LOCATION: 1330 N 40th St
DESCRIPTION: The applicant is requesting an additional animals permit in order to keep 1
additional cat than the maximum of 3 allowed per code on the premises
located at 1330 N. 40th Street (parcel number 3224059054). All 4 cats are
Savannahs, and all are approximately 10 pounds each. The property is a
total of 22,651 square feet. A 6 foot tall cedar wood fence exists around
the entire rear yard area. A small enclosure (12 feet x 8 feet) is currently
installed on the northeast portion of the property, behind the house. The
cats will primarily be housed indoors, but will occasionally be kept in the
outdoor enclosure for leisure and exercise.
DECISION CRITERIA:
The Planning Division Director shall review requests for Additional Animals Permits for compatibility of the
proposal with the surrounding neighborhood. In order to determine that the site and facility will be
adequate and to ensure the humane and appropriate care of the animals, the Planning Division Director
may require that the property be inspected by an Animal Control Officer. Factors to be considered in
determining compatibility and adequacy are:
Are animal and food wastes properly removed to keep the kennel free from the infestation
of insects, rodents or diseases and from obnoxious or foul odors?

Comments: An inspection was conducted by an animal control officer who did not express
any concern with regard to animal food and waste removal at this time. As a condition of
approval the applicant shall continuously ensure that animal food and waste is properly
removed to avoid infestation and obnoxious or foul odors.
Are all animals kept in such a manner so as not to create any objectionable noise, odor,
annoyance, or become a public nuisance?

Comments: An inspection was conducted by an animal control officer who did not express
any concern at this time with regard to objectionable noise, odor, annoyance, or public
nuisance. As a condition of approval the applicant shall continuously ensure that no
objectionable noise, odor, annoyance, or public nuisance is created by the raising of four
Savannah cats.
Do adequate and appropriate facility and rear yard specifications/dimensions exist that
ensure the health and safety of the animals?

Comments: The 1,890 square foot home is of sufficient size to raise four cats, and the
enclosure in the rear yard provides ample space for play and recreation. The cats are
approximately 10 pounds each and have been provided 96 square feet of recreational
space. An animal control officer inspected the enclosure and did not express any concerns
regarding compatibility.
Is there a past history of animal control complaints regarding animals kept by the applicant? 4.
Comments: The animal control officer verbally acknowledged that he was aware of past
complaints made by surrounding property owners who were concerned that the breed of
cat being raised on the property was illegal in the City of Renton. Since the time of these
complaints the Savannah has been legalized in the city, resolving this concern. No further
complaints have been issued.
Is the shelter location located a minimum of ten (10) feet from any property line and in the
rear yard? (Note: Unless Planning Division determines that a side yard would be a better
location.)

Comments: The cats will be kept on a 22,651 square foot lot. They will be kept primarily
indoors in a 1,890 square foot home. The cats will occasionally be kept in a recreational
enclosure within the rear yard, 16 feet from the rear lot line, and 12 feet from the side lot
line (Exhibit 1).
Will the keeping of additional animals have an adverse effect on abutting or adjacent
properties or cause a detriment to the community?

Comments: The keeping of one additional cat will not have an adverse effect on
surrounding properties. The cats will be primarily kept indoors, or within an enclosed pen
in the rear yard. The property was inspected by an animal control officer and no potential
or existing adverse effects were reported.
Is the animal waste product managed in a safe, clean and odor-free manner?7.
Comments: The site was inspected by an animal control officer who did not express any
concerns regarding waste management. As a condition of approval the applicant shall
manage all waste products in a safe, clean and odor-free manner.
Is the request for additional animals compatible with the zoning classification of the
premises on which the keeping of additional animals is to occur?

Comments: The site is zoned Residential-6 (R-6) which allows up to 3 household pets per
dwelling. Regardless of additional lot size, the keeping of four (4) or more dogs and/or cats
as an accessory use shall always require an Additional Animals Permit (RMC 4-9-100). The
keeping of four (4) cats is compliant with the zoning classification with the issuance of an
additional animals permit.
Are the animals' sizes, types, and characteristics of breed compatible with the adequacy of
the site and facilities?

Comments: The Savannah cats are approximately 10 pounds each and have been provided
96 square feet of recreational space in the rear yard and primarily live within the 1,890
square foot home. An animal control officer inspected the facilities and did not express any
concerns regarding compatibility.
Is the subject lot smaller than one (1) gross acre in size? If so, are dog-runs, open-run
areas and permanent/temporary kennel structures surrounded by a fence of adequate
height, located a minimum of ten (10) feet from any property line and in the rear yard?
(Note: Unless Planning Division determines that a side yard would be a better location.)

Comments: The subject property is 22,651 square feet (0.52 acres). The cats will be kept
primarily indoors in a 1,890 square foot home. The cats will occasionally be kept in a
recreational enclosure within the rear yard, 16 feet from the rear lot line, and 12 feet from
the side lot line. The rear yard is also enclosed by a 6-foot tall fence around the perimeter
(Exhibit 1).
CONCLUSION: The Savannah Additional Animals Permit, File No. LUA19-00027, AA, is
approved subject to the following conditions:
1.The applicant shall manage all waste products in a safe, clean and
odor-free manner.
2.The applicant shall continuously ensure that animal food and
waste is properly removed to avoid infestation and obnoxious or
foul odors.
DECISION: The Savannah Additional Animals Permit, LUA19-000027 is approved with
conditions.

Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on Friday, May 3, 2019,
together with the required fee with: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton,
WA 98057. Appeals to the Examiner are governed by RMC 4-8-110 and more information regarding the
appeal process may be obtained from the Renton City Clerkâs Office, 425-430-6510.
Reconsideration: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not
readily discoverable prior to the original decision is found or if he finds there was misrepresentation of
fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend
the original decision, there will be no further extension of the appeal period. Any person wishing to take
further action must file a formal appeal within the 14-day appeal time frame.
Expiration: An Additional Animals Permit shall be valid as long as the keeping of animals has not been
discontinued for more than one year, the operator is in compliance with the City requirements and has not
had the Additional Animals Permit and/or any related home occupation license revoked or renewal
refused. In addition, all animals that are required to be licensed shall be individually licensed according
to the regulations found in RMC 5-4, Animal Licenses. Failure to renew animal licenses as required in
RMC 5-4 shall trigger review and/or revocation of the Additional Animals Permit.
