C. Project Description / Background:
The applicant is requesting a variance fi-onr the provisions of the Renton Municipal Code (RMC 4-4-040)
regulating Fences and Hedges. The variance N� ould allow the applicant to .keep an existing eight -foot (8) side
yard fence in a Residential-S (R-8) zone. l lic tcncc regulations currently restrict the height of a side yard
fence to a maximurn of six feet (6) in height w itlriar rdsiclential zones.
The fence is located along the east property hilc of' tlic applicants' lot. The fence is approximately 116 feet in
length and is made of vertical 8-foot cedar planks. On the north end of the fence, there is a gate in-between the
fence and the eastside of the residence.
The existing fence on the abutting property to the cast is six -feet (6) high and is located on a slope supported
by a retaining wall. The fence is made of- white vinyl and has the same approximate top elevation as the
applicant's fence. A little more than twenty (20) inches separates the two fences.
This Administrative Variance request was filed to provide a legal means for the applicant to retain the existingy
eight -foot (8) fence,
D. Findings
Having; reviewed the written record in the emitter, 11rc City now makes and enters the following:
I) Request: The applicant has requested approval for an administrative variance from the maximum
allowable fence height requirements ot' six (0) feet in the R-8 zone (RNiC 4-4-040D) to allow an eight
(8) foot high side yard fence at the address, 11231 SE 182nd Street.
2) Adminisstrative Variance: The applicant's administrative variance submittal materials comply with the
requirements necessary to process a variance. The applicant's site plan, context map and photographic
evidence are provided as Exhibits 2 threwoh 4.

E. Consistency with Variance Criteria
RMC 4-9-25013.5 lists four criteria that the Revic wing Official is asked to consider, along with all other
relevant information, in making it decision on an Administrative Variance application. The four criteria are:
a. That the applicant suffers undue hardship and the variance is necessary because of special
circumstances applicable to subject property, including size, shape, topography, location or
surroundings of the subject properly, and the strict application of the Zoning Code is found to
deprive subject property owner of rights and privileges enjoyed by other property owners in the
vicinity and under identical zone c[assitication:
The applicant contends that special circtlnlstanccs apply to their fence situation. The applicant states
that they originally built their fence eight (S) Ieet above grade to screen their neighbors' fence because
they felt it was unsightly and the rct.,tinint, %gall portion was not maintained. The applicant asserts
that when she built the f-ence, it intentionally built no higher than the neighbors- fence. The
neighbors' fence is six (b) feet in hci�,ht, as measured from existing grade. The previous owners of the
east property positioned dic fence on top of' L�radcd section of earth that leveled their backyard. This
raised the grade by approximately tlircc (1) fcct, and, according to the applicant, the prc-fill grade was
the same on both lots.
Staff concurs with the applicant th It special circumstances apply to the site, specifically, the grade
separation between the parcels and the close proximity of the fences. To deny the variance would
deprive the applicant of rights and pri%Ilct,es enjoyed by the other property owners in the vicinity and
zoning designation.
b. That the granting of the variance will not be materially detrimental to the public welfare or
injurious to the property or improverneuts in the vicinity and zone in which subject property is
situated:
The applicant states that the granting of the variance would not be materially detrimental to the public
welfare or injurious to the property r>r iwproNements in the vicinity and zone. They contend that the
fence cannot be seen from the street and that the fence is adequately screened from the neighbors
either by vegetation, natural topography or by other fences. The tops of the two abutting fences are of
equal height to one another when vicvtied side by side. The top caps of the neighbors' fence can be
seen from the applicant's backyard. Only the very top of the applicant's fence can be seen from
eastern neighbors' backyard. The ncitrllbin directly abutting on west wrote a letter in support of the
fence variance. During the comment period, there were no letters submitted in opposition to the fence
variance request.
Staff recognizes that the visual impact from the fence would be minimal to the surrounding
neighborhood due to it location and the surrounding environment. When viewed from the surrounding
areas, only the top of the applicants fence can be seen. The top of the applicant's fence appears to be
at the same height as the top of the neighbors' fence. Also, there were no comments submitted in
opposition to the fence variance and one letter from a neighbor in support of the fence variance.

