Purpose: Notification of Receipt and Approval of Revised Conditional Use Permit
On July 28, 2008, the Department of Ecology (Ecology) received the City of Renton decision
on your Shoreline Conditional Use Permit for installing a boatlift in an existing boathouse
within the shoreline jurisdiction of Lake Washington.
By law-, Ecology must review all Conditional Use Permits for compliance with the following:
• The Shoreline Management Act (Chapter 90.58 RCW)
• Ecology's Conditional Use Permit approval criteria (Chapter 173-27-160 WAC)
• The Renton Shoreline Management Master Program
After reviewing Conditional Use Pern-tits for compliance, Ecology must decide whether
to approve, approve with conditions, or disapprove a Conditional Use Permit.
Our Decision:
Ecology approves your Conditional Use Permit provided your project complies with the
permit conditions required by the City of Renton and the following conditions.
The applicant hereby authorizes Ecology staff and their designees to have access
to the subject property for the purposes of compliance inspection and monitoring.
Such right of access shall begin from the date of the receipt of this letter, during
construction, and extend for a period of five years following project completion.
Ecology staff must provide reasonable verbal notice to the applicant or their
designee prior to coming onto the site.

Please note, however, that other federal, state, and local permits may be required in
addition to this shoreline permit.
What Happens Next?
Before you begin activities authorized by this permit, the law requires you to wait at least
21 days from the mailing date of this letter (see certification above). This waiting period
allows anyone (including you) who disagrees with any aspect of this permit, to appeal the
decision to the state Shorelines Hearings Board. You must wait for the conclusion of an
appeal before you can begin the activities authorized by this permit.
If no appeal is submitted you may begin activities any time after September 1, 2008.
The Shorelines Hearings Board will notify you by letter if they receive an appeal. We
recommend, however, you contact the Shorelines Hearings Board before you begin
permit activities to ensure no appeal has been received. They can be reached at
(360) 459-6327 or http://www.eho.wa.gov/Boards/SHB.asp.

freestanding, portable boatlift inside an existing boathouse in
association with an existing single-family residence.

PUBLIC HEARING: After reviewing the Development Services Report, examining
available information on file with the application, field
checking the property and surrounding area; the Examiner
conducted a public hearing on the subject as follows:
MINUTES
The following minutes are a summary of the July 1, 2008 hearing.
The legal record is recorded on CD.
The hearing opened on Tuesday, July 1, 2008, at 9:02 a.m. in the Council Chambers on the seventh floor of the
Renton City Hall. Parties wishing to testify were affirmed by the Examiner.

The hearing opened with a presentation of the staff rcport by Gerald Wasser, Associate Planner, Development
Services, City of Renton, 1055 S Grady Way, Renton, Washington 98055. This project is located off the
shoreline of Lake Washington at 3709 Lake Washington Boulevard North. The proposed action is the assembly
and installation of a pre -manufactured marine grade aluminum freestanding portable boatlift within an existing
Pasquier Boat lift

boathouse that is approximately 966 square feet in area. The proposed boatlift is approximately 10-feet wide by
I0-feet long. The boatlift would be at a depth of approximately four feet below the ordinary high water mark.
The site is located in the R-8 zone. There would be no change in the use of the property, the site including the
existing single-family residence and the boathouse is 4,349 square feet. Assembly of the boatlift would take
place onshore within 20-feet of Lake Washington, the assembled boatlift weighs approximately 500 pounds and
rests of 4' pads that are approximately 12" by 18" and would sit directly on the lake bottom. It is not anchored to
the lake bottom
The duration of the assembly is estimated at approximately 4 hours and is handled by two people. The
assembled boatlift will be hand carried or floated on temporary buoys into place within the existing boathouse.
All assembly and installation will take place within the construction window of July 16 through December 31,
2008.
The cost of the boatlift, $8,300 was the cause of requiring a Shoreline Substantial Permit
The Environmental Review Committee issued a Determination of Non -Significance, no further mitigation is
necessary.
The proposed boatlift meets the City of Renton development standards and building code requirements. Only
one watercraft will be maintained at this site. This boatlift is further compatible with the objectives and policies
of the City's Master Program as an accessory water use to an existing residential use.
The site is not adjacent to any public shoreline and therefore, no interference with the public shoreline or its use
is anticipated. This section of Lake Washington is designated as an Urban Environment and as a developed
shoreline with residential uses.
Gregory Ashley, 16412 NE 10`s Place, Bellevue, WA 98008 stated that he is the agent for Mr. Pasquier. This is
a freestanding boatlift with a high-pressure hydraulic boat battery. It is a solar charged boatlift completely self-
contained. The boatlift is designed to not leak, however the hydraulic fluid is EPA approved as biodegradable
non -toxic. The boatlift is completely freestanding, there is no need to attach it or anchor it in any way. Each
footpad is approximately twelve inches by eighteen inches and they are the only part of the boatlift that actually
touches the lakebed. There is very little assembly required at the site, the front of the boathouse opening is
approximately 13 feet wide. Two men will do the installation, they will use hand tools only, place the boatlift in
the water, float it around into the boathouse and then lower it in place and adjust it.
Kayren Kittrick, Development Services requested that they call for a locate, there is a sanitary sewer in the
shoreline at that area. There should be no problems, as the sewer line currently runs under the boathouse. It is
necessary to know exactly where that line runs under the boathouse, they need to beware and lower the pads
carefully.
The Examiner called for further testimony regarding this project. There was no one else wishing to speak, and
no further comments from staff. The hearing closed at 9:21 a.m.
FINDINGS, CONCLUSIONS & RECOMMENDATION
Having reviewed the record in this matter, the Examiner now makes and enters the following:

