the use of a space in an existing office building for religious services
temporarily. Of the 7,544 square foot building, 1,200 square feet would be used as a
religious gathering place. The organization currently has ten members. Services would be
held on weekends. A Temporary Use Permit is requested to hold services for two years.
The existing building is two stories high, and the space that would be occupied is on the
second floor. A second exit and staircase were recently added to the space.
The building is located in the Commercial Arterial (CA) zone on a 29,360 square foot parcel.
Access to the site is from Union Avenue NE. There are 30 parking stalls to serve all
occupants of the building.
FINDINGS, CONCLUSIONS & DECISION
Having reviewed the written record in the matter, the City now makes and enters the
following:
D. Findings
1) Request: The applicant, Helen Orme or Shekinah Glory Tabernacle, has requested
approval for a Temporary Use Permit to permit the use of a space in an existing
office building for religious services temporarily. Services would be held on
weekends, for two years.
2) Temporary Use Permit. The applicant has submitted the application materials
required for processing and making an administrative decision on the proposal.
3) Existing Land Use: Land uses surrounding the subject site include: North:
Automobile service center, CA zone; South: Single family house, CA zone; East
Six -acre vacant commercial site, CA zone; and West: Discount store, CA zone.
4) Zoning: Commercial Arterial (CA) zone. The purpose of the CA zone is to provide
opportunities for a wide range of commercial uses and to set site development
standards that transition the commercial area from "strip commercial" linear business
districts to business areas characterized by enhanced site planning, incorporating
efficient parking lot design, coordinated access, amenities and boulevard treatment.
Religious Institutions are not an outright permitted use in this zone. They are subject
to a Hearing Examiner Conditional Use Permit.
5) Topography: The site is relatively flat.
6) Lot and Building Size: The site is 29,360 square feet. The existing building is 7,544
square feet and the area that would be used for religious services is 1,200 square
feet. The lot coverage is approximately 26%.

7) Consideration of Temporary Use Decision Criteria
Section 4-9-240H lists 5 criteria that the Zoning Administrator must consider, along
with all other relevant information, in making a decision on Temporary Use Permit
applications. These include the following:
a. The temporary use will not be materially detrimental to the public health,
safety, or well-being, nor injurious to property or improvements in the vicinity
of the temporary use; and
Use of a 1,200 square foot portion of the existing office building for religious
services would not likely be detrimental to the public health or injurious to the
property in the vicinity. The use would be very limited in scope, spatially and in
terms of time. The religious activity would take place on weekends, which is
outside of the normal office business hours. Access to the site is from Union
Avenue NE, a minor arterial, which could accommodate the minor increase in
traffic. There is sufficient parking on the site, such that those visiting the services
would not need to park in the right-of-way or on surrounding property.
b. Adequate parking facilities and vehicle ingress and egress are provided to
serve the temporary use and any existing uses on the site; and
Parking and driveway conditions are sufficient to accommodate the temporary use
on the site. The parking requirement for religious institutions is based on a ratio of
one parking stall for every five seats in the main auditorium. In the absence of
fixed seating, a ratio of one stall per 125 square feet of space is used {as
extrapolated from the parking requirements for auditoriums. So the parking
requirement for the Shekinah Glory Tabernacle space would be 10 parking stalls.
The remaining office use would require 19 parking stalls. These numbers are
based on gross square footage and would be less if the net square footage of the
office and church spaces were known and used in the calculations. So the total
number of stalls required for the site, based on gross area, would be 29 stalls. The
site has 30 stalls available. So the number of stalls is more than sufficient, given
that fewer would be required based on the net area of the uses, and the religious
institution use would take place at times when the offices would not likely be open.
The site has one, approximately 28 foot wide, driveway for ingress and egress to
Union -Avenue NE. This is sufficient for the proposed extent of use of the site.
c. Hours of operation of the temporary use are specified, and would not
adversely impact surrounding uses; and
The applicant proposes using the space in the existing building on weekends. The
surrounding uses, including auto servicing, and across the street, retail. There is a
single family house south of the site, on a large parcel owned by a development
company, which appears to be vacant. On this parcel, there is a possibility that any
number of commercial uses, but also multi -family, could eventually be built here.
Considering the existing and potential neighboring uses, it is not likely that a
religious institution use of the limited scope that the applicant proposes would have
an adverse impact on them. Because the services are proposed only on
weekends, the chances for a negative impact are further limited.

d. The temporary use will not cause nuisance factors such as noise, light, or
glare which adversely impacts surrounding uses; and
The use of a portion of the existing office building would not likely cause light or
glare impacts to surrounding uses. The automobile traffic could cause a noise
nuisance, but the parking area is located at the north end of the site, next to an
auto repair service use, which also involves movement of automobiles.
Furthermore, the amount of additional traffic generated from the religious services
use would be limited by the small size of the space they would be occupying. So a
substantial noise impact is not to be expected.
e. If applicable, the applicant has obtained the required right-of-way use permit.

E. Conclusions
1, The subject site is located at 326 Union Avenue NE within the Commercial Arterial
{CA} zoning designation.
2. Religious Institutions are not permitted outright in the CA zone.
3. The analysis of the proposal according to zone -related land use regulations and
Temporary Use Permit decision criteria is found in the body of the Staff Report.
F. Decision
The Temporary Use Permit, File No. LUA06-113, for use of a 1,200 square foot portion
of the building at 326 Union Avenue NE by a religious institution for a period of two
years is approved. The permit will be issued for the period of October 19, 2006 to
October 18, 2008. At the end of this time, the use by religious institutions must be
ended
Conditions of approval:
1. The applicant shall have the space for religious assembly use inspected by the City of
Renton Building Department prior to occupancy.

Land Use Action Appeals
The administrative land use decision will become final it the decision is not appealed within 14 days of the date of
approval. An appeal of the decision must be filed within the 14 day appeal period (RCW 43.21.C.075(3); WAC
197-11-680). An appeal to the Hearing Examiner is governed by Title IV, Section 4-8-11.13, which requires that
such appeals be filed directly with the Hearing Examiner via the City of Renton City Clerk's Office on the seventh
floor of Renton City Hall, 1055 South Grady Way, Renton WA, 98055. Appeals must be made in writing on or
before 5:00 PM on November 2, 2006. Any appeal must be accompanied by a $75.00 fee and other specific
requirements.
THE APPEARANCE OF FAIRNESS DOCTRINE provides that no ex parte (private one-on-one) communications
may occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals
to the Hearing Examiner as well. All communications after the decision/approval date must be made in writing
through the Hearing Examiner. All communications are public record and this permits all interested parties to
know the contents of the communication and would allow them to openly rebut the evidence in writing. Any
violation of this doctrine could result in the invalidation the appeal by the Court.

organization and meeting times are on the weekends A second exit and staircase were recently added to the space. The
29,360 sf site is in the CA zone and surrounded by CA zoning. Access to the site is from Union Ave. SE. There are 30
parking stalls to serve the building.

Shekinah Glory Tabernacle signed a three years lease to use the
above location as a place to assemble for public gathering, to
provide a place for worship and spiritual direction for its members
and the community at large. The hours of operation are normally,
during the evening and on Sunday, when most businesses are
closed.
Since being at this location we've added two families, and
developed a consistent youth service on the fourth Sunday, in
which the youth are developing skills and character. The impact of
the flow of traffic will continue to be normal and with plenty of
parking on the property. Therefore, obtaining this two years permit
would enable us to continue being apart of the Renton community.
