Owner owns that certain building located at 1415 Maple Avenue South, -� in the City of Renton, County of King, Washington (the "Building") which sits on the tract of real property described on Exhibit A attached hereto [the "Property„). B. Owner has leased the Building and all parking and outside areas to MCI Vs ORLDCOM Network Services, Inc., a Delaware corporation (the "Tenant") by that certain Equipment Site Lease Agreement dated c -s October 1999 (the "lease"). C. Tenant has submitted to the Uty of Renton (the "City"j a site plan (the "Site Plan") for the construction of technical space and supporting office space (the "Project") within the Building. The Site Plan has Project Number 990354. In connection with the Site Plan, Owner Inas requested a modtfication from Section 4-4-OBOFIO of the City's parking regulations in order to provide sixteen (16) parking stalls, less than ttae minimum number of on-site parking spaces required by code, but more than sufficient for Owner's employee count at full employment. D. The City has agreed to approve the requested pcariang modification, provided that Owner executes and records upon substantial completion of this Project this Parking Covenant as a covenant running with the land. b.i I'm mi plkto Poll%i3equp Renun, LATA M&-th2& I1(I(E AGREEMENT NOW, MEREFORE, in consideration of the covenants contained herein, and for other goad and valuable consideration, Owner hereby agrees as follows: 1. The sixteen ( 16) parking stalls will be referenced in Recital B, above, will be provided as follows: M Thirty -One parking stalls of the existing forty-seven (47) parking stalls will have striping removed upon substantial completion of the Project. b. Upon termination of Tenant's Lease and any renewals thereof. Owner agrees to reinstate the thirty. -arse (31 J parking stalls for a total of Forty-seven [47) parking stalls , upon forty- five [45) gays of written notice by the Administrator of the City's Planning/Building/Public Work Department, which request shall be at the Administrator's sole and complete discretion. C. Sixteen (16) stalls will be striped capon substantial completion of the Project. 2. Upon application for any change In use, tenant improvements, budding permit, or business license for a new occupancy for the C'' subject property, a parking analysis must be submitted for the City's review and approval for compliance with code and planning regulations in Force at the time of the application. 3. Future changes of use that expand present uses or employee counts beyond these currenity submitted by the Tenant may not be allowed unless It oan be demonstrated that the on -Site parking Is sufficient. 4. The covenants set forth herein constitute covenants running with the land, shalt be binding upon the Property, and shall be binding upon Owner and Its assigns. The provision of this Parking Covenant shall continue In full force and effect in perpetuity from the date hereof, unless terminated with the express consent of the City asset forth in an executed and acknowledged Instrument recorded in the real property records of King County, Washington.