FINDINGS:
The applicant, Paul L. Pasquier, filed a request for a Shoreline Conditional Use Permit and a Shoreline
Substantial Development Permit.
The yellow file containing the staff report, the State Environmental Policy Act (SEPA) documentation
and other pertinent materials was entered into the record as Exhibit #1.
The subject site is located at 3709 Lake Washington Boulevard North. The parcel is located on the
shoreline of Lake Washington.
4. The map element of the Comprehensive Plan designates the area in which the subject site is located as
suitable for the development of single-family homes, but does not mandate such development without
consideration of other policies of the Plan.
5. The subject site is currently zoned R-8 (Single Family - 8 dwelling units/acre).
6. The subject site was annexed to the City with the adoption of Ordinance 1804 enacted in December
1959.
A single family home is located on the subject site. Associated with the residence are an approximately
272 square foot pier and an approximately 966 square foot boathouse.
The applicant proposes installing an approximately 10 foot by 10 foot, freestanding boatlift inside the
existing boathouse.
9. The boatlift is pre -manufactured and made of marine grade aluminum. It weights approximately 500
pounds. A small crew will do the assembly and installation. It will be assembled onsite and then
floated to the installation location in the boathouse. Assembly and installation generally takes a few
hours.
10. The lift will not be anchored to the lakebed. The weight of the lift will keep it anchored in place.
11. The lift uses EPA certified hydraulic materials, which are non -hazardous agents so even if a leak or spill
occurred there would be no harm to the lake or fish. A solar powered battery will generate power for
the lift operation.
12. The installation will be limited to a time frame or construction window between July 16 and December
31, 2008. This will prevent the installation from interfering with fish runs in the lake.
13. There will be no changes made to the uplands. The boatlift will be entirely contained in the existing
boathouse so there will be no changes to view corridors or the profiles of any buildings. No temporary
work sheds will be required. No trees or landscaping should be disturbed by the proposal.
14. A sewer line runs offshore past this location and the applicant's team should investigate its location
before proceeding.
CONCLUSIONS:
There are five main criteria and a number of sub -criteria that must be satisfied before a Shoreline

Conditional Use Permit may be issued. The main criteria are found in Section 4-9-190(I):
1. The use must be compatible with other permitted uses within that area_
2. The use will not interfere with the public use of public shorelines.
3. Design of the site will be compatible with the surroundings and the City's
Master Program.
4. The use shall be in harmony with the general purpose and intent of the
City's Master Program.
5. The use meets the conditional use criteria in WAC 173-27-160.
The additional criteria are found in:
"WAC 173-27-160 Review criteria for conditional use permits. The purpose of
a conditional use permit is to provide a system within the master program which
allows flexibility in the application of use regulations in a manner consistent with
the policies of RCW 90.58.020. In authorizing a conditional use, special conditions
may be attached to the permit by local government or the department to prevent
undesirable effects of the proposed use and/or to assure consistency of the project
with the act and the local master program.
(1) Uses which are classified or set forth in the applicable master program
as conditional uses may be authorized provided that the applicant
demonstrates all of the following:
(a) That the proposed use is consistent with the policies of
RCW 90.58.020 and the master program;
(b) That the proposed use will not interfere with the normal public
use of public shorelines;
(c) That the proposed use of the site and design of the project is
compatible with other authorized uses within the area and
with uses planned for the area under the comprehensive plan
and shoreline master program;
(d) That the proposed use will cause no significant adverse effects
to the shoreline environment in which it is to be located; and
(e) That the public interest suffers no substantial detrimental effect.
(2) In the granting of all conditional use permits, consideration shall be given
to the cumulative impact of additional requests for like actions in the area.
For example, if conditional use permits were granted for other developments
in the area where similar circumstances exist, the total of the conditional
uses shall also remain consistent with the policies of RCW 90.58.020 and
shall not produce substantial adverse effects to the shoreline environment.
(3) Other uses which are not classified or set forth in the applicable master
program may be authorized as conditional uses provided the applicant can
demonstrate consistency with the requirements of this section and the

