June 26, 2019: 1 performed an inspection of 2011 Harrington Ave NE. I observed and photographed from the public right of way 4 vehicles parked on the property. I searched the four vehicle plates in the department of licensing online database. The GMC Suburban WA plate AWK0102 was expired. See exhibit 4 and 5 June 27, 2019: 1 issued a Finding of Violation for an inoperable vehicle to the property owner Mr. Williamson. RMC 6-1-2 defines inoperable as "A vehicle that is apparently not functioning or is inoperative or cannot be lawfully operated upon public roads or highways." On this date the vehicle had expired license plates and could not be legally operated on a public road. Warnings of violation were issued for code cases 18-000512 and 16-000788 on August 08, 2018 and November 29, 2016 for the same violation. See exhibit 3 and 6. July 12, 2019: Mr. Williamson filed an appeal with the City Clerk's office. The City's position is that the full penalty should be paid, as City staff have spent a significant amount of time on this property. VIOLATION 1: Outdoor Storage Residential Investigation Date 08/08/2018 Violation Note: Code Cited: RMC 4-5-130.B.4 Amended IPMC Section 308.1-308.6 Outdoor Storage Code Text: RMC 4-5-130.B.4 The Renton Municipal Code has specific regulations governing outdoor storage, the amended IPMC code states that: 308.2 Allowed residential outdoor storage: For RC and R1 zoned properties, a maximum of 400 square feet of area may be used for outdoor storage. For R4, R6 and R8 zoned properties, a maximum of two hundred (200) square feet of area may be used for outdoor storage. For R-10 or R-14 zoned properties, a maximum of 100 square feet may be used for outdoor storage. 308.3 Prohibited areas for outdoor storage: Outdoor storage is prohibited on residentially zoned property in the following areas: Front yards, Side yards, Slopes greater than 15%, Designated open spaces or restricted areas, critical areas, including wetland, streams and associated buffer areas 308.4 Emergency access: Outdoor storage areas shall not prevent emergency access to the residential structure or any other building. 308.5 Business related storage: Materials stored outdoors on residentially zoned properties shall not be owned by or used in any business or industry including a home occupation business. 308.6 Height limitations: Materials stored outdoors on residentially zoned properties shall be neatly stacked and not exceed a height of six feet (6). Tarps may not be utilized for screening outdoor storage. Corrective Action: Consolidate outdoor storage to an area no larger than 100 square feet (R-14 zoning) and remove all items from the front and side yards. VIOLATION 2: IPMC Section 304 Exterior Structure Investigation Date11/29/2016 Code Cited: RMC 4-5-130 IPMC Section 304.7 Exterior Structure -Roofs and Drainage Code Text: 304.7 Roofs and drainage. The roof and flashing shall be sound, tight and not have defects that admit rain. Roof drainage shall be adequate to prevent dampness or deterioration in the walls or interior portion of the structure. Roof drains, gutters and downspouts shall be maintained in good repair and free from obstructions Roof water shall not be discharged in a manner that creates a public nuisance. Corrective Action: In this regard, repair and properly maintain all gutters and downspouts. VIOLATION 3: Storage Of Bulky Waste: Private Property Investigation Date 11/29/2016 Code Cited: CODE 8 1-4 E Code Text: Storage of Bulky Waste: Private Property 8-1-4 E: The City of Renton has adopted regulations that governs bulky waste. The code specifically states "it shall be unlawful for any person in the city to store, maintain, keep, retain, dump or accumulate bulky waste on 1055 South Grady Way, Renton, WA 98057 • rentonwa.gov Page 1 of 2 VIOLATION 3: Storage Of Bulky Waste: Private Property Investigation Date11/29/2016 private property in the city". Bulky waste is defined as "large items of solid waste, including but not limited to items such as furniture, large household appliances, refrigerators, freezers, oven, ranges, stoves, dishwashers, water heaters, washing machines, or clothes dryers: junk vehicles, vehicle hulks or any other oversized solid wastes which would typically not fit into or be permitted for collection as garbage in garbage cans ". Corrective Action: Remove and properly dispose of all items including but not limited to tires & rims, car parts (fuel tank), motorcycle parts, inoperable lawn mowers, used lumber/building materials, wood pallets, toilet/plumbing fixtures, plastic buckets, furniture, washer/dryer combo, metal vent pipe, a cut up bathtub and metal cages or any other oversized solid wastes which would typically not fit into or be permitted for collection as garbage in garbage cans stored outside on the property. VIOLATION 4: VEHICLE STORAGE Code Cited: CODE 6-1-3 Investigation Date 11/29/2016 Code Text: Vehicle Storage 6-1-3: The City of Renton Municipal Code Section 6-1-3: The storage, maintenance or retention of junk, wrecked, dismantled or an apparently inoperable vehicle, vehicle hulk, or any parts thereof, on private real property in the city is hereby declared to be a public nuisance in accordance with this chapter and RMC 1-3-3, as now worded or hereafter amended, and may be abated in accordance with this chapter and RMC 1-3-3 G, as now worded or hereafter amended. Corrective Action: Remove and properly dispose of all unlicensed and inoperable vehicles stored on this property; Bring the vehicles into compliance with city code or store in a fully enclosed building. VIOLATION 5: STORAGE OF GARBAGE & RECYCLABLES : PUBLIC PROPERTY Code Cited: CODE 8-1-4 C Investigation Date 11/29/2016 Code Text: 8-1-4 C: Unlawful Storage of Garbage and Recyclables: It shall be unlawful for any person to deposit, throw, dump, store, maintain, retain, keep or place garbage, recyclables or yard waste on private or public real property in the City, except in a garbage can or unit, recycling bin or yard waste cart for the purpose of storing such garbage, recyclables or yard waste until the next regular collection date by the City's collection contractor or any other person authorized by the City to collect garbage or recyclables. This subsection shall not apply to yard waste in compost piles or receptacles so long as they are properly maintained free of all vectors and any odors traveling off -premises. Further, this subsection shall not apply to any business licensed to collect and store garbage and recyclables when done in an area zoned for the collection or disposal of garbage or recyclables. Corrective Action: Remove and properly dispose of all garbage, recyclables and yard waste located on the property. Plastic bags are not approved containers.
