CITY OF RENTON, WASHINGTON
RESOLUTION NO. 2093
WHEREAS the City Council of the City of Renton, Washington, a
municipal corporation operating as a non-charter code city, has heretofore
authorized the preparation of a Water System Comprehensive Plan by joint
participation with King County Water Districts No. 14 , 63 , 69 , 77 and 88 ,
all in accordance with WAC 248-54-280 , and in conformity with the Inter-
Local Governmental Cooperation Act, RCW 39 . 34 and
WHEREAS in accordance with the above authorization the Comprehensive
Water System Plan was heretofore completed by Harstad Associates , Inc. ,
on or about October 5 , 1976 , and
WHEREAS the City of Renton, acting by and through its Public Works
Department, has reviewed said Comprehensive Water System Plan and the
proposed system of joint water supply and storage recommended by the
Plan and find that said Plan and the proposed joint water supply and
storage project will meet the requirements of the City , and
WHEREAS at a meeting on January 12 , 1977 , representatives of the
various King County Water Districts hereinabove enumerated, and the
City Council of the City of Renton agreed to proceed with the implementation
of the joint water supply and storage project as recommended in said
Comprehensive Water System Plan, and
WHEREAS it has been determined that the first step in the imple-
mentation of such plan requires the preparation of contracts among
the six participants , the preparation of Environmental Review documents
necessary to comply with the provisions of the State Environmental
Policy Act (SEPA) and SEPA guidelines , and the preparation of a final
application for Referendum 27 Grant to assist in the financing of such
project , and
WHEREAS the legal firm of Roberts , Shefelman, Lawrence , Gay and
Moch and the engineering firm of Harstad Associates , Inc. have submitted
proposals through the City of Renton to provide professional services
necessary to carry out , on behalf of the participants , the task set
forth above , said proposals being attached as Exhibit "A" and "B" ,

respectively, and incorporated herein as if fully set forth , and
WHEREAS it has been determined that a budget of $20 ,000 be
established for the payment of engineering and legal fees and that
the prorata share of such amount to be borne by the City of Renton
shall be the sum of $7 ,498 . 00 ; NOW THEREFORE ,
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON DO RESOLVE
AS FOLLOWS :
SECTION I : The above findings and recitals are hereby found to
be true and correct in all respects.
SECTION II : The City of Renton is hereby designated as the lead
agency g y for completion of the environmental review of the proposed joint
water
supply and storage pro0ect in accordance with the State Environ-
mental Protection Act (SEPA) and SEPA guidelines ;
SECTION III : The firm of Roberts , Shefelman, Lawrence , Gay and Moch
be retained in accordance with the proposal attached as Exhibit "A"
and the firm of Harstad Associates , Inc. shall be retained in accordance
with the proposal attached as Exhibit "B" .
SECTION IV: The cost of such legal and engineering services budgeted
at $20 ,000 shall be prorated among the joint participants in the water
supply and storage project as follows :

Re: City of Renton - Intergovernmental Water Contract
Dear Warren:
This letter is to follow up our conference wherein you requested
that we write a letter indicating our proposal for work on the above
contract. With respect to your situation, it is our understanding
that the City of Renton would propose to contract with nearby King
County Water Districts Nos. 14 , 63, 69, 77 and 88.
In carrying out such work we would suggest that this office first
draft a contract form based on information furnished by Ron Heinke on
the desires of the various parties and containing other provisions which
have been common to most contracts of this type. Following such draft, •
we would meet with representatives of the parties to discuss the con-
tract draft and desires for changes or additions thereto. Throughout
the process we would confer with the individuals recommended to serve
as "contact people," one of whom we understand will be Ron Heinke of
. Harstad Associates Inc. We foresee that there would be at least two
meetings with the representatives of the parties before a contract
would be worked out and probably three or four contract drafts.
Unless something unusual should arise which would cause addi-
tional work not foreseen at this time, we believe that it is reasonable
to set a maximum budget' for our work ranging between $5,000 and $6,000.
We shall charge on an hourly basis ranging from $50 to $70 an hour
• depending upon the person in this office who is performing the work.

As you know, we have had extensive experience in drafting inter-
governmental contracts both for water and sewer services. Because
we have recently been participating in writing and negotiating such
contracts, it should take less time to draw your contract. It is our
understanding that although we shall be looking to Renton for payment
and administering our contract, our fee and the costs relating thereto
will be shared by all of the parties on a basis worked out among them.