C. That approval shall not constitute a grant of special privilege inconsistent with the limitation
upon uses of other properties in the vicinity and zone in which the subject property is situated:
The ground on which the applicant's I•ence is located is approximately three (3) feet below the
neighbors' fence even though the fenCC,, arc only 22-inches apart. The difference in grade was it result
of previous grading in the abutting pmperty's backyard to make it more level. The applicant stated
that the pre -fill grade of both properiics w erc relatively the same. Given the topographic difference of
the property, the approval of the %iiri,ince request would not provide the applicant with special
privilege inconsistent with the limitation upon uses of other properties in the vicinity or zone. The
visual height of the fence at the top v.ould not be any liigher than the abutting neighbors' fence to the
east.
Staff recognizes that the applicant is not receiving special privileges inconsistent with the limitations
upon uses of other properties in the G icitrity and zone because the approval would allow the applicant
to retain an existing fence whose h1,,he t 1:7oint is no greater in elevation than the neighbors' fence,
which is less than two (2) feet to the w cst.
d. That the approval as determined by the Administrator is a minimum variance that will
accomplish the desired purpose:
The applicant contends that the request is a minimum variance needed in order to screen the
neighbors' fence and property.
Staff recognizes that the applicant i� proposing the minimum variance needed to accomplish the
request. The top of the applicant's Bence does not exceed the neighbors' Fence in elevation,
F. Conclusions
1. The applicant's fence variance request rriccts all four ofthc criteria to grant a variance from RMC 4-9-
250.B.5.
2. The top of applicants fence would be it the s�ime height as the neighbors' abutting fence to the cast.
3. Written comments were received in support of the fence variance. No written comments were
received in opposition of the fence %ziriar)cc.
4. Staff supports the requested variance, and rccoanrnends approval.

Land Use Action Request for Reconsideration, Appeals & Expiration
The administrative land use decision will became limit if the decision is not appealed within fourteen (14) days
of the effective date of decision.
RECONSIDERATION: Within fourteen (14) days of the effective date of decision, any party may request
that a decision may be reopened by the Administrator (Decision -maker)- The Administrator (Decision -maker)
may modify his decision if material evidence not readily discoverable prior to the original decision is found or
if he finds there was misrepresentation of tact. Atter review of the reconsideration request, if the Administrator
(Decision-inaker) finds sufficient evidence to wncud the original decision, there will be no further extension of
the appeal period. Any person wishing to take lur'thcr action must tile a formal appeal within the 14-day appeal
timeframe,
APPEAL. This administrative land use decision will become final if not appealed in writing to the
Hearing Fxaminer on or before 5:00 PAI on December 19, 2008. An appeal of the decision must be filed
within the 14-day appeal period (RCN+ 43.21.C.075(3); WAC 197-11-680). Appeals to the Examiner are
governed by City of Renton Municipal Crdc Sccticfn 4-S-1 10. Additional information regarding the appeal
process may be obtained from the Renton City GIcrk's office, Renton City Hall — 7th Floor. (425) 430-6510.

THE APPEARANCE OF FAIRNESS DOCTRINE- provides that no ex parte (private one-on-one)
communications may occur concerning the larxl use decision. The Doctrine applies not only to the initial
decision, but to Appeals to the Hearing hxiimincr as well. All communications after the decision/approval
date must be made in writing through the l tearing I xaminer. All communications are public record and this
permits all interested parties to know the contents of the communication and would allow them to openly rebut
the evidence in writing. Any violation oi' this doctrine could result in the invalidation of the appeal by the
Court.
EXPIRATION: The variance approval will expire 1sso (2) years from the date of decision. A variance two-
year extension may be requested pursuant to RMC 4-9-250B_16.

Renton Fire & Emergency Services Comments:
There is nothing specific in the IFC regarding fence height. However, the back yard
would serve as a possible area of refuge for the occupants of the house should they not be
able to exit through the front doors. It appears that the fence at the front corner of the
house is also 8 ft. tall. We would require a means of access for the response operations
crews to get to the back yard in case of fire, as well as a secondary means of egress for
the occupants. The minimum width of this access would be 36 inches. The latching
mechanism for this means of access should be accessible from both the front and back
side.

Fence up to 8 feet high in places to visually screen unsightly weeds, unfinished
retaining wall and plastic fence approximately 9 feet high belonging to the
neighbors to the east of us.

