CHANGING THE ZONING CLASSIFICATION OF CERTAIN
PROPERTIES WITHIN THE CITY OF RENTON (UPPER KENNYDALE
AREA) FROM RESIDENTIAL 8 DU/AC (R 8) ZONING TO
RESIDENTIAL 4 DU/AC (R-4) ZONING; FILE NO. LUA-06-122 (CPA
2006-M-8).
WHEREAS, under Section 4,2.020 of Chapter 2, Zoning Districts — Uses and Standards,
of Title IV (Development Regulations), of Ordinance No. 4260 entitled "Code of General
Ordinances of the City of Renton., Washington" as amended, and the maps and reports adopted in
conjunction therewith, the property hereinbelow described has previously been zoned as
Residential 8 du/ac (R 8); and
WHEREAS, the City of Renton initiated a proceeding for change of zone classification
of said property. This matter was referred to the Planning Commission for investigation., study,
and public hearing, and a public hearing was held thereon on or about September 20, 2006, and

Upper Kennydale Rezone Justification and Project Narrative
The area proposed for rezone in Upper Kennydale is approximately 36.5 acres in the
vicinity of Jones Ave NE to the west, Kennewick and Monterey Avenues NE to the east,
north of NE 16`h Street, and south of NE 27t' and NE 28' Streets. The current zoning is
Renton R-8, with Residential Single Family Land Use designation and the proposed
zoning is Renton R4, with Residential Low Density Land Use designation. This would
require a Comprehensive Plan Amendment.
It is surrounding the area known as the Kennydale Blueberry Farm. The owners of this
3.4 acre parcel have made private application for rezone under files CPA 2006-M-2 and
LUA 05-159.
The existing land use of the area is for 96 single family homes. Under the current R-8
zoning, Buildable lands capacity calculations show that there is potential for
approximately 205 units in this area. Under the proposed R-4 zoning, Buildable lands
capacity estimates the potential for approximately 110 units in this area.
The proposed rezone is requested for several reasons. At the time in which the R-8
zoning was put into place for this area, the zoning choice was between R-1 (Residential -
one unit per acre) or R-8. There was no intermediate R-4 designation, as now exists.
Development in the area has organically occurred at about the same level of intensity as
an R-4 zone. The majority of the development in the area occurred prior to the
implementation of the R-8 zone. Permit history shows that development has affected the
hydrology of the area. Although each project has complied with the rules and regulations
in effect at the time of development, the cumulative effect of the projects has resulted in
some changes. Recent development that has realized the full extent of the R-8
regulations has been especially noticeable and has resulted in neighbor response.
Critical areas are likely to encumber some the properties in the area. A sizeable wetland
has been mapped on both sides of NE 201h Street, in the vicinity of the Blueberry Farm.
Wetland determinations in some areas where the wetland has mapped have shown class II
and class III wetlands, and in other areas there have been no wetlands found. A type four
waterway meanders through the area with drainage ultimately ending up in Lake
Washington via Kennydale Creek. Steep slopes exist between the area and the freeway,
affecting some properties on Jones Road. The area as a whole gently slopes up toward
the north, but the area could be characterized as rolling with a series of ridges and
depressions. Specific properties that are free of critical area constraint are still part of the
environmental and hydrological system. Lower intensity zoning in this area would allow
future development in this area to remain at about the same intensity as the existing
development. The rezone would be one measure to prevent unintended cumulative
impacts from future development from further altering the natural features and hydrology
of this area.

provided to member of the public for review on this day. When the files were returned
and accounted for on Monday, October 16, 2006 file LUA 06-122 was missing. After an
exhaustive search, the file could not be located. All the originals accepted by the City

