HomeMy WebLinkAboutC_Lynn Rastelli Lee_20170629Winsper 3125 Wells Ave. crr OF RiNTCNRenton,WA 98055 ECEl\/ED ]UN3020J7 DEVELOPME’4I SER’/CES Clark H.Close Senior Planner Department of Community &Economic Development — Planning Division 1055 5.Grady Way Renton,WA.98057 June29,2017ClarkH.CloseSeniorPlannerDepartmentofCommunity&EconomicDevelopment—PlanningDivision1055S.GradyWayRenton,WA,98057Subject:WinsperCommunityHomeowner’sAssociationValleyVueShortPlat,LUA16-000272,SHPL-A,MODDearMr.CloseTheBoardoftheWinsperCommunityHomeownersAssociationwouldliketoacknowledgereceiptofyourletterdatedJune2,2017regardingtheValleyVueShortPlat,LUA16-000272,SHPL-A,MODandthecivilconstructionpermit(C17001891)relatedtothisPlat.Aspertheheatingexaminer’sfinaldecisionrenderedonJuly11,2016,“Inshort,thesubdivisionwillneverbefinallyapprovedbythisdecisionunlessanduntiltheapplicantacquiresemergencyaccessrightsacrossTractH”.Afterthisdecision,theBoard,withthecommunities’managementcompanyactingasitsagent,madeseveralrequestsofMr.Deestosupply,forreview,theconditionsorlegaldocumentbywhichheproposedtransferofeasementrightsthroughTractHwouldbeaccomplished.Mr.Deesnevercompliedwiththeserequests.Instead,thepresidentoftheBoardbeganreceivingdailyphonecallsontheirprivatenumber,whenMr.Deeswasspecificallyrequestedtocommunicatethroughthemanagementcompany.Ultimately,Mr.Deesmadeveiledthreatsregardinglegalaction,whichpromptedtheBoardtohirelegalcounselonbehalfoftheWinsperCommunity.SinceMr.DeesdidnotseemtohavefounditnecessarytosubmitaproposalforaccomplishingthetransferoftheeasementrightsthroughTractH,theBoard,throughitslegalcounsel,presentedaproposaltoMr.Dees.Mr.Deeshasneverrespondedtothis.Infact,untilreceivingacopyofthisproposalfromtheCity,wehadnotevenhadconfirmationfromhimthathehadreceivedit,althoughtherewaslittledoubtthathehad.Forclarity,letmesummarizethepositionoftheWinsperCommunityHomeowner’sAssociationregardingtheemergencyaccesseasementassetforthinourattorney’sMarch14,2017lettertoMr.Dees:•WedonotbelievetheHOAislegallyrequiredtoconveytheeasement.•Nonetheless,theHOAiswillingtoconveytheeasement,subjecttotheconditionssetforthintheletter.•TheHOAiswillingtodiscussreasonablemodificationstotheconditionsdescribedintheletterifabsolutelynecessarytoallowtheemergencyaccesseasementtosatisfyCityrequirements,buttheHOAisnotwilling,underanycircumstances,topermitanyuseordisturbance,evenonatemporarybasis,ofanypropertyoutsideofTractH.
