AN ORDINANCE OF THE CITY OF REN'�ON PROPiDING FOR THE �
VACATION OF STREETS AND AI.LEYS, ESTABLI5HING A PROCEDURE
THEREFOR� IMPOSING AND FIXING A PROCESSING F$E AND
AUTHORIZING PAYMENT OF COMPENSATION ?0 TfiE CZTY BY THE
ABUTTING OWNERS IN AN AMOUNT NOT TO EXCEED ONE-HALF OF '
THE APPRAISED VALUE OF THE STREET OR ALLEY SO VACATED.
BE IT ORDAINED BY THE MAYOR AI3D THE CITY COUNCIL OF THE CITY OF RENTON
AS FOLLCIWS: �
SECTION I; The owners of an interest in any real estate abuticing upon
any street or alley within the City of Renton may petition the City Couacil for the
vacation of such street or alley or any part thereof, Such petition shall be on
such form as may be grescribed by the City, shall contain a full and correct ,
description of the property sought to be vacated and such petitioa shall be signed by
the owners of more than two-third (2/3) of the property abuttfng ngon �he part of such
street or alley to be vacated.
Upon the filiag of such petition with the Ci.ty Clerk, the peti�ioning
owners shall simultaaeously pay therewiCh a fee of esle hurdx�d c�o�.lars ($xfl0�00) , to
be hereafterknown as the processiag fee, to compeasate the City for tne administr�tive
cost and expense i� processing, checking and handling such agplication, which fee -�-
shall likewise include the publication and posting expense of any natice or ordi�ctance
perCaining to such vacation.
SECTION II: After verification of such petition by rhe City Enginesr
or his duly authorized representative, the C�-ty Council shall by resolution fix
t he time for the heaziag on such petition, which time shall not be more thsa s3.xty
(60) days nor less than ltaenty (20) days after the passage of such� resolution.
Notice thereof shall be givea as provided for by RCW 35.79.020 and the heariag shal.l
be held before the Citq Council or before a Committee of said legislative body and
as otherwfse provided for in RCW 35.79.030, as amended.

The City Council may determine, at or pri�r to any such public hearing on
the peCition to vacate a street or alley, or any portion thereof, that the abutting
owners of the proper�y petitioned to be vacated pay utlto the CiCy an amount which
shall not exceed one-half (1/2) of the appraised value of the area so vacated and
upon such determination, the City shall make or cause Co be made such appraisal in
writing and furnish the results thereof unto the legi.slative body. The amount thus
determined upon appraisal shall then be paid in cash unto the City Clerk aad .the
ordinance vacating such street or alley shall not become effective until such gayment
has been made. The Cit� further reserves the right to retain an easement, or the

construction, repair and maintenance o� public utilities and public servfces and
Che re.tentioa of such easement, if any, shall be duly considered and allowances made
therefor in the malcing of any such appraisal.
SECTION III: No street or a11ey, or any parts thereof, shall be vacated
if any portion tnereof abuts oa a body of salt or fresh water unZess such vacation
be sought to �nable the City, Port District or State to aequire the property for port
purposes, boat moorage or launching sites, park, viewpoint, recreational, or educa-
tional purposes, or other gublic uses; provided however that this sectioa shall not
be applicable to iadustrially zoned property.
SECTION IV: tTp_oa the vacation of any street or alley as hereiaabove
provided for, the property within the limits so vacated she11 beloag to the abutting
property owners, one-half (1/2) to each. A certified copy of the ordiaaace vacatittg
; any such street or alley, or part thereot, shall be filed for record with the King
County Auditor's office, and additioaal copies thereof may be furaished to such
govercimental agencies as may have aa iaterest thereio.. • .
SECTION V: This Ordinaace shall be in full force and effect from and
after its passage, approvaZ and legal publicatioA.
