DenisLawMayorCommunity&EconomicDevelopmentC.E.‘Chip”Vincent,AdministratorMarch2],2019Robert&DoravinWilson2173060thStreetEastLakeTapps,WA98391VIAEmail:doravin@comcast.netSUBJECT:DenialofRequestforOne-YearExtensionofPeriodofValidityforWilsonPark2PreliminaryPlat(LUA12-013,PP,PUD);READCAREFULLY:IncludesDeadlinetoAppealDearMr.andMrs.Wilson:TheDepartmentofCommunity&EconomicDevelopment(CED)receivedyourJanuary30,2019requestforaone-yearextensionoftheperiodofvalidityfortheWilsonPark2PreliminaryPlat.RMC4-7-080.Lallowsforaone-yearextensionofapreliminaryplatwithinfiveyearsofthedateofpreliminaryplatapprovalifanapplicantfilesatleast30dayspriortotheexpirationofthefive-yearperiod,butonlyiftheapplicantdemonstratesthathe/shehasattemptedingoodfaithtorecordthefinalplatwithinthefive(5)yearperiod.ApplicabletoWilsonPark2,theWashingtonStateLegislatureallowedforanadditionaltwo(2)yearsforplatsapprovedonorafterJanuary1,2008,andbeforeJanuary1,2015.AstheWilsonPark2dateofpreliminaryplatapprovaliswithinthistimeperiod,theplathasaseven-yearperiodofvalidityforthepreliminaryplat,oruntilJuly5,2019.Yourletterrequestinganextensionbeginsbyfocusingonmarketingefforts.Specifically,itdescribeshavinghadseveralunsuccessfulofferstopurchasetheproperty,suggestingthatduringperiodsofnegotiationyouhavedivertedattentionawayfromworkingontheactualconstructionworknecessarytoadvancetheplattotherecordingstage.Next,theletterstatesthatyoualsoneededtofindanewcivilengineertocompleterevisionsontheplatbecausethepriorengineer“optedout;”however,thisonlyoccurredwithinthepastseveralmonthswhenyoudecidedtoconsiderpossibleredesignofelementsoftheplat.And,althoughtheletterassuredthatyouwould“submitdrawingsforapprovaltheweekofFeb4,”thisdidnotinfactoccuruntilmorethansixweeksafterthatdate,inkeepingwiththedelaysthroughoutthelifeofWilsonPark2.Additionally,focusingonrecentdelayedeffortstoreviseWilsonPark2doesnotaccountforthe1055SouthGradyWay,Renton,WA98057-rentonwa.gov Mr.RobertWilsonMarch27,2019Page2priorsixyearsinwhichtheWilsonPark2platcouldhavebeenmakingprogresstowardrecordingasitwasoriginallyapproved.Indeed,thepreliminaryplatandpreliminaryPUDwereapprovedin2012,andengineeringdrawingswereapprovedfiveyearsagoin2014.However,theengineeringdrawingshaveremainedinouroffice,theoutstandingconstructionpermithasnotbeenpaidfororpickedup,andnofurtherprogresshasbeenmadetowardconstructingallsiteimprovements—amandatoryprerequisiteoffinalplatrecording.Inadditiontoconsideringthepointsmadeinyourletter,CEDconsideredthefollowinginevaluatingyourrequestforaone-yearextensiontoWilsonPark?:•ThepreliminaryplatandpreliminaryPUDwereapprovedonJuly5,2012.•Theprojectwasprovideda7-yearapprovaltimeframe,basedonRentonMunicipalCodeandanextensiongrantedbytheWashingtonStateLegislature.ThereforetheprojectexpiresonJuly5,2019.•TheCivilConstructionPermithasbeenreadytoissuesinceJune17,2014waitingonlyforactionsfromyou:finalpermitfeestobepaid,aperformancebondtobesubmitted,andcontractorinformationalongotherconstructionrelateddocumentstobeprovided.•RevisionstoRentonMunicipalCodehaveoccurredsubsequenttotheapplication.InadditiontotherezoneofthesitefromResidential-8DwellingUnitsperAcre(R-8)toResidential4DwellingUnitsperAcre(R-4),revisionshaveoccurredtostormwaterregulations,fence/wallstandards,landscapingstandards,andtreeretentionstandards.•StaffmetwithyouandyourengineeronAugust4,2018inordertoprovideyouwiththreepotentialoptionsforyourconsiderationregardingapathforwardforWilsonPark1andWilsonPark2.IttookanadditionalsixmonthsforCEDtoreceiveanyformofformalapplicationpursuingtheseoptions.•TheCitysignedanagreementwithyouonAugust22,2018extendingtheperiodofvalidityofabuttingWilsonParkitoJuly5,2019.Inthosenegotiations,youassertedthatWilsonParkImustbeextendedtofollowthesametimelineasWilsonPark250thatthetwoplatscouldproceedtogether.Now,youassertthatWilsonPark2mustbeextendedpastWilsonParkl’sJuly5,2019expirationdate.Therepeatedattemptstoseesawthetwoplats’expirationdatesdiscreditargumentsofgoodfaith.•YouvisitedCityHallrequestingengineeringinformationforWilsonPark1and2onSeptember14,2018.TheCitysentyoualltheengineeringfilesonSeptember17,2018.Nevertheless,anothersixmonthswentbybeforeCEDreceivedaresubmittal.•CEDrepresentativesrecentlyvisitedthesiteandwitnessedfirst-handthattheplatremainsunimproved.Fromtheirextensiveexperienceinpermittingandwiththisplat,CEDrepresentativesconcludethatWilsonPark2wouldnotbereadytorecordonJuly5,2020evenifgrantedaone-yearextension.Basedontheabove,CEDhasdeterminedthatdespitetheadditionaltwoyearsofvalidityaffordedtheplatbytheLegislature,youhavenotmadeagoodfaithattempttoconstructtherequiredutilitiesandinfrastructureandtootherwisepreparetorecordtheplatpriortoits.1055SouthGradyWay,Renton,WA98057.rentonwa.gov
