RESOLUTION NO. 3248
A RESOLUTION OF THE CITY OF RENTON, WASHINGTON, SETTING A
HEARING DATE TO VACATE A PORTION OF S.W. 12TH STREET, FULL
VACATION OF S.W. 13TH STREET, AND THE ALLEY BETWEEN S.W.
12TH AND 13TH (SCARFF; VAC-97-001) .
WHEREAS, a Petition has been filed with the City Clerk of the
City of Renton on or about January 31, 1997, pursuant to the
requirements of RCW 35 . 79, petitioning for the vacation of a portion
of a certain street,, as hereinafter more particularly described, and
said petition having been signed by the owners of more than two-
thirds (2/3) of the property abutting upon a portion of said street
sought to be vacated, and same being described as follows :
See Exhibit "A" attached hereto and made a part hereof as if
fully set forth herein.
(Portion of S .W. 12th Street, full vacation of S .W. 13th
Street, and the alley between S .W. 12th and 13th)
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON,
WASHINGTON, DO RESOLVE AS FOLLOWS :
SECTION I. That the 24th day of March, 1997, at the hour of
7 : 30 P.M. at the City Council Chambers in the Municipal Building,
Renton, King County, Washington, be and is hereby fixed as the time
and place when the aforesaid Petition for vacating theaforesaid
portion of S .W. 12th Street, full vacation of S .W. 13th Street, and
the alley between S .W. 12th and 13th shall be heard and determined,
which said hearing date is not more than sixty nor less than twenty
days from the date of passage of this Resolution.

SECTION II. The City Clerk is hereby authorized and directed
to give notice of said time and hearing as provided in RCW 35 . 79 . 020
RESOLUTION NO. 3248
and any and/or all persons interested therein or objecting to said
vacation may then appear and be heard thereon, or they may file
their written objections thereto with the City Clerk at or prior to
the time of hearing on said vacation.
SECTION III. The City Council shall determine, as provided in
RCW 35 . 79 . 030, as to whether an appraisal shall be secured to
determine the fair market value of the property sought to be vacated
as provided for in Ordinance No. 4266, and the amount of
compensation to be paid by the Petitioner-Owners to the City for
such vacation but which said amount shall not exceed one-half (1/2)
of the appraised value of the area to be vacated.
The, City likewise- reserves the right to retain an easement for
public utility and related purposes .

Legal Description
Those portions of SW 12th Street (Second Avenue) between Maple Avenue SW (Main Street) and the I-405
and SR-167 interchange right-of-way; SW 13th Street (Third Avenue) between Maple Avenue SW and the
said interchange; and the alleys through Blocks 16 and 17, all as dedicated in the plat of C. D. Hillman's
Earlington Gardens Addition to the City of Seattle Division No. 1 according to the plat thereof recorded in
Volume 17 of Plats, page 74, records of King County,Washington, in the Northwest Quarter of Section 19,.
Township 23 North, Range 5 East,W.M.,being more particularly described as follows:
That portion of SW 12th Street beginning at the northwest corner of Lot 28, Block 17 of said plat, thence
along the arc of a curve to the right with a radius of 56.49 feet to a point of tangency with a line 12.00 feet
northerly of and parallel with the north line of said Block 17;
Thence northeasterly along said parallel line to an intersection with the northerly extension of the east line of
Lot 5 of said Block 17;
Thence southerly along said extension line of Lot 5 to the northerly line of said Block 17;
Thence southwesterly along said northerly line to the point of beginning;
ALSO,that portion of SW 12th Street beginning at the southwest corner of Lot 29, Block 16 of said plat;
Thence southeasterly along the arc of a curve to the left with radius of 31.27 feet to a point of tangency with a
line 12.00 feet southerly of and parallel with the south line of said Block 16;
Thence northeasterly along said parallel line to an intersection with the southerly extension of the east line of
Lot 39 of said Block 16;
Thence northerly along said southerly extension tothe southerly line of said Block 16;
Thence southwesterly along said southerly line to the point of beginning;
ALSO, that portion of SW 13th Street beginning at the intersection of the south line of Block 17 of said plat
with the west line of said SR-167 interchange right-of-way;
Thence southwesterly along said west line to an intersection with a line 17.50 feet northerly of and parallel
with the north line of Block 21 of said plat, said parallel line also being the southerly right-of-way line of SW
13th Street in its alignment according to the partial vacation by City of Renton Ordinance No. 4610, recorded
under King County Recording No. 9606140284;
Thence southwesterly along said line to an intersection with the southerly extension of a line 17.50 feet
westerly of and parallel with the west line of said Block 17;
Thence northerly along said extension line to an intersection with the southwesterly corner of said Block 17
according to said partial vacation by City of Renton Ordinance No. 4610;
Thence southeasterly, easterly, northerly and northeasterly along the southerly line of said Block 17 to the
point of beginning;
ALSO,that portion of the alley through Block 17 of said plat, beginning at the southwest corner of Lot 28 of
said Block 17; Thence northeasterlyalongthe north line of said alleyto an intersection with the west line of
said SR -167 interchange right-of-way; Thence southerly along said SR -167 interchange right-of-way to an
intersection with the south line of said alley;
Thence southwesterly along said south line to an intersection with the west line of said Block 17;
Thence northerly to the point of beginning.
Contains an area of 40,348.44 square feet, or 0.92 acre, more or less.