Re: Skyway-West Hill Joint Water System Improvements
Phase 3
Dear Warren:
This letter is our proposal to provide engineering services necessary to
carry out Phase 3 of the subject joint water system improvement program.
as agreed upon by the participants at a joint meeting on January 12, 1977.
The three tasks to be accomplished under this phase of the improvement
program are as follows:
1 . Preparation and execution of contracts for the implementation of
the construction of the joint system improvements and the subse-
quent operation and maintenance.
2. Preparation of environmental documents necessary to comply
with the State Environmental Protection Act (SEPA) and the
SEPA guidelines relative to the proposed action of adoption
of a joint water system improvement plan and the authorization
of the construction of the proposed improvements.
3. Preparation of a final application under the Referendum 27 Grant
Program to secure a grant on behalf of the participants to assist
in the financing of the construction of the improvements.
We propose to provide engineering services necessary to the successful
completion of these three tasks on behalf of the joint participants in
accordance with the following scope of work:
1 . Joint Participant Contracts
We propose to work with the legal firm of Roberts , ShefelmanL
Lawrence, Gay and Hoch in the preparation of a preliminary draft
contract and subsequent contract revisions as necessary until an
acceptable contract to all parties has been prepared. We will

act as a liaison with the participants in the distribution of
draft contracts and the scheduling of meetings required to dis-
cuss contracts and to resolve contract requirements as required.
We will act on behalf of the participants in an effort to assure
that contract provisions are in accordance with the joint parti-
cipants ' requirements.
2. SEPA Procedure
We propose that the joint participants designate the City of
Renton as the lead agency in accordance with the SEPA guidelines
for the carrying out of the environmental review process. We will
prepare an Environmental Checklist in accordance with the SEPA guide-
lines based on information currently available to us and field in-
spection of the location of the proposed improvements. The Environ-
mental Checklist will be presented to the City of Renton for thresh-
old determination. If the City of Renton determines that the proposed
action will not have a significant impact on the environment, we will
prepare the necessary declaration of non-significant impact as required
under the guidelines. If the City of Renton determines that the pro-
posed action will have a significant impact on the environment, we
will proceed with the preparation of a draft environmental impact
statement in accordance with the SEPA guidelines. The draft Environ-
mental Impact Statement will be presented to the City of Renton for
filing in their EIS available register and distributed for comment
to all affected agencies. Should an affected agency or citizen re-
quest a public hearing, we will prepare the necessary notices to meet
this requirement and assist the City in the presentation at the public
hearing. Following the receipt of comments to the draft Environmental
Impact Statement and the successful completion of the public hearing,
if required, we will prepare a final Environmental Impact Statement
in accordance with the SEPA guidelines and complete the environmental
review process.
3. Referendum 27 Grant Application
We will prepare a final Referendum 27 Grant Application in accordance
with the guidelines under this program. We will prepare all necessary
supporting data and documentation required to file a complete appli-
cation, ready for prioritization by the Department of Social and
Health Services. We will maintain liaison with the Administrator
of the Referendum 27 Grant Program to assure that the application
receives proper consideration for grant funding at the earliest
possible date.

We propose to perform engineering services in accordance with the above scope
of work on a time and material basis. Billing will be based on the actual
manhours expended in the completion of the work at salary cost times a multi-
plier of 2.35. In-house direct expenses will be billed in accordance with
our established charges. Outside direct expenses will be billed at invoice
cost plus 15 per cent.
Since the requirements for engineering services under each of these tasks
may vary significantly, we are not able to establish an exact budget for their
accomplishment . However, we have estimated a budget range for each task and
we agree to not to exceed the upper limits of the budget range established
without specific additional authorization of the participants. The budget
range for each task is set forth below:
1 . Contract Preparation $1 ,000 - $3,000
2. Environmental Review Process $2,000 - $7,000
3. Referendum 27 Grant Application $1 ,000 - $3,000
It is our understanding that the cost of engineering services, as proposed
above, will be shared by all parties in accordance with the agreed upon parti-
cipation in capital costs by each joint participant. However, we further.
understand that our services will be billed to the City of Renton and pay-
ment will be from the City of Renton in accordance with the authorization of
the joint participants.
If this proposal meets with the approval of the City of Renton and the remaining
participants in the joint water system improvement project, we will prepare an
agreement for execution in accordance with its terms.