The Washington Department of Fish and Wildlife (WDFW) has reviewed the above -referenced
Proposed Determination of Non -significance, and offers the following comments at this time.
Other comments may be offered if the project progresses.
A Hydraulic Project Approval (HPA; RCW 77.55.0211WAC 220-110; to be issued by WDFW)
would be required for activity affecting the natural bed or flow of the stream or its associated
wetlands.
The stream on the property is the upper end of Kennydale Creek and should be classified at least
as a class 2 perennial stream. It supports crayfish and other unidentified fish species. The
wetlands are a rare peat soil based system of very high value, especially if restored and given
adequate buffering. WDFW believes it is imperative to preserve and protect these wetlands, as
directed by the Growth Management Act (GMA), and it would be contradictory to the GMA to
rezone this property and allow dense residential development, particularly without a carefully
planned and implemented mitigation plan. Development of the property without such a plan
would result in disruption of the natural drainage and the degradation of the quality of the stream
and wetland system. WDFW also notes the buffers widths being considered are inadequate to
protect this very sensitive system.
Furthermore, WDFW believes it would be premature to evaluate the potential impacts of the
proposed rezone without a proper wetland delineation and a full biological evaluation. The
SEPA checklist is lacking key information concerning fish and wildlife use of the site and the
area near the site. A variety of wildlife species (including great blue herons, osprey, pileated
woodpeckers, deer, ducks, and shorebirds) have been observed using this area for habitat, but

that is not mentioned in the SEPA checklist. Nor does the checklist even mention the existence
of the wetland. As it is, there is no scientific basis by which to evaluate the potential impacts
of the proposed rezone on the wetland or stream system or the fishlife and wildlife which
use it for habitat. This proposal should not proceed without further study and a plan to
restore the wetland and its buffers.

perpetuate, and manage the fish and wildlife resources of the state of Washington.

I am writing in opposed to the proposition of rezoning the Upper Kennydale area from R-8 to R-
4 zoning. My husband and I recently purchased property in the area that is under review of
rezoning. The property currently has a small house on it, and we are looking to subdivide the
land for short plat. We have plans to keep the small house for my parents and build another
house in this currently subdividable land for my family and me to live in.
There are many reasons we purchased this new property. The first and foremost reason is that we
have lived in the Upper Kennydale neighborhood for many years, and we have grown fond of this
neighborhood, so we would like our children to grow up here. Secondly, my disabled father and
elderly mother are currently living with my family and me. However, we have outgrown our
current house, and needed new living arrangements. We jumped at the opportunity to buy this
new property because my parents could live next door to us so we could still provide assistance
for my disabled father.
If the proposition for rezoning from R-8 to R-4 is approved, then we will not be able to short plat
the property. Since our intent for subdividing the land is solely for personal use, not for
investment, this change will create a big financial burden to us as we have already made the

The area proposed for rezone in Upper Kennydale is approximately 36.5 acres rn thecE %i/ d
vicinity of Jones Ave NE to the west, Kennewick and Monterey Avenues NE to the east,
north of NE 16'h Street, and south of NE 27th and NE 28d' Streets. The current zoning is
Renton R-8, with Residential Single Family Land Use designation and the proposed
zoning is Renton R-4, with Residential Low Density Land Use designation. This would
require a Comprehensive Plan Amendment.
It is surrounding the area known as the Kennydale Blueberry Farm. The owners of this
3.4 acre parcel have made private application for rezone under files CPA 2006-M-2 and
LUA 05-159.
The existing land use of the area is for 96 single family homes. Under the current R-8
zoning, Buildable lands capacity calculations show that there is potential for
approximately 205 units in this area. Under the proposed R-4 zoning, Buildable lands
capacity estimates the potential for approximately 110 units in this area.
The proposed rezone is requested for several reasons. At the time in which the R-8
zoning was put into place for this area, the zoning choice was between R-1 (Residential -
one unit per acre) or R-8. There was no intermediate R-4 designation, as now exists.
Development in the area has organically occurred at about the same level of intensity as
an R-4 zone. The majority of the development in the area occurred prior to the
implementation of the R-8 zone. Permit history shows that development has affected the
hydrology of the area. Although each project has complied with the rules and regulations
in effect at the time of development, the cumulative effect of the projects has resulted in
some changes. Recent development that has realized the full extent of the R-8
regulations has been especially noticeable and has resulted in neighbor response.
Critical areas are likely to encumber some the properties in the area. A sizeable wetland
has been mapped on both sides of NE 20`' Street, in the vicinity of the Blueberry Farm.
Wetland determinations in some areas where the wetland has mapped have shown class II
and class III wetlands, and in other areas there have been no wetlands found. A type four
waterway meanders through the area with drainage ultimately ending up in Lake
Washington via Kennydale Creek. Steep slopes exist between the area and the freeway,
affecting some properties on Jones Road. The area as a whole gently slopes up toward
the north, but the area could be characterized as rolling with a series of ridges and
depressions. Specific properties that are free of critical area constraint are still part of the
environmental and hydrological system. Lower intensity zoning in this area would allow
future development in this area to remain at about the same intensity as the existing
development. The rezone would be one measure to prevent unintended cumulative
impacts from future development from further altering the natural features and hydrology
of this area.