requirements for conditional uses contained in the master program.
(4) Uses which are specifically prohibited by the master program may not
be authorized pursuant to either subsection (1) or (2) of this section."
2. The proposed boatlift is consistent with the policies of the Shoreline Management Act. Single family
homes and accessory structures such as docks and the occasional boathouse and lift are permitted along
the shoreline and over the lake. The waterfront along this portion of Lake Washington is currently
developed with residential water -related uses.
3. The proposed boatlift will be contained within an existing boathouse along a section of privately owned
shoreline. Therefore, it will not interfere with the public use of public shorelines anymore than already
occurs.
4. Again, the boatlift will be inside an existing boathouse. There will be no design changes to the exterior
or profile of the dock or boathouse and it should remain compatible with the surrounding uses.
The freestanding residential boatlift will not be attached to the lakebed and its four legs should not
interfere with fisheries. The mechanism is equipped with non -hazardous hydraulic materials so
accidental leaks should not impair the water quality. It will be installed during an appropriate window
to not interfere with fish migration or passage.
6. Since there will be no exterior changes over the water or on the uplands, the proposal appears to be in
harmony with the Master Plan.
In addition to the above criteria, the proposal has to be consistent with the criteria in WAC 173-27-160.
Some of these criteria match or are very similar to those already discussed. The proposed, boathouse -
contained boatlift is consistent with the urban shoreline represented by this site. It appears to "do no
harm" to the shoreline, the lake or public access to the lake or shoreline. The proposed inside boatlift
will not interfere with the normal public use of public shoreline. There is already a pier and boathouse
in this location so there will be no additional interference with normal uses of the shoreline.
The proposed use is compatible with the residential uses both at the subject site and on neighboring
parcels. Docks and piers are permitted. The boathouse already exists and will not be expanded. A
boatlift contained with the existing boathouse is compatible in design and use to the adjacent lakefront
residential properties. As noted, the boatlift will merely sit on the lakebed and not be anchored. It
presents a very narrow profile or impediment to fish passage. Its lift mechanism will be solar powered
and non -hazardous. There should be no significant adverse effects to the shoreline environment. While
a proliferation of docks and piers can have a cumulative impact, the installation of a boatlift inside an
existing boathouse does not appear to create any unnecessary problems.
9. Finally, the use is not a prohibited use and may be authorized and it does not appear that it would create
substantial detrimental effects on the public interests.
10. As noted at the Public Hearing, this decision is treated as a recommendation to the Department of
Ecology. That agency will take further action as necessary.
DECISION:
The Shoreline Conditional Use Permit is approved subject to the following conditions
The applicant shall abide by all other State and Federal mandates on when installation shall
occur and materials used in the facility.

The Appearance of Fairness Doctrine provides that no ex parte (private one-on-one) communications may occur
concerning pending land use decisions. This means that parties to a land use decision may not communicate in
private with any decision -maker concerning the proposal. Decision -makers in the land use process include both
the Hearing Examiner and members of the City Council.
All communications concerning the proposal must be made in public. This public communication permits all
interested parties to know the contents of the communication and would allow them to openly rebut the
evidence. Any violation of this doctrine would result in the invalidation of the request by the Court.
The Doctrine applies not only to the initial public hearing but to all Requests for Reconsideration as well as
Appeals to the City Council.

1_ PROJECT DESCRIPTION/BACKGROUND
The applicant has requested a Shoreline Conditional Use Permit and a Shoreline Substantial
Development Permit for the installation of a residential boatlift. The property contains a single
family residence with a 272 square -foot pier and an existing approximately 966 square foot boat
house.
The proposed land use action, the installation of a pre -manufactured, marine grade aluminum,
freestanding, portable boatlift (approximately 10 feet long by 10 feet wide), within an existing
boat house associated with an existing single family residence, would take place at 3709 Lake
Washington Boulevard. The boatlift would be at a depth of approximately 4 feet below the
Ordinary High Water Mark (OHWM). The site and adjacent properties are located along the
shore of Lake Washington in the R-8 zone. The existing shoreline at the project site consists of
a fixed pile dock with a wooden boat house. There is a rock bulkhead along the shoreline and
the lakebed in this vicinity consists of sand and gravel. No change in use of the property will
occur as the result of the proposed project.
Assembly of the proposed boatlift would take place on shore within 20 feet of Lake Washington.
The assembled boatlift weighs approximately 500 pounds and rests on four "foot pads" (12 inches
x 18 inches) which would sit directly on the lake bottom. Duration of assembly and installation is
expected to last approximately four hours and is typically handled by two people. The assembled
boatlift will be hand carried or floated on buoys to its location in the existing boat house. The
boatlift would be operated by a hydraulic motor run by a solar powered 12 volt battery.
Installation would take place within the construction window established by the Department of
Fish and Wildlife, July 16 — December 31, 2008, No job shack is necessary and no off -site
improvements, excavation or fill are proposed. No trees are proposed to be removed and no
modifications are requested as part of the proposed project. Because the proposed boat lift
would be enclosed within an existing boat house, the proposed project would not obstruct views
from surrounding properties. The cost of the boatlift and the fair market value of the project is
$8,300.00.
2. ENVIRONMENTAL REVIEW
Pursuant to the City of Renton's Environmental Ordinance and SEPA (RCW 43.21C, 1971 as
amended) on June 2, 2008 the Environmental Review Committee (ERC) issued a Determination
of Non -Significance (DNS) for the Pasquier Boatlift. A 14-day appeal period ended on June 23,
2008. No appeals of the threshold determination were filed.

