THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN •
AS FOLLOWS :
SECTION I. Section 4-31-19 .F of Chapter 31, Zoning Code,
of Title IV (Building Regulations) , of Ordinance No. 4260 entitled
"Code of General Ordinances of the City of Renton, Washington" is
hereby amended to read as follows :
4-31-19 .F: Variances :
1 . Authoritv and Applicability:
a. Hearing Examiner Variances : The Hearing Examiner
shall have the authority to grant variances from the provisions of
this Title where the proposed development requires or required any I
permie or approval as set forth in Chapter 36 of Title IV. I
b. Board ot Adjustment VarfanCes : The Board of
Adjustment shall have authority to grant variances from the
provisions of this Tit�e upon application to the Development

Services Division where no approval or perinit is required for the
proposed development which must be granted by the Examiner pursuant
to Chapter 36, Title IV. The Board of Adjustment shail have no
authority to vary the terms or conditions of any pennit,
recommendation or decision issued by the Hearing Examiner.
c. Administrative Variances : The Planning/Building/Public
Works Administrator, or his/her designee, shall have the authority
to grant variances from the following development standards when no
other permit or approval requires Hearing Examiner review:
(1) Residential land uses - Lot width, lot depth,
setbacks, allowed projections into setbacks, and lot coverage; and
(2) Commercial and industrial land uses - Screening
of surface mounted equipment and screening of roof-top equipment .
2 . Application and Notice: A property owner, or his duly
authorized agent, may file an application for a variance which
application shall set forth fully the grounds therefor and the
facts deemed to justify the granting of such variance. Notice of
the application shall be given pursuant to Code section 4-36-8 .
a. Hearing Continuation: If for any reason
testimony in any manner set for public hearing, or being heard,
cannot be completed on date set for such hearing, the person
presiding at such public hearing or meeting may, before adjournment
or recess of such matters under consideration, publicly announce

the time and place to and a� tahiCh said inee�ing will be continued,
and no further notice of any kind shall be required.
3 . Review Criteria: The Rewiewing Official shall have
authority to grant a variance upon making a determination in
writing that the conditions specified below have been found to
exist :
a. That the applicant suffers undue hardship and the
variance is necessary because of special circumstances applicable
to subject property, including size, shape, topography, location or
surrcundings of the subject property, and the strict application of
the Zoning Code is found to deprive subject property owner of
rights and privileges enjoyed by other property _ owners in the
vicinity and under identical zone classification;
b. That the granting of the variance will not be
materially detrimental to the public welfare or injurious to the
property or improvements in the vicinity and zone in which subject
property is situated;
c. That approval shall not constitute a grant of
special privilege inconsistent with the limitation upon uses of
other properties in the vicinity and zone in which the subjec�
I property is situated;

d. That the approval as determined by the Reviewing
Official is a minimum variance that will accomplish the desired
purpose.
4 . Conditions of Approval : The Reviewing Official may
prescribe any conditions upon the variance deemed to be necessary
and required.
5 . Appeals : Property owners or his/her authorized agent
within 300 feet of the subj ect property may appeal the granting of
an administrative variance decision, or a property owner, or
his/her duly authorized agent may appeal the denial of an
administrative variance decision _to the Hearing Examiner, pursuant
to Code section 4-8-10 .A. 8 . The processing of such appeal will be
governed by Code section 4-8-11 .B.
6 . Expiration: Any variance granted by the Reviewing
Official, unless otherwise specified in writing, shall become null
and void and in the event that the applicant or owner of the
subject property for which a variance has been requested has failed
to commence construction or otherwise implement effectively the
variance granted within a period of two (2) years after such
variance has been issued. For proper cause shown, an applicant may
petition the Reviewing Official for an extension of the two (2)
year period, specifying the reasons therefor. The Reviewing
Official may extend the time limit, but such extension shall not

exceed one additional year iri any even� . Any variance granted by
the Hearing Examiner shall expire pursuant to the provisions of
Chapter 8, Title IV.
SECTION II. Section 4-36-2 .B of Chapter 36, Renton
Regulatory Reform Ordinance, of Title IV (Building Regulations) , of
Ordinance No. 4260 entitled "Code of General Ordinances of the City
of Renton, Washington" is hereby amended by adding subsection 7
which reads as follows :
7 . Administrative Variances .
SECTION III. Section 4-36-6 .D. 1 of Chapter 36, Renton
Regulatory Reform Ordinance, of Title IV (Building Regulations) , of
Ordinance No. 4260 entitled "Code of General Ordinances of the City
of Renton, Washington�� is hereby amended to read as follows :
4-36-6 .D.1: Variances not associated with a development
permit that requires review by the Hearing Examiner or
administrative variances .
SECTION IV. Section 5 . 1 . 1 .A of Chapter l, Fee Schedule, of I
Title V (Finance and Business Regulations) , of Ordinance No. 4260
entitled "Code of General Ordinances of the City of Renton,
Washington" is hereby amended by adding subjection v, which reads
as follows :

ORDINANCE NO. 4648
SECTION V. Tables 3 , 4 and 7, as referenced in Renton City
Code sections 4-36-4 .C, 4-36-7 .E and 4-36-7 .F are hereby amended to
reflect the administrative variance procedure. A copy of each
table, as amended, is attached hereto as Exhibit A, and is
incorporated by this reference.
SECTION VII . This ordinance shall be effective upon its
passage, approval, and thirty days after publication.

1. SEPA exempt or for which the SEPA/land use permit process has been completed.
2. Administratively approved.
3. In lieu of the public notice requirements of Section 4-36-8, public notice of a SEPA exempt
temporary use permit shall consist of the on-site installation of a 24"X 30" sign meeting
the requirements of Section 4-31-19. At the discretion of the Administrator, additional
notice may be required.
4.Environmental Review may be associated with Land Use Permits. The
_ - -..Environmental Review Committee (ERC) is responsible for environmental determinations.
5. Board of Adjustment shall hear variances where not associated with a development
that requires review by the Hearing Examiner, and for those land use actions not
covered by administrative variances.
6. Shoreline Conditional Use Permits and Shoreline Variances also require approval of
the State Department of Ecology (DOE). DOE has up to 30 days to make a decision
on a permit. This time period does not count toward the 120 day maximum time limit for
permit decisions. DOE's decision is followed by a 21 day appeal period, during which.
time no Building Permit for the project may be issued.
7. An Open Record Appeal of an Environmental Threshold Determination must be held
concurrent with an Open Record Public Hearing.
8. Street vacations are exempt from the 120 day permit processing time limit.
