ORDINANCE N0. 4079
AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
AMENDING PORTIONS OF CHAPTER 2, TITLE III
(DEPARTMENTS ) OF ORDINANCE N0. 1628 ENTITLED "CODE
OF GENERAL ORDINANCES OF THE CITY OF RENTON"
RELATING TO EMERGENCY USE OF WATER, DESIGNATION OF
HOURS FOR LAWN SPRIN�LING, WATER CONSERVATI0IV, AND
RELATED MATTERS; ESTABLISHING CIVIL PENALTIES FOR
VIOLATIONS, AND ESTASLISHIN� A METHOD OF
FURECLOSURE OF THS CIVIL PENALTY
THE CITY COUNCIL OF THE CITY OF RENTON, G�IASHINGTON, DOES
ORDAIN AS FOLLOWS :
SECTTON I: Existing Section 3-216 of Chapter 2 , Title III
(Departments) af Ordin�ncP No. 1528 entitled "Code of General
Ordinances af the City of F:enton" is hereby am�nded to read as follows :
Section 3-215, as amen�ed : Emergency Use of Wat2r : The
Council shall pstablish �olicies implPmented by the Public Works
Director to arrange, re�luce or limit the time for irrigation and
sprinkling in cases of emergency, ar whenever the public �afety or
h�alth or the ne�d for conservation of water so requires. Whenever
there is, in the opinion of the Public Works Director , an insuff_iciency
of water supply, the Public Works Director shall notify the Mayor and
Council and take action n�c�ssary to reduce watez system demand to a
level that can be safely met with the water supply available. �ny such
a�tion by the Public Works Director must be in accardance with the City
Water Cons�rvation Plan, which must be approved by the Council and,
within the operational constraints of the water system, must �ffect the
same degree of water conservation from customers both insirle and
outside the City limits in a non-discriminatory manner . The Public
Works Department may modify the �Vater Conservation P1an as necessary tc�
upd�te the data and administrative information, but any change in
nolicy must be approved by the City Council .
SECTION II : Existing Section 3-219 af Chapter 2 , Title III
(Departments) �f Ordinance No. 1628 entitled "Code of General
Ordinances of the City of Renton" is hereby amended to read as follows :
Section 3-219 , as amended : Designation of Hours.
A. Restrictions: The Public Works Director , in case of a
shortage of water supply from any cause, may mak� �n order forbiclding
or suspending the use of water for sprinkling or irrigation, or may
direct customers that s�rinkling or irrigation may only be done during
certain hours or on cert�in days by giving notice through the
anpropriate media.

B. Civil P2nalty: Any person viol�ting the order described
in the prior subsection sh�all be subject to a �i.ne as �let�rmined by the
Public Works Director in an amount not exceeding Five Hundred Dollars
( $500 . 00 ) for residential customers, and not exceeding Five Thous3n�7
Dollars ($5, 000. 00 ) for all other customer classes. Written notice of
the violation and the imposition of the civil penalty, together with a
notice of the right of an appeal from the determination a.f the Public
Works Director , shall be deliv�rec� to the violator �and/or the customer
by personal service, or by first class mail addr�ssed to the billing
address of the customer. In determining the amount of the penalty, the
Public Works Director shall takP into cansideration all of the facts
and circumstances, including , but not limited to the following :
(1 ) Whether it is a first or subsequent offens�;
(2 ) The extent and nature of the violation;
(3 ) Whether there was any loss of property or life which was
caused or contributed to by the violation;
(4 ) The cost to the City in discovery of the violation and
the processing of the violation; and
(5 ) Th� likelihood of a further or later violation if no
significant penalty is imposed.
C. Foreclosure: �uch civil penalty shall be a lien against
the real estate if the real estate at the loc�tion of the violation is
owned by the violator , or the violator is the agent, employee, officer
or director of the real property owner. Such lien may be foreclosed in
the same manner as materialman' s liens under State law. In all
instances the civil p�nalty shall also be enforceable as � fine against
the person violating the restrictions on water usage.
D. Water 8hut-Off: In addition to the foregoing civil
penalty, in the ev�nt of a violation of the restrictions impQsed by
this Section, the watsr service to the violating us�r may be shut off
after re�sonable notice to the us�r �nd not turned on again until such
penalty has been paid . "Reasonable notice°' for the purpose of this
subsection shall mean not less than ten (10 ) days notice delivered k�y
first class mail to the billing address of the user , unless th2 Public
Works Director shall have determined that the violation is �
substantial and imminent dang�r t� the existing water supply. In such
event, "reasonable notice" shall consist of the best, practical notice,
if any, which can be delivered to the offending user under all of the
circuznstances.
E. Appeal : Any person or legal entity aggrieved by the
civil penalty or its amount, or the nroposed shut-off of water service,
may appeal the propriety og the penalty or its amount, or the proposed
shut-off of water service, to the City of Renton Finance Director
within ten (10 ) days of the date o� the determination by the Public
Works Director . The consideration of the Finance Director on tne
appeal shall be limited to a d�termination of the existenc� of the