3. COMPLIANCE WITH ERC MITIGATION MEASURES
A Determination of Non -Significance was issued by the City of Renton's Environmental Review
Committee (ERC) on June 2, 2008 requiring no further environmental mitigation.
4. STAFF REVIEW COMMENTS
Representatives from various city departments have reviewed the application materials to identify
and address site plan issues from the proposed development. These comments are contained in
the official file, and the essence of the comments has been incorporated into the appropriate
sections of this report and the Departmental Recommendation at the end of the report.
5. CONSISTENCY WITH SHORELINE CONDITIONAL USE CRITERIA:
RMC Section 4-9-190.1 lists 5 criteria that the Hearing Examiner is asked to consider when
making a decision on a Shoreline Conditional Use application. These include the following:
(1) The use must be compatible with other permitted uses within that area.
The applicant proposes to install a pre -manufactured, freestanding, portable boatlift within an
existing approximately 966 square foot boat house in association with an existing single family
residence on the shore of Lake Washington. The waterfront along this portion of Lake
Washington is currently developed with residential water -related uses. The site currently does not
include a boat lift.
(2) The use will not interfere with the public use of public shorelines.
The proposed residential boatlift would be located within the existing approximately 966 square
foot boat house. The approximate 10 foot x 10 foot lift will meet City of Renton development
standards and Building Code requirements. The proposed use is for one watercraft to be
maintained at this site, which is along private shoreline.
(3) Design of the site will be compatible with the surroundings and the City's Master
Program.
The proposed 10 foot x 10 foot freestanding residential boatlift would be located within an existing
boat house. The City's Shoreline Master Program regulations require a minimum five feet setback
to an adjacent property line. Additionally, it is compatible with other properties with such
structures in the surrounding area.
The City's Shoreline Master Program (WAC 173-26-230 b) states the design and construction
shall avoid or, if that is not possible, shall minimize and mitigate the impacts to ecological
functions, and critical areas resources. The proposed residential boatlift is compatible with the
objectives and policies of the City's Master Program as an accessory water use to an existing
residential use.
(4) The use shall be in harmony with the general purpose and intent of the City's Master
Program.
The use is a residential accessory use often associated with single family waterfront residences.
While no setbacks are established in the Comprehensive Plan or Development Regulations for
boatlifts, in the City of Renton, piers and docks require a five (5) ft. side yard setback and can not
exceed 80 feet in length. These regulations would not necessarily be applied to a boatlift,
however, in this instance; the proposed boatlift would comply with the City specifications relative
to docks.

