DESCRIPTION: Victoria HMIs Home Owner's Association is requesting a Critical Areas
Exemption to remove/prune 15 Bigleaf Maple trees in the tract (parcel number
8898700000) located at the corner of 5 26th Street and Benson Road S (See
Exhibit 1), within Victoria Hills Development. The tract is approximately 6,269
square feet and contains moderate and high coal mine hazards, high landslide
hazards, and sensitive slopes. The proposed tree removal and pruning will be
located within these critical areas. Our city arborist, Terry Flatley, has
confirmed that 7 of the trees (tree numbers 1,4,6,10,11,13, and 14; see Exhibit
3) are damaged, diseased, or decayed, and are high risk trees. Terry Flatley
recommends retaining the main trunk with removal for wildlife purposes for
trees numbered 1, 10, and 14. Terry Flatley recommends retaining and pruning
tree numbers 8, 9, and 12 (See Exhibit 1 for pruning details). Terry Flatley does
not recommend removal or pruning for trees numbered 2, 3, 5, 7, and 15. City
staff recommends as a conditions of approval that no tree stumps be removed
on site to prevent impacts to critical areas, and that the applicant follow all
recommendations indicated in Terry Flatley's email, dated October 27th, 2015.

FINDINGS: The proposed development is consistent with the following findings pursuant to
RMC section 4-3-050C.5:
1. The activity is not prohibited by this or any other chapter of the RMC or state or federal law or regulation.
2. The activity will be conducted using best management practices as specified by industry standards or
applicable Federal agencies or scientific principles if submitted plans are followed and the conditions of
approval of this exemption are met.
3. Impacts will be minimized and disturbed areas will be immediately restored, if submitted plans are followed
and the conditions of approval of this exemption are met.
4. Where wetland or buffer disturbance occurs during construction or other activities in accordance with this
exemption, the site will be revegetated with native vegetation as required as a condition of approval for this
exemption.

period (RCW 43.21.C.075(3); WAC 197-11-680).
APPEALS: An appeal of this administrative land use decision must be filed in writing together with the
required fee to the City of Renton Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA
98057, on or before 5:00 p.m., on March 29, 2016. RMC 4-8-110 governs appeals to the Hearing Examiner
and additional information regarding the appeal process may be obtained from the Renton City Clerk's Office,
(425) 430-6510.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not readily
discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After
review of the reconsideration request, if the approval body finds sufficient evidence to amend the original
decision, there will be no further extension of the appeal period. Any person wishing to take further action
must file a formal appeal within the 14-day appeal time frame.
EXPIRATION: Five (5) years from the date of decision (date signed).

Regarding the request for removal on the Victoria Hills HOA parcel 8898700000 and east of 1211 S 26
Street, we offer the following comments on the status of the condition of the trees:
Tree Numbers:1,4,6,10,11,13 and 14: Remove these trees as being damaged, diseased, decayed or high
risk. Many of these trees can be partially removed to retain the main trunk standing for wildlife
purposes, if they choose. All cuttings should remain on the site and on the ground.
Tree Numbers: 2,3,5,7,8,9,12, and 15: Leave these trees as there does not appear to be any reason to
remove them. Modifications to the fence are needed for tree 7 as it continues to grow.
As a condition of removal, we recommend planting 6, 8'-tall western redcedar trees.
Some pruning on leave trees is warranted, which is noted on the attached map. Trees 1 and 2 are within
the street right-of-way. The attached map shows the relative location of the trees and may not be
exact.

PROJECT NAME: Victoria Hills Routine Vegetation Management Permit.
Common Area D, located on the south-west corner of Benson Road S and S 26th Street (see
map), has a number of problem maple trees that are causing damage to a homeowners fence.
In most cases the trees have been damaged in the past and have sent up shoots that have
grown. Up to 15 trees identified by an arborist, Terrance Flatley (Urban Forestry & Natural
Resources Manager, City of Renton), will be pruned or removed and suggested trees of
Western Red Cedar will be planted in the noted area along Benson Road 5 to provide a noise
and sight buffer between the sidewalk and the homeowner property.

significant dust, or traffic as a result of this project. The noise of cutting will be present only

cutting of the trees occur but this will be within regular construction hours of gam —10pm.
Preliminary Traffic control plan It is not anticipated that any traffic control plan will be