all�ged violation, the amount af t�e civil penalty ass2ssed , if any,
and/or the `�et�rmination, if any, to shut-off wat�r s�rvicP. The
decision of the Finance Director shall be final unless a writ of review
is obtained from the King County Superior Court within twenty ( 20 ) days
after the date of the Finance Director ' s decision.
SECTION III: Existing Section 3-210 of Chapter 2, Title III
(Departments) of Ordinance No. 1628 entitled "Code of General
Ordinances of the City of Renton°' is hereby amended to read �s follows :
Section 3-210, �s amended: Discontinued Use Charge :
Whenever the owner or occupant of any premises desires to discontinue
the use of water for a period of not less than one month he shall make
written application to have th� water turned of� and pay all arreara�es
in full . The water will be turned off and turned on again with a
charge of Twenty Dollars ($20. 00 ) payable at the time of turnoff, but
no remission of rates will be made for a period of less than one month
or without the application prescribed in this section.
SECTION IV: Existing Section 3-21$ of Chapter 2 , Title III
(Departments) �f Ordinance �10. 1628 entitled "Code af �eneral
Or�linances oF the City of Renton" is hereby amended to read a� follows :
Section 3-218 , as �mended : Violation Charge : If any person
shall violate any provision of Section 3-217 , the Public Works Directflr
shall, after reasonable notice to the �zser , shut of� the water
furnished to the premises upon which such violation is made, �nd shall
charge Twenty Dollars ($20 . 00 ) for shutting of� and turning on such
water. "Reasonable notice" for tne purpose of this subsection shall
have the meaning set forth in Section 3-219 (D) . The d�tPrmination to
shut off water service pursuant to this Section shall be appealable to
the City of Renton Finance Director pursuant ta S�ction 3-219 (E ) .
SECTION V: Existing Section 3-226 of Chapter 2, Tit1P III
(Departments) of Ordinance No. 1628 entitled "Code of General
Ordinances of the City of Renton" is hereby amended to r�ad �s follows :
Section 3-226, as amended : Public Works Director to
Discontinue Service in Cas� of Violation: If any owner or occupant of
any premises supplied with city water shall violate any provision of
the preceding section, the Public Works Dirctor may, after reasonable
notice to the user, shut off such servic�; and such owner or occupant
shall be required to pay any or all delinquent and unpaid charges
against such premises togeth�r with a charge �f Twenty Dollars ( $20. 00 )
for shutting off an� turning on such water before the s�me shall be
ag�in turned on. "Reasonable notice" for the purpose of this
subsection shall have the aneaning set forth in Section 3-219 (D) . The
determination to shut �ff water service pursuant to this Section sha11
be appeaZable to the City of Renton Finance Dir�ctor �ursuant to
Section 3-219 (E) .

1.0 CURRENT IiATER SYSTEM SUPPLY CAPACITY
�
1.1 PRIMARY SUPPLY SOURCES
� The City of Renton currently utilizes five wells and one artesian spring as
its primary means of supply to the Water System. All of the primary supply
enters the City' s System through the Downt own 196 Pressure Zone where it is
either pumped to the upper pressure zones or stored in the Mount Olivet or
" Talbot Hill Reservoirs. All of the City' s active wells are located in
close proximity to each other. Well Nos. 1 , 2 , and 3 are located in
Liberty Park and Well Nos. 8 and 9 are located in Cedar River Park. The
�. total combined production rate of these five wells is 11,300 GPM.
Spri ngbrook Spri ngs i s an artesi an spri ng 1 ocated four mi 1 es south of the
� downtown area. The Spring provides supply direction to the Downtown 196
Pressure Zone by way of a 16-inch diameter transmission main 1 aated on
Talbot Road South. The Spring' s production rate varies seasonally but
has an approximate capacity of 700 GPM.

The total canbined production rate of the City' s primary supply sources is
12,000 GPM. A summary of the production supply sources is provided in

1.2 INTERTIE SOURCES

The City has seven interties with Seattle' s Cedar River Supply Pipeline in
addition to two interties with the Cities of Kent and Tukwila. In
�„ addition, interties with King County Water Dist rict Nos. 90 and 107 can be
formed by connecting adjacent fire hydrants. All of the interties are on
standby status and only used during emergencies when additional supply is
needed. A summary of each of the City' s standby supply sources is provided
"` in Table 2.