(5) The use meets the conditional use criteria in WAC 173-27-160, to provide a system within
the Master Program, which allows flexibility in the application of use regulations in a manner
consistent with the policies of RCW 90.58, 020. in authorizing a conditional use, special
conditions may be attached to the permit by local government or the department to prevent
undesirable effects of the proposed use and/or to assure consistency of the project with the
act and the local master program.
(A) Uses which are classified or set forth in the application master program as
conditional uses may be authorized provided that the applicant demonstrates all the
following:
i) That the proposed use is consistent with the policies of RCW 90.58.020 and
the master program. Lake Washington is classified as a Shoreline of Statewide
Significance. The proposed private residential boatlift demonstrates compliance
and/or non -applicability to the policies of RCW 90.58.020 and the master
program.
ii) That the proposed use will not interfere with the normal public use of public
shorelines. The subject site is single-family residential private property on the
shores of Lake Washington. No interference with the public use of public
shoreline is anticipated to occur, as the site is not directly adjacent to any public
shoreline.
iii) That the proposed use of the site and design of the project is compatible
with other authorized uses within the area and with uses planned for the area
under the comprehensive plan and shoreline master program. The subject site is
designated Residential Single -Family in the City's Comprehensive Plan and the
proposed use qualifies as an accessory use to the waterfront property. The
residential boatlift is compatible in design and customary use to the adjacent
lakefront residential properties and the Shoreline Master Program as discussed
previously.
iv) That the proposed use will cause no significant adverse effects to the
shoreline environment in which it is to be located. This section of Lake
Washington is designated as Urban Environment in the Shoreline Master
Program regulations and is a developed shoreline of residential uses. if the
boatlift is installed and maintained according to all required state and local
permits, the use is not expected to cause significant adverse effect to the
shoreline environment.
v) That the public interest suffers no substantial detrimental effects. Because
the site is a private single-family residential use, the proposed boatlift would be
located within an existing boat house and is the only watercraft lift proposed on
the site at this time, it is not anticipated any significant detrimental effects would
occur. The proposed boatlift would be located within an existing boat house and,
therefore, no adverse impacts to shoreline views are anticipated.
(B) In the granting of all conditional use permits, consideration shall be given to the
cumulative impact of additional requests for like actions in the area.
This single-family residential site has an existing approximately 966 square foot boat house
which is compatible with the adjacent residential properties. The applicant proposes to locate
the proposed boatlift within an existing boat house and, therefore, it is anticipated that no
adverse cumulative impact would occur.
(C) Other uses which are not classified or set forth in the applicable master program
may be authorized as conditional uses provided the applicant can demonstrate consistency
with the requirements of this section and the requirements for conditional uses contained in
the master program.

A residential boatlift is not a use set forth in the Shoreline Master Program. Therefore, this
project requires a Shoreline Conditional Use Permit. The criteria discussed in this report
have demonstrated the applicant's request is consistent with the requirements.
(D) Uses which are specifically prohibited by the master program may not be
authorized pursuant to either subsection (A) or (B) of this section.
A residential boatlift is not specifically prohibited by the City's Shoreline Master Program.

DEVELOPMENT DESCRIPTION:
The applicant has requested a Shoreline Conditional Use Permit and a Shoreline Substantial Development
Permit for the installation of a residential boatlift. The proposed project encompasses the assembly of a pre -
manufactured marine grade aluminum boatlift using common hand tools. Assembly and installation is
expected to take approximately four hours. The proposed boatlift would be assembled on shore adjacent to
and within 20 feet of Lake Washington.
The proposed project, the installation of pre -manufactured, marine grade aluminum, freestanding, portable
boatlift (approximately 10 feet long by 10 feet wide), within an existing boat house associated with an existing
single family residence, and would take place at 3709 Lake Washington Boulevard. The boatlift would be at
a depth of approximately 4 feet below the Ordinary High Water Mark (OHWM). The site and adjacent
properties are located along the shore of Lake Washington in the R-8 zone. The existing shoreline at the
project site consists of a fixed pile dock with a wooden boat house. There is a rock bulkhead along the
shoreline and the lakebed in this vicinity consists of sand and gravel. No change in use of the property will
occur as the result of the proposed project.
Assembly of the proposed boatlift will take place on shore within 20 feet of Lake Washington. The assembled
boatlift weighs approximately 500 pounds and rests on four "foot pads" (12 inches x 18 inches) which would
sit directly on the lake bottom. Duration of assembly and installation is expected to last approximately four
hours and is typically handled by two people. The assembled boatlift will be hand carried or floated on buoys
to its location in the existing boat house. The boatlift would be operated by a hydraulic motor run by a solar
powered 12 volt battery. Installation would take place within the construction window established by the

Location: 3400 block of NE 17th Place. Description: Application for Environmental Review for the development of a
single-family home on Lot 11 of Tall Firs at Honey Creek. The project site is located in the R-8 Zone. The site has
critical slopes and abuts Honey Creek, a Class 2 stream. In order to build the single-family home, three adminstrative
variances are requested, a reduced front yard setback, building on a critical slope, and a reduction in the stream
buffer. There are no wetlands onsite.
Boeing Paint Hangar (Dolbee)

Location: 737 Logan Avenue N. Description: The applicant is requesting a SEPA Environmental Review for the
reactivation of the 5-50 Paint Hangar located at 737 Logan Ave. N. The existing 5-50 building is 38,000 sq. ft. and is
located on a 168-acre parcel belonging to Renton Municipal Airport. The subject site is zone Industrial Medium (IM).
The purpose of the project would be to refurbish the 5-50 Paint Hangar to paint 737 series aircraft. The entire interior
of the facility would be demolished except the boiler room and associated equipment. Major upgrades would include
a walk-on ceiling, new body exhaust pits, and structural upgrades. The 5-50 building is located approximately 67 feet
west of the Cedar River's ordinary high water mark. The proposal is to refurbish the interior of an existing facility; as
such, the existing on -site storm drainage system would be utilized.

