RESOLUTION NO. / '>
WHEREAS the City of Renton heretofore entered into a certain Agreement dated
August 20, 1963 with PUGET PROPERTIES, INC., a Washington corporation, and which Agrecr-';
was thereafter duly amended, and further reference being had hereto, and said Agreeme''-,
as amended, proving among others, for the construction and installation of a certain
],;8 inch major sewer trunk line, approximately 1,335 feet long, together with additional
appurtenances and improvements and all such work to be done at the expense of PUGET
R'ROPERTIES, INC., and
WHEREAS the City of Renton, by and through its City Engineer, has now accepted
said work and construction as in compliance with the plans and specifications heretofore
approved, and
WHEREAS PL3ET PROPERTIES, INC. is willing to sell unto the City of Renton a
qertain right-of-way for said major sewer trunk system and same to be made part of the
4ity's sewer system, and
WHEREAS the City is willing to purchase said right-of-way as hereinbelow set
forth, and
WHEREAS it has been duly established that the reasonable fair market value of
gaid right-of-way is not less then $10,000.00 and the acquisition thereof be in the
public interest and for the public benefit and in furtherance of proper sanitation and
disposal, NOW THEREFORE
BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE CITY OF RENTON AS
FOLLOWS:
SECTION I: The aforedescribed findings and recitals are hereby found to be
true and correct in all respects.

SECTION I: The City Clerk and the City Treasurer are hereby authorized and
d .rected to pay the sum of $10,000.00 out of the following named account, to-wit:
?IVIYIN0RKS UTILITY FUND, 7120, Capital Outlay Acct, 605
upto PUGET PROPERTIES, INC., a Washington corporation, in consideration for the
afquisition of a certain right-of-way as evidenced by the attached Easement and Quit .1 1L 14j
Deed which are incorporated herein and made a part hereof as if fully set forth, which
said Easement pertains to such major sewer trunk and lateral lines as described, and

which said payment shall be full and final payment to said PUGET PROPERTIES, INC. fc_
said conveyance of right-of-way.

EAS SMENT
THIS INDENTURE, made this 13th day• of September , �9 65 ,
between RENTON VILLAGE COMPANY, herein called GRANTOR, and CITY OF RENTON, herein
called GRANTEE,
bl` WITNESSETH:
That in consideration of the sum of ten thousand dollars, ($1.0,000.00)
in hand paid, receipt of which is hereby acknowledged, and the performance by
Grantee of the covenants hereinafter set forth, Grantor hereby grants unto
Grantee, a right of way not exceeding 5 feet in width on each side of the
center line hereinafter described, for the maintenance, operation, repair and
replacement of the following described service facility:
SANITARY SEWER TRUNK AND LATERAL LINES
within and across and following described land situated in the County of King,
State of Washington to wit:
That portion of the Northeast u of Section 19, Twp. 23N., R5E., W.M.,
described as follows:
Beginning at a point on the southerly margin of S.S.H. No. 1-L
(Grady Way in the City of Renton) said point being 232.50 feet West of
the East line of the Northwest of said Northeast 4, as measured
perpendicular; thence Southerly, along the line 232.50 feet from (as
measured perpendicular) and parallel to said East line of the Northwest
u of the Northeast *, a distance of 147.57 feet; thence N88°55' 52" W
a distance of 175.33 feet; thence N01°08'50" E a distance of 5.00 feet to
the true point of beginning; thence SO1°08'50" W a distance of 6J5.07 feet;
thence S54°15'52" W a distance of 163.50 feet; thence N88° 55'52" W a
distance of 109.30 feet to a point hereinafter described as "Point A";
thence continuing N88°55'52" N a distance of 303.00 feet to a point
hereinafter described as "Point B"; thence N4+2°32' 37" W a distance of
478.10 feet; thence S89°25713" W a distance of 158.30 feet; thence
N81°01.'23" W a distance of 405 feet more or less to a point on the
Easterly margin of PSH No. 5 (East Valley Highway) said point being the
terminus of this easement.
EXCEPT ROADS
Also, beginning at the heretofore described "Point A", said point
being the true point of beginning, thence S30°20'52" E a distance of
378 feet more or less to a point on the Northerly margin of PSII No. 1

Also, beginning at the heretofore described "Point B", said point
being the true point of beginning, thence N 156e•3171+7" W, a distance
of 275.00 feet to the terminus of this easement.
This easement is granted on the following terms and conditions:
1. Grantee agrees to save and hold Grantor harmless from all loss
or damage which may be due to the exercise by Grantee of the right herein
ti
granted and from all claims for such damage by whomsoever made and to

indemnify Grantor for all such loss, damage and claims.
2. Grantor reserves the right to use said land for their own
purposes in any way, and to grant rights in or on said land to others, not
inconsistent with the right herein granted to Grantee.
3. The right hereby granted shall cease and determine whenever
Grantee shall have permanently abandoned the use of said facility and upon
such abandonment Grantee shrill. f i.]1 its fac i.]ity to meet sanitary requirements
and restore the premises to as good a condition as they were in prior to the
construction of said facility.
4. If the Grantee, it successors or assigns makes an excavation in
the Grantor's property, it shall without delay restore the surface as nearly
as practicable to the same condition as it was in before the doing of such work.
5. The location of said right of way is shown on map dated March 23, 1965,
prepared by Douglas E. Weeks, copy of which is attached hereto and by this
reference made a part hereof.
IN WITNESS WHEREOF, this instrument has been executed by the parties
hereto as of the day and year first above written.
