I really think we are hitting all the right intentions but at the same time ask for the leniency needed in that these guidelines were established in large part for general new construction. Hopefully in the letter I have addressed some items that can be agreed hit the right public benefits to the public, pedestrians, community, etc…. This is likely the path we will be taking as rooftop access would require a considerably larger scope of work. I am a bit confused with the staff comment on this one as it reads that to comply we need to either 1. Revise the proposal to provide the required common open space, pay a fee in lieu at the applicable rate to the Community Services Department or 2. that private open space be provided in an equivalent amount required for common open space prior to the approval of a Building Permit To me this reads as if we need to provide either the common or private open space (on-site), but the common open space would require the fee. What I believe the intent here, and my follow-up question would be how we go about this, is that we consider the adjacent park to be the common open space and apply the fee. Is there some sort of paperwork we need to file with the Parks department to do this? Additionally how are we supposed to calculate the fee? 4-1-240 talks about the monetary value of land area and nonstructural improvements… however that park is already developed, is the intention that we further improve the park to a certain dollar amount?
