The project was approved by the Hearing 17 Examiner on October 11, 2017. The extension request was supported by City staff in a March 25, 2019 email. The requested two year extension is approved. The expiration date for LUA17- 18 000237 is extended from October 11,2019 to October 11, 2021. 19 Extension requests for PUDs are governed by Renton Municipal Code 4-9-150G.1. This provision 20 authorizes the hearing examiner to grant extensions of up to two years, but doesn't specify any standard for doing so, except that the extension must be filed more than 30 days before PUD 21 expiration. In the absence of any set standard, a showing of good cause is construed as required to justify the extension. That standard is met for this project. As noted in the staffs March 25, 2019 22 email, the Department of Community and Economic Development will be studying the vicinity of 23 the VIA 405 site this year as part of a sub area plan associated with the Sound Transit Bus Rapid Transit Station located at S. Grady Way and Rainier Ave S. The extension would provide the 24 applicant the ability to provide stakeholder input into the planning exercise and make minor adjustments to their project if needed prior to submitting building and construction permits. In 25 addition, as noted in the Applicant's March 25 extension request, construction costs for the PUD have increased by 20% since the PUD application was first planned and designed in 2016. These 26 PLAT EXTENSION REQUEST - 1 1 reasons constitute sufficiently good cause for the extension, in particular since it would give the Applicant the opportunity to implement new planning efforts by the City. 2 3 DATED this 12th day of April, 2019. 4 5 Phi A.Otbrechts 6 City of Renton Hearing Examiner 7 8 Appeal Right and Valuation Notices 9 The RMC does not identify whether a hearing examiner decision on PUD expiration requests is 10 appealable to the City Council. If any party wishes to appeal, they should consult with their 11 attorney and the City's Planning Department to ascertain their appeal rights. In the absence of clear appeal rights, a common strategy is to appeal both administratively (in this case the City 12 Council) and judicially (under the Land Use Petition Act, Chapter 36.70C RCW). City Council appeals must be filed within 14 days of the issuance of this decision and judicial appeals must be 13 filed within 21 days of the issuance of this decision.