PART ONE: PROJECT DESCRIPTION 1 BACKGROUND
The proposed project encompasses the assembly of a pre -manufactured marine grade aluminum boatlift using
common hand tools. Assembly and installation is expected to take approximately four hours. The proposed
boatlift would be assembled on shore adjacent to and within 20 feet of Lake Washington.
The proposed land use action, the installation of a prc-manufactured, marine grade aluminum, freestanding,
portable boatlift (approximately 10 feet long by 10 feet wide), within an existing boat house associated with an
existing single family residence, would take place at 3709 Lake Washington Boulevard_ The boatlift would be at
a depth of approximately 4 feet below the Ordinary High Water Mark (OHWM). The site and adjacent
properties are located along the shore of Lake Washington in the R-8 zone. The existing shoreline at the project
site consists of a fixed pile dock with a wooden boat house. There is a rock bulkhead along the shoreline and the
lakebed in this vicinity consists of sand and gravel, No change in use of the property will occur as the result of
the proposed project.
Assembly of the proposed boatlift will take place on shore within 20 feet of Lake Washington. The assembled
boatlift weighs approximately 500 pounds and rests on four "foot pads" (12 inches x 18 inches) which would sit
directly on the lake bottom. Duration of assembly anti installation is expected to last approximately four hours
and is typically handled by two people. The assembled boatlift will be hand carried or floated on buoys to its
location in the existing boat house. The boatlift would be operated by a hydraulic motor run by a solar powered
12 volt battery. Installation would take place within the construction window established by the Department of
Fish and Wildlife, July 16 — December 31, 2008. No job shack is necessary and no off -site improvements,
excavation or fill are proposed. No trees arc proposed to be removed and no modifications are requested as part
of the proposed project. Because the proposed bowl lift would be enclosed within an existing boat house, the
proposed project would not obstruct views from Surrounding properties. The cost of the boatlift and the fair
market value of the project is $8,300.00.
PART TWO: ENVIRONMENTAL REVIEW
In compliance with RCW 43.21 C.240, the following, environmental (SEPA) review addresses only those project
impacts that are not adequately addressed under existing development standards and environmental regulations.

Based on analysis of probable impacts from the proposal, staff recommends that the Responsible Officials:
Issue a DNS -, ith a 14-day Appeal Period.

Impacts: The project does not require any fil l or excavation of soils. Assembly of the boatlift would take
place on shore within 20 feet of Lake Washington using common hand tools. The assembled boatlift will be
hand carried or floated on buoys to the existing boathouse. The approximately 500 pound boatlift would rest
directly on the lake bottom on four "foot pads- at a depth of approximately 4 feet below the Ordinary High
Water Mark (OHWM).
Mitigation Measures: No mitigation measures are recommended.

2. Water
Impacts: The project site is located on the eastern shore of Lake Washington along Lake Washington
Boulevard. Lake Washington is designated as a Shoreline of Statewide Significance and is considered to be
a Class I water subject to Renton's Shoreline Master Program. The shoreline is classified as an "Urban
Environment" in the City's Shoreline Regulations. This designation permits a variety of uses within the
shoreline area provided the use complies with the Master Program. Boatlifts are not outright permitted uses
arid, therefore, a conditional use permit is rcquired and will be reviewed by the Hearing Examiner.
Work would not be conducted over watcr.
Mitigation Measures: No mitigation rncasures are recommended.

3. Wildlife
Impacts: The proposed freestanding boatlift -would be installed in an existing 966 square foot boat house
within and over Lake Washington. Salnonids known to be present in southern Lake Washington include
Puget Sound Chinook salmon, coho salmon, sockeye salmon, steelhead trout, bull trout and cutthroat trout_
Puget Sound Chinook, Puget Sound steelhead and bull trout are listed as threatened by the Endangered
Species Act. The proposed boatlift would not likely result in adverse impacts to fish migration routes or
spawning areas. No additional lighting would be installed. Assembly and installation would be short term,
and would take less than one day to acconrl1liwh during the construction window established by the
Department of Fish and Wildlife, July 16 December 31, 2008_ No further shading would occur as the
boatlift would be installed in an existin(; structure,

that significant environmental impacts are unlikely to resjit from the proposed project. Therefore, as permitted under the
RCW 43.21C.110, the City of Renton is using the Optional DNS process to give notice that a DNS is likely to be issued.
Comment periods for the project and the proposed DNS are ritegrated into a single comment period. There will be no

General: We have completed a preliminary review of the pre -application for the above -referenced
development proposal. The following comments on development and permitting issues are based on
the pre -application submittals made to the City of Renton by the applicant and the codes in effect
on the date of review. The applicant is cautioned that information contained in this summary may be
subject to modification and/or concurrence by official decision -makers (e.g., Hearing Examiner. Zoning
Administrator, Development Services Director, Public Works Administrator, Community & Economic
Development Administrator and City Council.). Review comments may also need to be revised based on
site planning and other design changes required by City staff or made by the applicant. The applicant is
encouraged to review all applicable sections of the Renton Municipal Code. The Development
Regulations are available for purchase for S50.00 plus tax_ from the Finance Division on the first floor of

