JUSTIFICATION FOR THE VARIANCE REQUEST
A. The 10·20 building was built before the American with Disilbilities Act
became law and was pm of nny design criteria or local building codes. As a
result. the existing locntion of the accessible parJdng stalls is not idem and
presents a potr.:ntial pedestrian/vehicle conflict to the users of these parking
stalls. The existing site conditions present a 4% slope 10 negotiate (or any
wheelchair bound stall user. This site condilion requires a wheelchair. apron
exiting a car, (0 roll down a 4% slope, into a vehicle travel way. The .
draimlge pattern of the travel way incorporates an Ol.c;phalt swate whose
longitudinal slope to the West. is close to the existing accessible staUs and
not down the centerline of the travel way. The wheelchair user must then
make their way along the vehicle trovel way (0 the wheel chair curb cut at
the entry plaza of the building . The height of the existing entry pi ....
precludes any potential ramp to be built and stiIJ allow accessible sUllls to be
located close 'to the enlry to the bUilding.
The proposal is to move the existing accessible stalls across the vehicle
tra.vel way. This will allow wheelchairs existing the CRr to enter onto to a
1%-2% slope. to have direct access to the side walk and onto a striped
pedestrian cros~;ing leading directly to the buildings entry plaZOl. This
requires the existing parking stall to be extended four feet into the existinr
planting strip. The pillnling strip c.,"sists of grass Bnd deciduous street trees.
The current set back requirement is 20 feet . TIle proposed setback wilt be
sixteen feet six inches for the width of the six accessible stalls.
The finish floor elevation of the e;:isting building. existing cross slopes of
the parking and travel way. and the distance between the building entry and
the street right of way restricts the proposed design changes to be built
without a variance as existing codes will not allow n smaller landscaped set
back.

Assembly Plant. The building is an ofliee building facing onto an · ~t\~ ~ ';)

welfare . It will be positive as it will add direct sidcwalk acccss to the
entry p131.il where there is not any. To enler the building now will require
pedestrian conflict with vehicles in the vehicle travel way . The proposed

cover necessary to incorporate the proposed design chnngcs. This
includes covering 4' X 80' of ground cover for 5i. staU widths, and three
concrete paths to the existing sidewalk.
