HomeMy WebLinkAboutLease t",„„ Ofi/GINAL RLAG -93-001 RENTON MUNICIPAL AIRPORT AIRCRAFT HANGAR PERMIT This Permit is made and entered into between the CITY OF RENTON, as Owner, and NORTHWEST SEAPLANES, INC., as Permittee, as follows: PREMISES: Subject to the terms hereof, Owner shall permit the use by Permittee of Space No. X-33A (hereinafter called the "Office Area") located at Renton Municipal Airport. The exterior area and ground in the immediate vicinity of the building is for the purpose of access to the leased portions of the building. No material whatsoever may be stored upon the exterior area ground. TERM: Except as provided elsewhere herein, the term of this Permit and the rentals due hereunder shall continue on a month-to-month basis until such time as one party gives the other written notice of termination, as herein provided, except that Owner may terminate this Permit upon not less than three days' notice in case of nonpayment of rental. USE: Hangar Area No. X-33A may be used for an office area and/or for the storage of written and office materials and furniture. USE RESTRICTIONS: The Office Area may be used by the Permittee only in conjunction with the use of Hangar X-33C and may not be subleased or the use of this area permitted to any other party. TE M: The term of this lease shall be for a period of one month, commencing on / f� , 199.1, terminating on iha.y 3/-54 , 19903 and month-to- month th reafter. -C7 RENT: Permittee agrees to pay monthly rent of $ gSi , payable in advance. The monthly rental shall be due as of the first day of each and every month during the term hereof, payable by not later than the tenth day of each month. Payment shall be made to the City of Renton, 200 Mill Avenue South, Renton, WA 98055. LATE PAYMENT CHARGE: It is hereby further agreed that if rental is not paid before the 10th of each month then there will be added a late payment charge of 5% per month for each month of delinquency until paid. If any check received by Lessor is returned unpaid for any reason, Lessor reserves the right to make an additional charge of Ten Dollars ($10.00). TAXES: Washington State Leasehold Tax of 12.84%, currently, on rent will be paid by Permittee directly to the City of Renton, WA. with the monthly rental, in addition to any County, State, or Federal taxes which may be assessed by those entities. TERMINATION: Except as provided herein, the term of this Permit and the rentals due hereunder shall continue on a month-to-month basis until such time as one party gives the other written notice of termination. Other provisions herein notwithstanding, in the event that any sum payable hereunder by the Permittee shall not be paid within thirty (30) days after the same becomes due, and upon written notice, the Owner shall proceed to remove therefrom all aircraft and other property which may be contained therein in accordance with State law. Either party may, upon written notice to the other, delivered at least thirty (30) days before the end of the calendar month, terminate this Permit without cause at such effective date. Owner may terminate this Permit upon not less than three days' notice in case of nonpayment of rental. If Permittee is in default of any obligations hereunder, Owner may, in addition to all other rights, give written notice terminating this Permit at any time, such termination to be effective at the time set forth in such notice. NOTICES: All notices hereunder to the Owner shall be in writing and shall be addressed and mailed as follows: Airport Manager 616 West Perimeter Road Renton, WA 98055 All notices to the Permittee shall be in writing and shall be mailed to the Permittee at the business address indicated below, or the last known address. If any such notice to the Permittee shall be returned by the US Postal Service, notice shall be given by posting the same on the office area door. PERMITTEE SHALL: Not assign any interest of Permittee hereunder or sublet, license or permit any other party or parties to occupy any portion of the Office Area without approval of the Airport Manager. Not conduct any charter, rental, repair, instructional service or any other commercial activity in or from the leased premises, i.e., the Office Area, except in conjunction with the use of Hangar X-33C and its permitted uses. Keep the Office Area clean and free of debris and not place any debris on the Renton Airport. Not attach any hoisting or holding mechanism to any part of the Office Area or pass any such mechanism over the struts or braces therein. For purposes of the Permit, a hoisting mechanism shall be deemed to include, but shall not be limited to, a chainball, block and tackle, or other hoisting device. 441iW *Nome Indemnify the Owner, its officers, employees and agents against and hold said parties harmless from any and all claims, demands, or liability which may arise as a consequence of Permittee's presence, conduct, or operation upon Renton Municipal Airport or of the acts or omissions of the Permittee. Not park vehicles on the pavement adjacent to the Office Area door in a manner which unduly interferes with or obstructs access to adjacent hangars. Accept the Office Area in "as is" condition and be responsible for their own maintenance. OWNER SHALL: Provide reasonable access to the Office Area and public taxiways, ramps and runway. Periodically inspect the Office Area and keep the Office Area in good repair, Permittee to give prompt, written notice to the City in case of any defect, damage or need of repair. I have read and understand the foregoing and agree to be bound thereby. I will notify the Owner or its representative of any changes in my address, aircraft ownership, or change of use, and such notice to be given within ten (10) days after any such event.
