MEMORANDUM OF UNDERSTANDING
This Memorandum of Understanding is between the Planning/Building/Public Works
Department operating in its transportation function (Transportation) and the Community Services
Department operating in its parks function(Parks).
1. Parks owns Tax Parcel Number 172305-9013 off of Maple Valley Highway(SR 169) of
20.15 acres.
2. Transportation has planned and designed the Maple Valley Highway (SR 169)HOV
(High Occupancy Vehicle) Lanes and Queue Jump Improvements Project. Phase I of this
project will construct roadway and pedestrian improvements for the new Cedar River
Park access off of SR 169. In order to construct Phase I of this project, Transportation
needs a portion of the parcel indicated in the prior paragraph and more fully described in
Exhibit A and shown in Exhibit B as Acquisition"B".
3. Parks is aware of the improvements needed for the project described in the prior
paragraph, which will reduce highway congestion and improve traffic safety.
4. Both departments have previously agreed to mitigation of the impacts to the Cedar River
Park as described in the April 9, 2002 and September 3,2002 memos from
Transportation summarizing the agreed-to mitigation and requesting a letter from Parks
agreeing to the mitigation as part of the environmental documentation and the September
25, 2002 memo from Parks stating and agreeing to the mitigation. As shown in the
January 10,2005 memo from Transportation and the December 13,2004 memo from
Parks, both departments have agreed to transfer the property referred to as Acquisition
«B„
Based upon the foregoing facts, Parks and Transportation enter into the following
agreement:
1. Parks will transfer to Transportation the property referred to as Acquisition"B"which is
described in Exhibit A and shown in Exhibit B.
2. Transportation will use this property in the Maple Valley Highway(SR 169)HOV (High
Occupancy Vehicle)Lanes and Queue Jump Improvements Project for road purposes.

SUBJECT: Execution of Declaration of Right-Of-Way Document
The Mayor asked me to review a folder of materials she recently received from the City Clerk's
that included a declaration of right of way for property needed for the SR 169 expansion.
Included with the right of way document was a memorandum of understanding signed by both of
you. The MOU indicates that the Community Services Department agrees to transfer a portion of
Cedar Park property to the Planning/Building/Public Works department for road purposes.
We want to make it clear that—unless property is owned by an enterprise fund—there should be
no document such as an MOU that infers property rights vested in one department or the other.
The park property is owned by neither of your departments. It is owned by the City of Renton. I
thought we had cleared up this confusion when we reviewed the surplus property policy and
procedure several months ago. I am concerned that you seem not to have understood that
discussion.
I understand that we need the Declaration of Right of Way document to record the conveyance of
property for road purposes. And I understand and expect that the two of you need to develop
recommendations for the Mayor(and Council if necessary)to consider regarding mitigation
impacts from road projects on city property designated for park purposes. But those agreements
should not imply department property ownership,unless the property is owned by one of the
City's utility funds.
Please make sure others in your departments understand this as well, and include this memo with
the Memorandum of Agreement signed 31st of March, 2005

Attached is the exhibit map and legal description for the ROW dedication needed from
Cedar River Park for Phase l of the Maple Valley Highway(SR 169)Improvement
project. Please review the documents and proceed to City Council for dedication. For
the fist phase, only Acquisition B, as labeled on the exhibit map and legal descriptions, is
needed for the dedication. The remaining acquired property needed for the entire
project's ROW will be obtained in Phase 2 of the project.
I have also included a letter from the Parks Department stating their acceptance of the
dedication of Park property.
Please process this as quickly as possible; we want to go to construction early this year.
If you have any questions, please let me know.

Re: Maple Valley Highway (SR-169) HOV
Thank you for your recent memorandum regarding the Maple Valley Highway (SR-169)
HOV project. The Parks Department is aware that the Transportation Systems Division
is proposing to make improvements to Maple Valley Highway in the vicinity of 1-405, in
order to reduce highway congestion and improve traffic safety.
We realize this project will take a strip of park land in Cedar River Park adjacent to the
Maple Valley Highway (approximately 14,050 sq. ft.), relocate approximately 98 parking
spaces, and relocate the Park entrance. It is our understanding these impacts will be
mitigated. Upon total project completion, the new Park entrance will be located further
east from 1-405 and will direct traffic through the east side of the park rather than
through the middle of the park, a potentially positive outcome.
We reached agreement on Parks mitigation as summarized in your April 9, 2002
memorandum to me. Mitigation includes the following:
1. Landscaping
2. Textured (architecturaVgraphic) concrete wall barrier 42" high beside sidewalk
along SR-169 (total wall height would be approximately 8' from parking lot).
Parks will have the opportunity to review and approve design drawings.
3. An ADA ramp/walk from the sidewalk along SR-169 down to the parking lot
by the current Park access.
4. Demolition of the Parks Maintenance Building unless Parks has previously
demolished the building. If demolition of the existing maintenance facility is
not possible because a replacement facility is not available, Transportation
will modify SR-169 to accommodate the Cedar River Park Shop at its current
location. Details of this arrangement will be specified in a separate inter-
departmental agreement.