Project Proposal: The subject property is to install a freestanding portable boatlift inside an existing
boathouse at 3709 bake Washngton Blvd. North. The existing boathouse is within the 5-foot side yard

setback area and protrudes two feet into the neighboring property.
Zoning/Use: The subject property is Located within the R-8 zoning designation and has been designated
Residential Single :Family (RaSF) by the Comprehensive Plan. The required side yard setback in the R-8
zone is 3 feet, to which the existing boathouse does not conform. The applicant will need to apply for a
variance to allow the boathouse to be within the side yard setback area.
Critiesi Areas: The project is located along Lake Washington, a Shoreline of the State and is not
outright permitted by Renton's Shoreline Regulations. Therefore, a Hearing Examiner Conditional Use
Permit would be required, which is subject to subsequent review and approval by the Washington State
Department of Ecology. Staff will recommend to the Hearing Examiner that the Conditional Use Permit
contain a condition of approval that the applicant obtain an easement, or other legal means to allow the
boathouse to protrude into the yard of the neighbor to the north.
Environmental Review: The activity will take place on lands covered by water and is therefore subject to
Environmental (SEPA) Review.
Permit Requirements: To build the boatlift the applicant must make formal submittal for a Hearing
Examiner Conditional Use Permit, a Hearing Examiner Variance, a Shoreline Substantial Development
Permit and Environmental Review. A submittal checklist, listing the items that must be included in the
submittal packet to the City, is included in the preapplication meeting packet of information. Review by
the Hearing Examiner has an estimated time frame of 10-12 weeks for preliminary approval_

Paul Pasquier would like to install a freestanding portable boatlift inside his existing
boathouse. The site is a 4,349 sq. ft. single-family residential use parcel located at 3709
Lk. Wa. Blvd. N. The project will require both a Shoreline Substantial Development and
Conditional Use Permit. The site and adjacent properties are zoned R-8 and located along
the shoreline of Lake Washington. The existing shoreline consists of a fixed pile dock
with a wooden boathouse. There is a rock bulkhead along the shoreline. The lakebed
consists of sand and gravel. Drainage conditions are not applicable to this project. There
will not be any change to the existing use of the property. The scope of the project entails
assembly of a pre manufactured marine grade aluminum boatlift. Assemble will be
accomplished with common hand tools. The boatlift will be assembled on shore adjacent
to, and within twenty (20) feet Lake Washington. The time to assemble and place the
boatlift inside the boathouse is approximately four (4) hours. No job shack is needed.
No off site improvements, excavation or fill are proposed for this project. No trees are to
be removed, no land will be dedicated to the city, and no modifications are requested. No
existing residential units will have an obstructed view because of this project. The cost of
the boatlift and the fair market value of the project is $8,300.00.

Dear Mr. Wasser:
A. The proposed boatlift is compatible with Section 7.12 Piers and Docks of the
Renton Shoreline Master Program. Piers and docks are allowed for single-family
residential use to provide reasonable and safe moorage. Boatlifts are accessory
structures to piers and docks for mooring a boat in a safe and secure manner.
Most properties in the area have existing boatlifts. The use will not interfere with
the public use of public shorelines, as there are none in the immediate vicinity. The
design of the site is compatible with the existing adjacent dock and boatlifts in the
neighborhood-
B. Approximately 90% of all damage to watercraft occurs when they are tied to a pier
or dock. When a boatlift is use to secure a watercraft up out of the water next to a
pier or dock, this damage is greatly reduced or eliminated.
1. The addition of a boatlift to the pier will not increase the use of watercraft,
or lead to an overconcentration of boat and boatlift use within the city or
immediate area.
2. The proposed location is suited for the boatlift, as the site has had a pier
and boathouse for moorage since the 1970's.
C. The proposed use will not have adverse effects on adjacent properties, as the
boatlift will be inside an existing wooden boathouse.

