AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
AUTHORIZING THE ACQUISITION OF CERTAIN LANDS BY
' EMINENT DOMAIN, PROVIDING FOR THE PAYMENT THEREOF
OUT OF THE GENERAL FUND; AUTHORIZING THE CITY
ATTORNEY TO PREPARE A PETITION FOR CONDEMNATION
IN THE SUPERIOR COURT IN AND FOR THE COUNTY OF
KING AND THE PROSECUTION THEREOF FOR THE ACQUISITION
OF SUCH PROPERTIES FOR PARK, PLAYGROUND AND MARINE
RECREATIONAL AND LIKE PURPOSES .
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE
CITY OF RENTON, WASHINGTON, AS FOLLOWS :
SECTION I : It is hereby acknowledged that the City ,
acting by and through its Park Department, has heretofore completed
the initial phase of improving the City' s so-called Lake Washington
Beach Park together with improvements located thereon , which said
Park is located immediately to the south of the herein described
property.
It is hereby reaffirmed and acknowledged that the
acquisition of the following described properties is part of the
City' s Comprehensive Plan and design for the construction and
development of additional recreational facilities including parks , �
playgrounds , beach and similar purposes and facilit.ies .
SECTION II : It is hereby determined that the acquisition
of the following described properties is for a public purpose and
use including park, playground, beach and related recreational
facilities and purposes incidental thereto, and all of such lands
being located within the corporate limits of the City of Renton,
same being described as follows , to-wit:
PARCEL I (Dillingham Corporation)
A, Lots 10 to 22 , inclusive , Block 360 , C. D.
Hillman' s Lake Washington Garden of Eden,
Division No. 5 , according to the plat recorded
in Volume 11 of plats , page 83 , in King County ,
Washington; and adjoining second class shore-
lands according to Commissioner' s map approved
and on file in King County Superior Court
Cause No. 156371 ; except that portion thereof
lying northerly of the following described line :
Beginning at the intersection of the South line
of Lot 4 in B1Qck 361 of said plat with the
westerly boundary of northern Pacific Railway
right of way; thence North 76°11' 06" West a
distance of 42 . 65 feet to the true point of
beginning of the line herein described;

more or less , to a point on the South Boundary

Eden Division No. 5 , according to the plat
recorded in Volume 11 of plats , page 83 in
Kirg County, Washington; and adjoining second
class shore lands , according to Commissioner' s
map approved and on file in King County
Superior Court Cause No. 156371 , described as I
follows :
Beginning at the intersection of the South
line of Lot 4 in said Black 361 with the
Westerly bourr�.ry of Northern Pacific Railway ,
right of way; therice North 76°11 ' 06" West
along said southerly line 42 . 65- feet; therice
North 20°43 ' 26" West 115 . 2 feet, more or
less , to the notherly end of a strip conveyed
to Pacific Coast Railroad Company by Deed
recorded under Auditor' s File No. 4691996 ,
and the point of beginning; thence North

northerly line of said Block 361 ; thence
along said northerly line north 81°07 ' 16"
West to the inner harbor line of Lake Wash-
ington; thence along said line and its
projection south 19°45 ' 00" East 1030 feet ,
more or less , to a point on the southerly
line of said lot 32 ; thence south 58°13 ' 5g"
east 120 feet , more or less , to a point
which bears south 70° 38 ' 12" west from the
most southerly corner of a 17 foot strip
conveyed to Pacific Coast Railroad Co. by
Deed recorded under Auditor' s file No. 4691995 ;

said southerly corner; ,thence north 20°43 ' 26"
west along the west�rly line of said strip

curve in said westerly line ; thence along
a curve to the right which is concentric

railroad curve , along the westerly line of

PARCEL II (Pacific Coast Railroad Company)
A. All that portion of Lots 2 , 3 , and 4 , Block 361,
C. D. Hillman` s Lake Washington G�en of Eden
Division No. 5 , according to the plat recorded
in Volume 11 of plats , page 83 in King County,
Washington; and adjoining second class shorelands ,
according to the Commissioner' s map approved and
on file in King County Superior Court Cause No.
156371 lying within the following described

Beginning at a point on the s.outherly boundary
of said lot 4 , from which the intersection of
the southerly boundary of said Lot 4 and the
westerly boundary line of the No.rthern Pacific
Railway right of way bears south 76°11 ' 06"

King County Superior Court Cause No. 156371 ,
which map and the several metes and bounds des-
cription for said parcel were approved by decree
entered October 19 , 1923 in said case No. 156371 ,
the proper metes and bounds description of said
parcel of 2nd class shorelands , based on said
court decree , being as follows :
Beginning at a point on the westerly boundary
line of the north�rn Pacific Railway "Belt Line"
right of way as located and established by
said Court Decree_, said point bearing south

according to the Commissioner' s map approved and
on file in King County Superior Court Cause No.
156371, and described as follows :
Beginning at the interse -ction of the southerly

with the westerly boundary line of the Northern
Pacific Railway right of way; therice north

lying within the following described boundaries :

with the westerly boundary line of said
Northern Pacific Railway right of way; thence
south 19°21'48" east 55 feet along the westerly
boundary of said right of way; therice south

west 839 . 00 feet, more or less , to a point on
the north boundary of said Lot 5 ; thence south
76°11' 06" east along the north boundary of
Lot 5 a distance of 42 . 65 feet , more or less ,
to the westerly boundary of the Northern
Pacific Railway right of way; thence south
19°21' 48" east along the westerly boundary
of the Northern Pacific Railway right of way

beginning.
and further that the City is authorized by the laws and statutes
of the State of Washington to condemn and damage lands and other
property rights and privileges within and without its corporate
limits necessary for the above stated purposes .
SECTION III : The City Attorney is hereby authorized and
directed to commence condemnation proceedings against the owners or
reputed owri�er:s of the above described lands and improverrients as
provided by law, to prepare the necessary petition in condemnation
and to commence and prosecute such action in the Superior Court in
and for the County of King against all of the owners or reputed
owners of the hereinabove described property and to acquire title thereof
for the City of Renton, and such proceedings to ascertain the just
compensation for the taking or damaging such properties .
SECTION 'IV: Comperisation for the acquisition of said lands ,
R shall be made from the gerieral fund of the City, together with such other II
funds and grants as may be available therefor. I,

SECTION V : Nothing in �h'is drdinance shall be con�trued
as a waiver by the �ity of Reritan of its right to decline to take '
and pay for said land and ��prapert�i.es�� after the amount of damages
has been ascertained and withzn the time allowed by law.
SECTT"ON VI : Th'is Ordinance sha1l -�ake effect and be in
farce from and after its passage , approval and publication as
provided by law. I