As we have previously discussed, the proposed improvements to the Maple Valley Highway at
Cedar River will take a narrow strip of land from the front of the Park, relocate the entrance to
the Park, and relocate approximately 98 parking spaces. These improvements will relieve
congestion in the vicinity of the I-405 interchange and improve safety. See the attached memo
dated April 9, 2002 summarizing our agreed mitigation for Parks impacts.
In the long run, I believe that shifting the Park entrance approximately 700 feet to the east will
benefit Cedar River Park. The existing Park entrance can become congested when there are long
traffic queues near I-405, a situation which is occurring more and more often and which will be
significantly reduced by moving the entrance out of the high congestion area. The new Park
entrance also allows direct access to parking,the theater,the community center,and the proposed
pool. Additionally, the new entrance will be shared between the Stoneway site and the
Maintenance Facility(15,600 sq. ft. from the Stoneway site). Subtracting the 14,050 sq. ft. taken
from along the Maple Valley Highway, the net change to Parks property due to our impacts is a
gain.
As part of the documentation we are preparing for submittal to WSDOT, we require a memo
from Parks to us, indicating that you are aware of this project, and in fact have discussed and
agreed with us on the mitigation required so as to not have a negative impact on the operation of
the Park. I have attached a suggested memo which should be signed and return to me. I look
forward to receiving the memo back in the near future. I will be gone September 5, 2002 through
September 15, 2002,but please feel free to remit to Joe Armstrong.

This memo and the two attachments are in response to your requests stated at our
March 29, 2002 meeting discussing mitigation for Parks as part of our Maple Valley
Highway (SR-169) HOV project.
I was pleased with our meeting and felt we had agreed on a mutually beneficial
solution for our project. The primary points of our agreement are summarized in this
memo. There are two attachments; the first is the latest rendition of Option C
showing how we will mitigate for access and parking spaces which was modified from
the original to meet your requests. The second is a copy of the City-Stoneway
agreement you had requested.
Agreed to Parks mitigation as follows:
1) Landscaping and textured concrete wall barrier 42" high beside sidewalk along
SR-169 (total wall height would be approximately 8' from parking lot). You will
have the opportunity to review this once it is designed.
2) An ADA ramp/walk from the sidewalk along SR-169 down to the parking lot by
the current Park access.
3) Demo of the maintenance building. We will perform this work unless Parks has
an opportunity first to do the work themselves.
4) Replace parking in kind. This has been done as shown in the attached
rendition of Option C. In addition we will pursue parallel parking as allowable
along the original parking on SR-169.
In addition to the above, we agreed there is the possibility our project timing may not
work well with Parks projects therefore, a transfer of money in lieu of actual parking
mitigation construction may be a possibility. I supplied some very preliminary cost
estimates at our meeting but we can firm those up if this becomes an option we want
to pursue.
Thank you for working with us on this project. I feel we were able to reach a solution

SUBJECT: Execution of Declaration of Public Right-Of-Way Document
Attached please find a Declaration of Public Right-Of-Way document for the Mayor's signature.
As shown by the attached MOU, the Community Services Department has agreed to transfer a
portion of the Cedar River Park property to the Planning/Building/Public Works Department for
road purposes.
Currently, the Transportation Systems Division has a project on the City's most recently updated
Six-Year Transportation Improvement Program, 2005-2010, as the SR 169 HOV Project (140th
Way SE to SR 900). In order to proceed with Phase 1 of this project, the Transportation Systems
Division needs a portion of the Cedar River Park property, referred to as Acquisition "B" in the
attached documents. Since the Cedar River Park property is under the responsibility and
management of the Parks Division, a Memorandum of Understanding was needed to formalize
the agreement between the Community Services Department and the Planning/Building/Public
Works Department.
The MOU merely transfers the responsibility of this portion of the Cedar River Park property to
the Transportation Systems Division. The attached Declaration of Public Right-of-Way
document is intended to declare the property as public right-of-way. Notice of this declaration
will occur upon recording.
After the Declaration of Public Right-of-Way document has been signed, please return it to me
so that I may fill out the appropriate documentation and submit a package for recording.