PURPOSE OF CHECKLIST: SEP 5 2006
The State Environmental Policy Act (SEPA), Chapter 43.21 C RCW, requires all gave lepalw6s to
consider the environmental impacts of a proposal before making decisions. An Environmental Impact
Statement (EIS) must be prepared for all proposals with probable significant adverse impacts on the
quality of the environment. The purpose of this checklist is to provide information to help you and the
agency identify impacts from your proposal (and to reduce or avoid impacts from the proposal, if it can be
done) and to help the agency decide whether an EIS is required.
INSTRUCTIONS FOR APPLICANTS:
This environmental checklist asks you to describe some basic information about your proposal.
Governmental agencies use this checklist to determine whether the environmental impacts of your
proposal are significant, requiring preparation of an EIS. Answer the questions briefly, with the most
precise information known, or give the best description you can.
You must answer each question accurately and carefully, to the best of your knowledge. In most cases,
you should be able to answer the questions from your own observations or project plans without the need
to hire experts. If you really do not know the answer, or if a question does not apply to your proposal, write
"do not know" or "does not apply". Complete answers to the questions now may avoid unnecessary
delays later.
Some questions ask about governmental regulations, such as zoning, shoreline, and landmark
designations. Answer these questions if you can. If you have problems, the governmental agencies can
assist you.
The checklist questions apply to all parts of your proposal, even if you plan to do them over a period of
time or on different parcels of land. Attach any additional information that will help describe your proposal
or its environmental effects. The agency to which you submit this checklist may ask you to explain your
answers or provide additional information reasonably related to determining if there may be significant
adverse impact.

This non project action includes rezoning approximately 36.5 acres to R-4 in the Upper Kennydale
Area from R-6. This includes comprehensive plan amendment 2006-M-8 to change the land use
designation from RSF (Residential Single Family) to RLD (Residential Low Density). The area
includes approximately 96 single family homes. It also surrounds the property known as the
Kennydale Blueberry Farm- which is in agricultural use at the present time. A separate, private
application for rezone of the Kennydale Blueberry Farm is being considered under
Comprehensive Plan Amendment application 2006-M-2 and the environmental review for that
private application has been assigned to file LUA 05-159.

E 1/2 of Section 5, Township 23 N, Range 5E. The area is located along Jones Ave NE Between NE 16m
Street and just south of NE 276'1NE 2e Street and is located between Interstate 405, and (roughly)
KennewickNonterey Ave NE. See attached maps.

The current use of this area is primarily for detached single-family residences. There are
currently 96 single-family residences.

No. However, the site surrounds the property known as the Kennydale Blueberry Farm,
which has been operated as a U pick for several decades. The Kennydale Blueberry
Farm owners have applied for Comprehensive Plan Amendment and Rezone, and their
private application is reviewed in CPA 2006-M-2 and LUA 05-159.

