' -��D AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, APPROVING AND CONFIRMIN6 THE ASSESSMENTS AND ASSESSMEN.T ROLL OF LOCAL IMPROVEMENT DISTRICT N0. 260 FOR THE IMPROVEMENT OF A CERTAIN AREA WITHIN THE CITY OF RENTON BY THE CONSTRUCTION . AND INSTALLATION OF CERTAIN WATER MAINS AND APPURTENANCES THERETO AND BY DOING ALL Tn70RK NECESSARY IN CONNECTION THEREWITH; LEVYING AND ASSESSING THE AMOUNTS THEREFOR AGAINST THE SEVERAL LOTS , TRACTS , PARCELS OF LAND AND OTHER PROPERTY AS SHOWN ON SAID ASSESSMENT ROLL AS . CONFIRME.D ; BY. THE CITY COUNCIL; AND PROVIDING FOR THE PAYMENT OF SUCH ASSESSMENTS INTO THE ' LOCAL IMPROVEMENT. .FUND, DISTRICT N0 . 260 OF THE CITY OF RENTON AS CREATED BY ORDINANCE N0. 2446 . WHEREAS the assessment roll levying the special assessments against .the properties located in Local Improvement District No. 260 of the City of Renton, created under Ordinance No.. 244.6 has been filed with the City� Clerk of the City of Renton by the City Engineer as provided by law; and , WHEREAS due notice of the time and place of hearing thereon and making objections and protests to said roll was duly published at and for the time and in the manner provided by law, fixing the time and place of hearing thereon for the 21st day of April,� l9`69 , at the hour of 8 : 00 P.M. in the City Council Chambers, City Hall, Renton, Washington, and further notice thereof was duly mailed by the City Clerk to each property owner shown on said roll as provided by law and as further specified in RCW 35 .44 . 090, and ,I WHEREAS .at the time and place fixed and designated in said notice, the hearing on said assessment roll was duly held and the �ollowing protests and/or objections were received �rior, at and i during said hearing, to-wit: I II�Tone ' and the City Council having duly considered said assessment roll and all matters filed in connection therewith, and the City Council sitting and acting as a Board of :E�qua.-lization for the '�urpose of -1- . • . � . �.c�d��l'�f-;�3 considering the roll, the benef.its to be received by each lot, parcel and tract of land shown upon said roll, including the increase in th.e fair market. value of each such parcel of land by reason of � said improvement; NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, AS FOLLOWS : � SECTION I : That the assessments and aseessment roll of Local Improvement District No.. 260 , which has been created and established for the purpose of paying the. .cost of constr.ucting and installing certain water mains and appurtenances the.reto. in the vicinity of East Valley Highway and South 180th Street, Renton, King Count�, Washington, all in accordance with .Ordinance No. 2446 , be and the same is hereby in , all things approved and confirmed so that the total amount of said assessment roll being in the .sum of $66,725 .79. SECTION II : That each of the lots , tracts , parcels of land and other property shown upon said assessment roll is hereby determined and declared to be specially benefited by said improvement in at least the amount charged against the same, and the asseesments appearing against the same are in proportion to the s.everal assessments appearing I� upon said roll. There is hereby l.evied and assessed against each lot, tract, or pax�cel of land, or other property appearing upon said roll, the amount finally charged against .the same thereon. SECTION III : That .the asses.sment roll as approved and . I confirmed shall be filed with the City Treasurer for. collection and said City Treasurer is hereby authorized and directed to publish notice as required by law, stating that said roll is in his hands for collection and that payment of any assessment thereon or any portion of said assessment can be made at any time within thirty. days from date of first publication of said notice, without penalty, interest or cost, and that thereafter the .sum remaining unpaid, may be paid in ten equal -2- '{ x r �`,;tfi�i�-":1�i�;!_ annual installments with intere.st .thereon her.eby, fixed at the rate of 6 per cent .per annum. The first installment of assessment on said assassment roll shall become due and payable during the thirty , day period succeeding the date one year after the date of first publication by. the City Treasurer of notice that the asses�sment roll ,� is in his hands for collection and annually thereafter each succeeding :� insta�lment shall become due and payable in like manner. If the whole or any portion of the assessment remains unpaid �ter the first .30 day period,interest upon the whole unpaid sum shall be charged at the rate of 6 per cent .per annum and each .year thereafter one of said installments , together with interest due on the whole of the unpaid balance, shall be .collected. Any installment not paid prior to expiration of the said 30 day period during which said installment is due and payable shall ther.eu�on become delinquent . All delinquent installments shall be subject to a charge for inte.rest at �i. per cent .per annum and for an additional charge of 6 per cent .penalty I�, levied upnn both principal and interest .due upon such installment or installments . The collection of such delinquent insta�lments shall , be enforced in the manner provided by law. SECTION :IV: All of such assessmerits or installments thereof, and interest and penalty, if any thereon, when collected by the City Treasurer, shall be paid into the Local Improvement Fund, District No.. 260 , of the City of Renton as created by said Ordinance No.. 2446 '' and shall be used solely for the purpose of paying the principal and interest on the warrants and bonds drawn upon or issued against said Fund, or in case no bonds have been issued, then in payment of any installment note or notes as provided for in RCW 35 .45.. 150 , as may be determined by the City Council :of the City of Renton. SECTION V: This Ordinance shall be in full force and effect from and after its: passage, approval and legal publ.ication.
