King County has adopted King County Code("K.C.C.")chapter 13.24, 5 which requires approval of comprehensive plans for water utilities that 6 distribute or obtain water in unincorporated King County as a prerequisite 7 for operating in unincorporated King County,receiving approval for 8 annexation proposals,being granted right-of-way franchises, and being 9 given approval for right-of-way construction permits. K.C.C. section 10 13.24.060 prescribes the requirements for approval of such plans, 11 including consistency with state and local planning requirements. 12 2. The Revised Code of Washington("RCW")70.116.050 requires that 13 general comprehensive plans for water within critical water supply service 14 areas be submitted to,and approved by,the legislative authority within 15 whose boundaries all or a portion of a utility lies. 16 3.The city of Renton's ("the city")last water system plan was prepared in 17 2005. Both Washington state Department of Health("DOH")and King 18 County regulations require water system plans to be updated every six 19 years. 1 Ordinance 17653 20 4. The city's service area is within a critical water supply service area and 21 has adopted a Water System Plan("the plan"). 22 5. King County has adopted a comprehensive plan that includes water 23 supply policies in its provisions for facilities and services(policies F-101 24 through F-254)that call for consistency with other adopted plans, support 25 for regional water supply planning,pursuit of reclaimed water, water 26 conservation,and protection of water resources. 27 6. K.C.C. chapter 13.24 requires the utilities technical review committee 28 ("UTRC")to review and make a recommendation to the King County 29 executive and council on the plan and the requirements under K.C.C. 30 chapter 13.24 and consistency with the King County Comprehensive Plan. 31 The UTRC has reviewed the planning data and city operations and has 32 found: 33 a. The plan uses population and employment forecasts developed by the 34 Puget Sound Regional Council for the city's service area; 35 b. Portions of the city's service area are in unincorporated King County; 36 c. The capital facility plan is adequate to meet anticipated facility and 37 service needs; 38 d. The plan is consistent with applicable Washington state water quality 39 laws, including the evaluation of reclaimed water use; and 40 e.The plan is consistent with other pertinent county adopted plans and 41 policies. 2 Ordinance 17653 42 7. The DOH approval of the city's plan is pending King County council 43 action. 44 8. Under the state Environmental Policy Act the city issued a 45 Determination of Nonsignificance for the issuance of the plan on April 9, 46 2012,and there were no appeals. 47 9. The city's operations and facilities meet multiple existing statutory, 48 administrative and planning standards. As the city's operations, facilities 49 and planning meet the requirements of the K.C.C., and are consistent with 50 the King County Comprehensive Plan,the UTRC has recommended 51 approval of the plan. 52 BE IT ORDAINED BY THE COUNCIL OF KING COUNTY: 3 Ordinance 17653 53 SECTION 1.
