RESTRICTIVE COVENANT
WHEREAS,JAMES P.and BARBARA LYNN PIERRE,are the owners of the real property
described in Schedule A attached hereto and incorporated herein; and
WHEREAS, said property is currently zoned CO in the City of Renton; and
WHEREAS, the CO zoning does not allow for certain desirable uses including, but not
limited to, gas stations,min-marts; automobile sales,rental,and leasing; and
WHEREAS,the City of Renton has conditionally approved a rezone of the subject property
From CO to IM on certain conditions,one of which is the execution and recording of this restrictive
covenant; and
WHEREAS, the City wants to preclude undesirable manufacturing, storage and heavy
industrial-type uses from the subject property though allowed in the IM zone;
NOW,THEREFORE,the undersigned as owners of the subject property do hereby place a
restrictive covenant on the subject property, subject to the terms and conditions as hereinafter set
forth, to wit:
0 I. Restrictive Covenant. The owners of the subject property agree not to utilize the
property described in Schedule A for the uses other than applied for,which include a gas station with
mini-mart;automobile sales,rental and leasing;offices associated with these primary permitted uses;
or other similar uses,without first applying for,processing and obtaining approval from the City of
J1 Renton for an amendment to this restrictive covenant allowing any other such use not allowed by
the foregoing_
2. Change in Zoning. If the zoning of the subject property is changed by the City of
Renton in the future, the property owner will, in addition to the uses authorized herein, also be
allowed to utilize the subject property for any uses authorized by the zoning classification to which
the subject property is rezoned.
3. This restrictive covenant will be binding on the heirs and successors of the owners_