The Proposed installation date for the boatlift is as soon as possible after the work
window opens and permits are approved. The work window is between July 16 and
December 30. The installation will occur between the hours of 8:00 a.m. and 4:00 p.m.,
and take approximately four (4) hours to complete.
There are no proposed hauling or transportation routs, as the boatlift comes pre -
manufactured and packaged, requiring minutes to deliver to the site. There are no
proposed measures to minimize, dust, traffic and transportation impacts, erosion, mud, or

This letter is to provide a brief analysis of potential environmental impacts of the
proposed in -water boatlift at 3709 lake Washington Blvd. North, Renton WA 98056
(Applicant: Paul L_ Pasquier). As per your direction, the analysis is general and
qualitative in nature and limited to the issue of potential operational impacts to Lake
Washington fisheries resources. Information provided to us (EcoPacific Environmental
Services) consisted of site photographs and a standard boatlift proposal site plan. No
site visits or local biological surveys were conducted by EcoPacific. The analysis is not
intended to be comprehensive, or to satisfy federal Biological Evaluation (BE)
requirements under Section 7 of the Endangered Species Act.
EcoPacific has conducted biologicai investigations and/or impact assessments at over
35 different shoreline development sites in Lake Washington and Lake Sammamish.
Much of the discussion below is based c^ Vis project experience.
PROJECT DESCRIPTION
The project site is located on the east side of Lake Washington, in the City of Renton_
The full property address/description is 3709 Lake Washington Boulevard, Renton,

The proposed project involves installation of single, free standing boatlift adjacent to an
existing wood pier and within an existing wood boathouse. The boatlift would be a solar
charged hydraulic lift of marine -grade aluminum construction. The boatlift would be
approximately 10 feet in length and 10 feet wide. The landward side of the lift would be
at a depth of approximately 4 feet below the Ordinary High Water Mark (OHWM = 21.85
feet USACE Datum).
The boatlift would be installed in compliance with all applicable requirements of USACE
Regional General Permit 1 — Watercraft Lifts in Fresh and Marine/Estuarine Waters
within the State of Washington (Greg Ashley, personal communication - April 22, 2008).
No pile driving, filling, or new over -water construction activities would be conducted in
association with the proposed project.
AFFECTED ENVIRONMENT
The property lies within a fully developed area within the City of Renton. Single-family
plots with 40 to 60 ft of waterfront dominate the shoreline. Backyard I shoreline
conditions vary, but many properties have little native riparian vegetation present and
bulkheads and piers are common. The lake littoral habitat is expected to have minimal
amount of structural complexity consistent with a developed site (armored shoreline with
little overhanging vegetation and submerged woody debris).
No notable areas of undeveloped natural shoreline are located within the immediate
vicinity. The closest permanent strea� � � ente •ing the lake is May Creek, approximately
1,200 feet to the north.
Federally protected fish species in the Lake Washington include Chinook salmon
(Oncorhynchus tshawytscha), steelhead (D. mykiss) and bull trout (Salvelinus
confluentus). Chinook smolts from the Cedar River are likely to migrate by the site in
large numbers on a seasonal basis and may linger in the area for feeding or for seeking
refuge. Steelhead and Bull trout are likely to be infrequent visitors in the site vicinity.

Sockeye salmon (O. nerka) in Lake Washington are protected under the jurisdiction of
Washington Department of Fish and Wildlife. All life stages of sockeye can be found in
the lake and they are known to be spawn within beach gravels in the general vicinity of
the project site.
POTENTIAL IMPACTS AND LIKELY SIGNIFICANCE
Construction of in -water structures such as piers and boatlifts has the "potential" to
cause both direct and indirect adverse effects on protected fish species, especially
migrating salmon smolts. Typical impacts usually addressed for in -water projects
include.
• Increased shading of the lake bottom could reduce abundance of available prey
organisms (aquatic invertebrates) for fish by decreasing plant growth. Shading
could also interfere with behavior and migration patterns of juvenile salmon.
• The presence of new underwater structures could increase predation on juvenile
salmon by providing cover for predator fish species such as smallmouth and
largemouth bass.
+ The presence of new underwater structures could enhance nesting habitat for
bass and thus increase predation pressure on juvenile salmon.
The presence of new under4vater structures could disrupt water / sediment
transport patterns and accelerate beach erosion or increase availability of
spawning habitat for predator fish species such as smallmouth bass.
• Increased boat usage of the site could result in increased disturbance (sediment
resuspension, water pollution; etc) of the shallow fish habitat.

For the proposed Pasquier project, it is expected that none of these potential impacts
would occur. Reasons are as follows:
• The proposed boatlift is a relatively small structure with a narrow aluminum
frame_ It has no large structural elements to cause shading or to change
existing features on the lake bottom.
• The site is already developed, with existing in -water structures and bank
armoring; therefore, it provides low quality foraging and rearing habitat
relative to more undeveloped areas of the lake.
• The boatlift would be installed entirely within an existing boathouse (an over -
water structure supported by a number of piles), further minimizing potential
impacts to shading.
Apparently, the site is already used for year-round boot mooring and storage.
Thus, the addition of a boatlift would not increase boat usage or traffic.
The boatlift would be installed in compliance with Regional General Permit 1,
Watercraft Lifts in Fresh and Marine/Estuarine Waters within the State of
Washington. Included in RGP-1 are standard design and construction
guidelines for reduction of impacts in the nearshore environment.
