Project description: The applicant is proposing to use Lots 1 and 4 of the Southport
Site (1053 and 1101 Lake Washington Boulevard North, respectively) for temporary
outdoor events. The proposed location is 359,673 square feet in size and is currently
used as a gravel parking lot, a public waterfront promenade, and an open lawn area.
The outdoor events would be held in the open lawn area, and would include concerts,
festivals, weddings, corporate events, and other such public and private activities.
Proposed events would take place from 8:00 a.m. to 11:00 p.m. for weekday events and
with later hours for weekend events. Events would occur two to three times per week
with a maximum attendance of 2,540 people for each event. Depending on the nature
of the event, temporary tents and/or temporary stages could be used. A total of 635
temporary parking stalls are proposed to accommodate the maximum number of
attendees (1 parking stall per 4 attendees = 635 stalls). Temporary restroom facilities
would be placed on the west side of the gravel parking area. No grading, permanent
structures, permanent impervious surfaces or other permanent improvements are
included in the proposal. This proposal is similar to LUA05-165, Temporary Use Permit
which expired on February 8, 2008.
Decision: The Southport Outdoor Events Temporary Use Permit, Project
LUA08-039 is approved subject to the conditions below.

Date of Expiration: June 6, 2010
Conditions of Approval:
1. Temporary event activities may not occur on days during which Gene Coulon
Park is subject to heavier than normal use due to annual festivals and events.
These include the following:
• Renton Kids Fishing Derby and Bass Tournament
• July 4
• Renton River Days
• Clam Lights Day
2. Weekday hours of operation for events shall be 8:00 a.m. to 11:00 p.m.
3. The maximum number of attendees at any individual event shall be 2,540
people.
4. The maximum number of temporary parking stalls shall be 635.
Should the new proposed local Fire Code amendments be adopted, there shall
be two new amendments that will be applicable to special events:
A) Events with an occupancy load greater than 300 persons shall
require a Special Events Permit; and,
B) Events with an occupancy load of 300 or greater shall require an
Automatic External Defribrillator.

together with the required $75.00 application fee to the City of Renton Hearing Examiner,

The project proposal is for the continuation of the hosting of outdoor events at Lots 1 anc
4 of the Southport site. The proposed location is 359,673 square feet in size and is
currently used as a gravel parking lot (100 spaces currently approved under a temporary
use permit), a public waterfront promenade, and an open lawn area. Lots 1 and 4 are
zoned UC-N2 and are vested to the COR3 regulations under the Southport Master Plan.
The outdoor events would be held in the open lawn area. Events would include
concerts, festivals, weddings, corporate events, and other such public and private
activities. Proposed use is from 8am to 11 pm, with later hours for weekend events as
the City permits. Events would likely occur 2-3 times per week.
The events would be planned to host up to 2,540 attendees and could involve a
temporary tent and/or a temporary stage depending on the type of event. All materials
would be fire resistant to comply with fire and safety codes.
635 temporary parking stalls (including the existing 100 parking stalls approved under
the above -reference temporary use permit) are proposed to accommodate the maximum
size event. The zoning code requires 1 parking stall per 4 fixed concert seats. The
proposed events would not have fixed seating, but applying the zoning formula to the
maximum event size of 2,540 attendees equates to 635 parking stalls.
To avoid conflicts with days on which Gene Coulon Park is subject to heavy use,
temporary events would not be held on the following days, unless approved otherwise by
city staff. -

Temporary restroom facilities would be placed on the west side of the gravel parking
area.
No grading, permanent structures, permanent impervious surfaces, or other permanent
improvements are included in the proposal, as the site contains an existing lawn area for
seating and event facilities and an existing gravel/paved area for parking.

Release and Indemnification Agreement for Model Homes
This agreement is made by and between the City of Renton, Washington, a municipal corporation of the State
of Washington ("City") and ("Owners")_
Recitals
The Owners own real property in the City legally described in Exhibit A, attached.
The Owners have submitted an application for building permit(s) and/or a Temporary Use Permit to construct
model homes on the real property prior to recording of a short plat or final plat. Since changes to the short plat
or final plat may be necessary after construction of the model homes rendering the homes illegal, there is some
risk in building the model homes.
In consideration of the inherent risks associated with the construction of buildings in advance of the recording of
the plat, the City requires the owner to execute an indemnification agreement prior to any model home
construction activities.
Agreement
The parties agree to the following:
The City authorizes the Owners to do the work as described in the Temporary Use Permit application

2. The owners assume the risk that the model home(s) must be removed or reconfigured and therefore
release and discharge the City and its representatives from all known and unknown losses, claims,
damages or causes of actions which the owners have or may have relating to buildings or structures
authorized by the Temporary Use Permit.
3_ As a condition of granting Owner permission to construct model homes, Owner agrees to indemnify,
defend and hold the City of Renton Harmless from any claims or liens that may be exerted against the
property as a result of construction of model homes and use of the unrecorded plat of
4. Owners understand and acknowledge that, should the model home construction not comply with the
proposed lot configuration of the final plat, that no variances to development standards for either the
lots or the homes may be granted as such a situation would be considered a "self-induced hardship".
5. Owners acknowledge that they understand that any construction begun prior to the recording of the final
plat must be in compliance with all City zoning and subdivision requirements (e.g. setbacks, lot
coverage, etc.) or removed prior to recording of the final plat. If the final plat is not recorded prior to the
expiration of the Temporary Use Permit, Owners acknowledge that the homes must be removed unless
complying with all applicable code requirements (e.g. one home per lot, etc.).
6. Applicant will also provide an Abatement Agreement and a security device acceptable to the City to
ensure removal of any structures not in compliance with City regulations at the time of expiration of the
Temporary Use Permit and understands construction of the model homes is at Owners' own risk.
The provisions of this agreement shall bind the parties, their legal heirs, representatives, successors
and assigns and shall expire upon the recording of the final plat of