6. Justification for the Variance Request:
Location liescription:
Our house is located on street with a hill and is situated in the middle of the hill.
The house to the west of us sits lower than us and the house to the east higher.
The front of our house faces north with the back facing south (see pictures New
Fences Picture 2).
History:
The previous owners of the house located to the east of us had just under 100
cubic yards (116ft.x 7ft.x 3ft.) of dirt brought in to level their back and side yards.
As a result, their back and side yards are about 3 feet higher than ours where the
properties meet. The natural slope of the property was level with ours previously.
Be inning, of Problem:
The former owners used railroad ties as a retaining wall that over the years
deteriorated and needed replacing. We offered to go in on a fence with the current
neighbors but did not want to contribute for cost of the retaining wall. As a result
of this the current owners let this deterioration go on for years with the railroad
ties literally falling into our yard (see pictures - Old Fence Pages 1 and 2). We
had no recourse, but to continually ask them as nicely as possible to please take
care of the problem.
Ongoing I
First:
The homeowners (the Zinsli's) let this go on for approximately four years before
they finally addressed the problem and replaced the railroad ties with retaining
wall brick. The wall is about 3 feet high in places but they never finished the wall
so the height varies (this went on for about 2 years). We offered to finish it as we
were tired of looking at the unfinished wall and were told to leave it and not touch
their property.
Next:
Approximately Two years later they put a 6 foot white vinyl or plastic (I'm not
sure which) fence up on top of their dirt above the retaining wall giving them in
effect a 9 foot fence. The plastic fence sits about 2 feet back from the retaining
wall rather than on top, leaving a strip of property between their retaining wall
and their fence (see pictures- New Fences PG.3, picture #5). This strip of property
is about 20 inches wide and is not and never has been maintained by them. We've
been told by Mrs. Zinsli not to touch their property so we have no alternative but
to look at it.
Fence Description and Site:
The fence we built starts on the east side of our property on the side of our house
and goes to the back corner of our yard, exactly as theirs does. It is no higher than
their fence and simply covers what they've put up on their property (see pictures
, a
— New Fences — pictures 1, 3, 4 and b). We have talked to several of our
neighbors, including those to the west of us and those behind us that can actually
see the fence, to ensure that they are not adversely effected by the height. We
have been assured they have no problem with our fence and that it does not block
any view for them. Additionally, the neighbor to the west of us also contacted
neighbors and found no objections to our fence (see letter from Joe Avolio).
Summary:
We've made every effort to make sure our fence is not any higher than the
Zinsli's so they can enjoy their fence and we ours (see pictures - New Fences
PG.2 pictures #3 and #4 and PG.3 picture #6).
Points:
- If their property had not been altered in the first place and left in its natural
state we would have only had to have built a six foot fence, which in all
honesty would have been much less expensive for us.
- Given so much dirt was brought in to level their yard we had to build a fence
which is eight feet high in some places just so we were even with what they
constructed.
- We put up with their collapsing fence and retaining wall at least 4 years (see
pictures Old Fence).
- The unfinished retaining wall for 2 years
- The weed infested strip of property (see New Fence pictures 1,4,& 5) that
we're not to touch and
- Their ugly white plastic fence that we wish to screen
Justification:
We put up with their mess for years and were finally able to build our own fence
without fear of their railroad ties and old fence collapsing into it and damaging it.
We built a nice cedar fence that in some places reaches 8 feet in height to visually
screen their fence and the unfinished mess these people have created and that only
we are subject to view.
We built the fence for several reasons:
1.) We don't want to look at the retaining wall that is unfinished
2.) We don't care for the white plastic fence they erected and don't wish to look
at it when we go out to our hack yard and
3.) The weeds that have grown on the strip of property between their retaining
wall and their fence is an eyesore.
We still have to continually deal with the vines and weeds that are not maintained
as they're growing right through the boards of our fence. We're concerned now
about the rodents this mess is attracting, as well as the possible future fire hazard
(see pictures New Fences — PG.1 picture #1 and PG.3 picture #5).

We don't feel that we should be deprived of enjoying our own back yard any
longer and subjected to the ugly mess these people have created when our fence is
no higher and has no impact on them what so ever (again see pictures of New
Fence — PG.2). We have a nice yard and simply want to be able to enjoy it as any
other homeowner would want to enjoy theirs without being subjected to the
unfinished disaster these people have left for us to view. We've put up with their
collapsing fence and then their unfinished mess for years and feel we are justified
in having the fence we built as it is.