There are 96 detached single-family residences on this site, some with accessory
buildings/garages.
d. Will any structures be demolished? If so, what?
This is a non -project action and it is unlikely that any of the structures will be demolished.

R-8, 8 units per net acre.

Yes- the type four waterway requires a development buffer. There are pockets of steep
slopes along Interstate 405 and there are undelineated wetlands and delineated class two
and three wetlands in this area.

This is a non project action. With 96 single family homes, it is estimated that
approximately 220 people live here. Under the current zoning, there is Buildable lands
capacity for approximately 205 single family homes, or 471 people. Under the proposed
zoning, the Buildable lands capacity is 110 homes, or 253 people.

Because these questions are very general, it may be helpful to read them in conjunction with the
list of the elements of the environment.
When answering these questions, be aware of the extent the proposal, or the types of activities
likely to result from the proposal, would affect the item at a greater intensity or at a faster rate than
if the proposal were not implemented. Respond briefly and in general terms.
How would the proposal be likely to increase discharge to water; emissions to air; production,
storage, or release of toxic or hazardous substances; or production of noise?
It is unlikely that the proposal would have any affect on the above environmental issues. Some
additional residential development is likely to occur on this site with or without the proposal.
However, the capacity for future development would be capped by the proposed action. Under
the current zoning there is capacity for 205 dwelling units, where as under the proposal there
would only be capacity for approximately 110 units. The proposed capacity is only a small
increase over the existing level of development at 96 units.
Proposed measures to avoid or reduce such increases are:
New development resulting as a consequence of these proposed amendments would be required
to comply with the City's development regulations, including the City's Critical Areas Ordinance.
2. How would the proposal be likely to affect plants, animals, fish, or marine life?
There would be no affect on plants, animals, fish, or marine life as a direct consequence of this
non project, prezoning proposal. There may be some displacement of existing vegetation to clear
undeveloped lots for future development, which is likely to occur under the both the present
conditions and the proposal. Since larger lot sires and less development would generally be
allowed under the proposal, there would be less potential land clearing and less potential impact
to plants and animals In the area.
Proposed measures to protect or conserve plants, animals, fish, or marine life are:
None at this non -project level. Development of additional dwelling units under this proposal must
comply with City of Renton regulations and with Renton's Critical Areas Ordinance. Any
measures needed in this regard will be implemented at the project level review.
3. How would the proposal be likely to deplete energy or natural resources?
The proposed non project action will not deplete energy or natural resources. Future project level
development may impact energy or natural resources slightly but will not deplete them.

None are proposed at this non -project action stage.

This proposal would likely not use or affect environmentally sensitive areas. At such time that
additional dwelling units are developed on this site, they will be subject to City of Renton critical
area regulations and development standards that are designed to protect environmentally
sensitive areas. Since the proposal caps the potential Buildable lands capacity at just above the
present level of intensify (110 units, compared to the existing 96 units and the potential for 205
units under full buildout under the current R-6 zone) there would likely be less impact to
surrounding environmentally sensitive areas under the proposal than under the current condition.

or encourage land or shoreline uses incompatible with existing plans?
The proposal will limit the number of units built in this neighborhood. There are 96 existing units
and capacity for 205 units under current zoning regulations. Under the proposal, there would only
be capacity for approximately i 10 units. This means that the proposal is likely to preserve the
style and intensity of land uses already existing in the area and will prevent some of the infrll and
more intensive development that is likely to occur without the proposal.
Proposed measures to avoid or reduce shoreline and land use impacts are:
None.
6. How would the proposal be likely to increase demands on transportation or public services and
utilities?
At current levels of development there are 96 units and approximately 960 AWDVTE in this area.
Additional development is likely to occur in this area with or without the proposal. However, at full
development under the current zoning there is a potential for 205 units, or 2050 AWDVTE. The
proposal would result in approximately 110 total units and 1100 AWDVTE.
Proposed measures to reduce or respond to such demand(s) are:
