Following the Initial construction of all or a porffon of Its systems, Grantee may, from time to time, constrict
much additional facilities ask may require for such systems. Grantee shot have the right of access to the Easement
Area over and arose the Property to arable Grantee to exercise its rights hereunder. Gramme shalt oompen3ate

2. Easemeent Area Clearing and Maintenance. Grantee shag have the right to cut, remove and dispose
of any and all brush, trees or other vegetation In the Easement Area. Grantee shall also have the right to control, on
a continuing basis and by any prudent and reasonable means, the establishment and growth of brush, trees or other
vegetallon in the Easement Area.
3. Trees Outside Easement Area. Grantee shall have the right to cut, trim remove and dispose of any
trees located on the Property outside the Easement Area that could, In Grantee's sole judgment, interfere with or
create a hazard to Grantee's systems. Grantee shall, prior to the exercise of such right. iderrtify such trees and
make a reasonable effort to give Grantor priur notice That such trees Wit be cut, trimmed, removed or disposed of
(except that Grantee shall have no obligation to identify such trees or give Grantor such prior notice when trees are
cut. trknrned, removed or otherwise disposed of in response to emergency conditions)_ Grantor shall be entitles to
no compensation for trees cut, trimmed, removed or disposed of except for the actual market value of merchantable
timber (If arry) cut and removed from the Property by Grantee.
4. Grantors Use of Easement Area. Grantor reserves the right to use the Easement Area for any
purpose not Inconsistent with the rights herein granted, provided, however. Grantor shall not consbW or maintain
any buildings, structures or other objector on the Easement Area and Grantor shall do no blasting Within 300 feet of
Grantee's facilities without Grantee's prior written consent.

5. Indemnity. Grandee agrees to indemnify Grantor from and agahrt liability lnetrrred by Grantor as a
result of Grantee's negligence in the exercise of the rights herein granted to Grantee, but nothing herein shall require
Grantee to Indemnify Grantor for that partlon of any such liability attributable to the negligence of Grantor or the

A RESOLUTION of the Board of Commissioners of Soos Creek Water and Sewer
Distnct, Kong County, Washington, establishing Water Special Connection Charge
#123 due Soos Creek Water and Sewer District for Contract 8-2002W
WHEREAS, water mains and facilities have heretofore been installed as part of the protect
commonly known as Contract 8-2002W, and
WHEREAS, said water facilities will provide benefits and services to the properties described
in Exhibit "A" attached hereto, which is made a part hereof by this reference thereto, and
WHEREAS, it is the policy of Soos Creek Water and Sewer District to require reimbursement
for any facilities built by the District andlor by an individual when said facilities provide benefit and
service to other properties, and
WHEREAS, the Distnct engineer has determined the properties benefited and computed the
value of said benefit as applied to said properties, and
WHEREAS, the Board of Commissioners finds said benefits and the cost thereof to be
reasonable, and the Special Connection Charge Rate based thereupon to be a fair allocation of such
benefits and costs,
NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Soos Creek
Water and Sewer District as follows
SECTION 1: That Water Special Connection Charge No 123 is hereby established for the
properties and in the amounts shown in Exhibit "A", which is incorporated herein by this reference
Said rate does not include cost of connecting, stub service, permits or inspections, general facilities
charges, or other latecomers that may be due on the properties
