ORDINANCE NO . 3785
AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON AMENDING
PORTIONS OF CHAPTER 11 , TITLE IX (PUBLIC WAYS & PROPERTY)
OF ORDINANCE NO. 1628 ENTITLED "CODE OF GENERAL ORDINANCES
OF THE CITY OF RENTON" , RELATING TO SUBDIVISION
REQUIREMENTS (BINDING SITE PLAN & FEES)
THE CITY COUNCIL OF THE CITY OF RENTON , WASHINGTON, DO ORDAIN
AS FOLLOWS :
SECTION I: Existing Section 9-1102 of Title IX (Public Ways &
Property) of Ordinance No. 1628 entitled "Code of General Ordinances
of the City of Renton" is hereby amended by adding the following new
subsection :
Section 9-1102 (20) : Binding Site Plan. "Binding Site Plan"
means a survey of a new subdivision of a parcel of real property
which has previously received final plat after November 15, 1971 , or
final Planned Unit Development approval, prepared for filing for
record with the Office of the King County Recorder and containing
all elements and requirements set forth in Section 9-1106A and RCW
58. 17.020(6 ) , or as hereafter amended .
SECTION II: Existing Chapter 11 of Title IX (Public Ways &
Property) of Ordinance No. 1628 entitled "Code of General Ordinances
of the City of Renton" is hereby amended by adding the following new
section :
Section 9-1106 (4) BINDING SITE PLAN .
(A) Binding Site Plan Authorized: Division of lands into lots
or tracts classified for industrial or commercial use may be
accomplished by means of a Binding Site Plan.

(B) Binding Site Plan Requirements :
( 1 ) Application : The Binding Site Plan shall be
prepared by a registered land surveyor in accordance
with the requirements of RCW 18. 43.010 . The
application shall be submitted with eight (8) copies
plus the original to the Building and Zoning
Department who shall record the date received and
assign a file number . The application shall be
accompanied by a fee in accordance with the fee
schedule of the City of Renton.
(2) Referrals and Recommendations : The Building and
Zoning Department shall transmit copies of the
Binding Site Plan to other departments and agencies
as necessary for their review and recommendations .
The departments and agencies shall make their written
recommendations regarding the Binding Site Plan to
the Building and Zoning Department within ten ( 10)
days after receipt of the proposed Binding Site Plan.
(3) Required Information:
(a) The applicant of the Binding Site Plan
shall furnish information according to
Section 9-1106 (3) (H) (1 )-(3) and (6)-(9) ,
(I) , and (K) and (M) of the City Code .
(b) In addition , the Binding Site Plan
shall include on its face the following
information:
"Development or construction of
any improvements upon the real
property herein described shall
be in accordance with the Binding
Site Plan approved by the City of
Renton on , 191
and the [final plate. [final
Planned Unit Development]
approved by the City of Renton on

"This Binding Site Plan and all
of its requirements shall be
legally enforceable on any
purchaser or other person
acquiring an interest in the
within-described real property."
(4) Revisions : Based upon its review and the review
of the application by other agencies and departments ,
the Building and Zoning Department may require the
applicant of the Binding Site Plan to revise the
proposal to conform to the requirements of the Renton
City Code on the date of the filing of the
application, except as provided in RCW 58. 17. 170 , and
to promote public health and safety and the general
welfare of the City.
(5) Approval: Binding Site Plan applications shall
be approved or disapproved by the Building and Zoning
Department within thirty (30) days after the date of
issuance of the environmental determination . Any
revision to the proposed Binding Site Plan shall be
approved or disapproved within thirty (30) days from
the date of re-submission . Such time limits may be
extended with the consent of the applicant. In the
event that the Binding Site Plan is based upon a
previously approved final Planned Unit Development ,
then the final Planned Unit Development shall be
recorded by the City Clerk in the office of the King
County Recorder at the expense of the applicant , if
not previously recorded .
(6 ) Recording of Binding Site Plan : The final
Binding Site Plan shall be recorded at the expense of
the applicant by the City Clerk upon submittal of the
final Binding Site Plan, upon approval by the

Building and Zoning Department and Department of
Public Works , and upon full compliance with the
provisions of the City Code .
(7) Appeal: Appeals from the administrative
determinations in the administration of the Binding
Site Plan approval shall be made to the Hearing
Examiner as an appeal from an administrative
determination.
(8) Expiration : If the Binding Site Plan is not
recorded within three ( 3 ) years of the date of
approval of the application, the application shall be
null and void . Upon proper application by the
applicant , the Building and Zoning Department may
grant one extension of not more than six (6) months .
An expired Binding Site Plan application may be
refiled by resubmission as a new application .
SECTION III : Existing Section 1-4101 of Title I
(Administrative) of Ordinance No. 1628 entitled "Code of General
Ordinances of the City of Renton" is hereby amended by adding the
following fee schedule .
Section 1-4101 Fee Code Section
( 19) Binding Site Plan Approval $300.00 9-1106A ( 1 )
SECTION IV : If any part or portion of this Ordinance is
determined to be unconstitutional or invalid by a court of competent
jurisdiction such determination shall not affect the remainder of
this Ordinance .
SECTION V: This Ordinance shall be effective upon its passage ,
approval and thirty (30) days after publication .
