SchultzATTN:ClarkH.CloseDepartmentofCommunity&EconomicDevelopment1055SouthGradyWayRentonWA98055April26,2016DearMr.Close,IhavenumerousconcernsregardingtheValleyVueShortPlatproposal(LUA16--000272).Myfirstconcernwasthatshort-platproposalsdonotrequireapublichearing.Thisparcelwassubjecttosubstantialcommunityinputduringthepreviousproposalandhearingprocess(LUAI4-001040)inJuly2015.IwasrelievedwhenyounotifiedmethattheAdministratoragreedthatapublichearingiswarrantedandtransferredthedecisionofthisproposaltotheHearingExaminer,becauseanyaccesstotheparcelfromtheWinsperCommunitywouldrequirevariancestothestandardcodes.However,sincewehavenotreceivedanoticeofhearingandthe14daycommentperiodhasstarted,Ifeelcompelledtogetmyconcernsonrecord.ThepreviousproposalwasdeniedbytheHearingExaminerfindingthat:“...thedenialisduetoprivateaccessroadsproposedbytheapplicantthatfailtomeetcitycodeorqualifyforcodemodifications.”Itwasalsonotedthat“theadjoininghomesnexttotheaccesstractarelocatedonlyfivefeetfromthepropertylinesoftheaccesstractsandthereisnoroomwithintheaccesstractsforanyshoulderorotherspacetoaccommodateanyvehicularcoursecorrections.”TheaccesstractHhasnotchanged,andtheconditionsthatwarrantedadenialarestillrelevant.Thecurrentproposaldoesnotaddressmaintenanceofaccesseasement,nordoesitmeetCodeStandardsforprivatedriveway,shareddriveway,privateroad,orlimitedresidentialaccess.Additionally,Mr.Deesisrequestingavariancesuggestingthat“Thelotcreationwillprovidefrontageontotheaccesseasementandnotaright-of-wayS.32ndPlace”.Mydrivewayflairswithinonefootofthepropertyline,andthehouseisangledtowardstheproposedshareddriveway,thatwouldhavevehicletrafficpassingwithinafewfeetofmyfrontdoorandlivingroombaywindow.Thisisadetrimenttopersonalwellbeing.Iaskthatnodiscretionarymodifications/variancesbegrantedasanymodificationisattheexpenseoftheWinsperCommunity.Thisrequestwouldallowfortheeasementtobeapublicroadwithoutfollowingcodes,inadditionitwouldgivetheDeesparcelaRightOfWay(ROW)frontageforfuturehigherdevelopmentconsideration.Inessence,itwouldallowhimtodevelop“throughthebackdoor,thatwhichhewouldhaveneverbeenallowedthroughthefront”.Higherdevelopmentdensitywouldimpactthesafety,privacy,andenjoymentoftheborderingWinsperneighbors.Iaskthatnodiscretionarymodifications/variancesbegrantedforthisprojectastheyareclearlyattheexpenseofthesurroundingneighbors.WithregardstothecommentperiodfortheDNS-M,andtheproposedmitigationmeasureforthisproposal;Istronglyopposetheusethe2014Geotechnicalreportbeingusedforthispurpose.The2014reportandrecommendationsarenotrelevanttotheLUA-16-000272proposal,astheywerederivedfortheLUA-14-001040proposalwhichwassubstantiallydifferentincontent.Thisreportclearlystatesthattherecommendationsarebasedon8residentiallots,stormwaterdetentionpond,grading,andretainingwalls.NoneoftheseelementsarepartoftheLUA-16-000272plan.The2014reportalsostatesthatifthescopeoftheprojectchanges,modificationstorecommendationsandconclusionsmaybewarranted.IalsoobjecttothisdocumentbeingusedbecauseitdoesnothingtoaddressthesafetyconcernsvoicedbyneighborsandarticulatedintheHearingExaminerreport.TherewasaGeologicalRiskwaiversignedbyDees,butnopublicinformationastowhythiswasrequired.TheprojectnarrativesuggeststhatthewetlandareatotheeastwillbeplacedinatractforinclusionwiththeadjacentprotectareatractlocatedinWinsper.IdoubtthattheWinsperHOAisonboardwiththisconcept.TheWinsperCommunitypaidagreatdealofmoneytofencethewetlandtoprotectagainst:Eliability,andhasnodesiretoincreaseliabilitywithadditionalwetlands.i,PR
