ORDTNANCE NO.����.� AN ORDINANCE OF THE CTTY OF RENTON, WASHINGTON AUTHORIZING THE ACQUTSITION OF CERTAIN PROPERTY RIGHTS BY EMINENT DOMAIN; PROVIDING FOR THE PAYMENT THEREOF; AUTHORTZING THE CITY ATTORNEY TO PREPARE A PETITION FOR CONDEMNATION IN THE SUPERIOR COURT IN AND FOR THE COUNTY OF KING AND THE PROSECUTION THEREOF FOR THE ACQUISITION OF SUCH PROPERTY RIGHTS FOR THE IMPROVEMENT OF EDMONDS AVENUE N. E. IN RENTON, WASHTNGTON. BE IT ORDAINED BY THE MAYOR AND THE CTTY COUNCIL OF THE CITY OF RENTON, �idASHINGTON, AS FOLLO�nTS: SECTION I: It is acknowledged that the acquisition of the following described property rights is part of the City' s Plan and design for the improvement of its city streets . SECTION II: It is hereby determined that tI�e acqui.sition of the following described property rights is necessary and for a public purpose and use - the improvement of Edmonds Avenue N. E . , and that such property is located within the corporate limits of the City of Renton, the same being described as follows, to-wit: PARCEL I CERNEST) A permanent easement in, over, and upon the westerly ten C10) feet of the following described Parcel "A" : The Southwest Quarter of the Northwest Quarter of the Northwest Quarter of the Northwest Quarter of Section 9 , Township 23 North, Range 5 East, W.M. , in King County, Washington, except the South 75 feet thereof and except the �nTest 30 feet for County Road. CThe record owners of said Parcel "A" are LAWRENCE J. ERNEST and ELSIE M. ERNEST, his wife. ) ; and it is further acknowledged that the City is authorized by the laws and statutes of the State of Washington to condemn and damage lands and other property rights and privileges within its corporate limits necessary for the abovestated purposes . SECTION III: The City Attorney is hereby authorized and directed to commence condemnation proceedings against the owners and all other parties in interest in the abovedescribed lands and improvements as provided by law, to prepare the necessary petition in condemnation and comm�nce and prosecute such action in the - 1 - . � � ' � f t . � li �, . .r1, � ^ r Superior Court in and for the County of King against all of the owners and interested parties in the hereinabove described property, and to acquire property rights therein for the City of Renton; and such proceedings shall be to ascertain the just compensation for the taking of such property rights and/or the damaging, if any, of such property caused by the City� s acquisition of such property rights . SECTION IV: Compensation for the acquisition of said property rights shall be made from the Urban Arterial Trust Fund of the State of Washington, Forward Thrust Fund, and/or from such other funds of the City of Renton as 7nay be avai,lable therefor. � SECTION V: Nothing in this Ordinance shall be construed as a waiver by the City of Renton of its right to decline to take and pay for said property rights after the amount of compensation has been ascertained, and within the time allowed by la�.