Two af the Seattle interties can provide supply ta the Scenic Hi31 �90
�„ Pressure Zone. Two other Seatt3e interties can provide supply to the
Rotling Hills 59Q Pressure Zo�e through the Tiffany Park and Fred Nelson
Pump Station. The three remaining Seattle interties can provide supply to
the West Hill 495, the Talbot Hill 35Q. and the powntown 196 Qressure Zones
'�' (near Longacres) . The supply fran these pres5ure zones can be distributed
throughout the remaining pressure zones by pressure reducing stations and
booster pump stations.

The emergency interties with the Cities af Kent and Tukwiia couid provide
supply ta the DoMrntown 196 Fressure Zone. Distribution fran there to the
,,,� higher pressure zor�es would be through the booster pump facil ities, An
intertie with Water Districts 9Q and 107 can be reactivated on short notice
through adjacent fire hydrants, if necessary, to provide backup supply to
the Highlands Area. These two interties would serve the Highlands 565 and
'"" Kennydale 320 Pressure Zones, respectively.

3.0 RESPOiiSE PLAN
�
The Response Plan is divided into six stages. The water conservation
,,, measures and water system responses are autl �ned for each stage.
�etermination of which stage to implement is based on the actual or
perceived water shortage. The water shortage is determined by the
difference between the daily production capability and the daily system
'"" dema nd.
++� 3.I STAGE l: LOSS OF SElM1E SUPPLY CAPACITY
Stage 1 af the Water Conservation Plan is implemented when:
�.
- One ar more of the City' s primary supply sources are out of
service and are unable to provide supply to the System.
'� - System demand is met by the City' s remaining primary ar
standt�y supply saurces, and therefore, no shortage exists.
�
RESPONSE:
,,,� A. Water Utility. Na conservation is necessary at this stage. The
Water Utility staff shall determine extent of the problem and take
the necessary steps to bring ali supply saurces back into service
with no unreasanabie delays.

B. Customer Conservati an. Na conservati on acti on by custaners i s
required at this stage.

C. Notification, Public notification of the problem is not necessary
at this stage. The Public Works Qirector shall natify the Mayor

� 3.2 STAGE 2: MINOR MATER SHORTA6E �
Stage 2 of the Water Conservation Plan is implemented when the expected or
"' projected water shortage fran primary supply sources is less than 1,500 gpm
(2.2 MGD) .

RESPONSE:
�,,, A. Water Utility. The Water Utility staff shall cease all flushing
and flow testing of pipes and instruct the Parks Department to
reduce lawn and shrub watering in City parks by 50 percent.
�" B. Customer Conservati on. No conservati on acti on by the custaner is
required at this stage.
�.. C. Notification. Public notification of the shortage is not necesary
at this stage. The Public Works Director shall notify the Mayor
and Council of the situation.

3.3 STAGE 3: MODERATE WATER SHORTAGE
� Stage 3 of the Water Conservation Plan is implemented when the expected or
�"' project water shortage from primary supply sources is between 1,500 and
3,500 gpm (2.2 and 5.0 MGD) .
..r RESPONSE:
A. Water Utility. The Water Utility staff shall cease all flushing
and flow testing of pipes , instruct the Parks Department to
�" eliminate watering of City parks and all public greenbelts ,
request Boeing, Paccar,and Longacres to obtain their water
suppl ies from the City of Seattle and, if necessary, convert the
� West Hill and Scenic Hill areas to Seattle supply.
B. Customer Conservation. Customers shall be asked for voluntary
..,, reductions in outdoor water uses such as lawn watering and car
washi ng . At thi s stage, vol untary acti ons wi 11 only be asked of
customers and no citations will be issued.
�" C. Notification. Public information efforts would be necessary at
this stage. The public notification emphasis shall be on
conserving water by informing the public on the water supply
� problem. Water conservation literature will be made available to
the public. The Public Works Director shall notify the Mayor and
Council of the situation.

3.4 STAGE 4: SEVERE WATER SHORTAGE
Stage 4 of the Water Conservation Plan is implemented when the expected or
"' projected water shortage from primary supply sources is between 3,500 and
6,000 gpm (5.0 and 8.6 MGD) .
�+ RESPONSE:
A. Water Utility The Water Utility shall take all measures to reduce
„�, water consumption and use and obtain additional water supplies.
These measures include:
�
- Forego all flushing and flow testing of pipes;
- mandatory restriction of water use in all City parks and
public greenbelts;
�
- mandatory restriction of outdoor water use for all classes of
customers;
�` - mandatory restriction, both indoor and outdoor, on the use of
decorative fountains and water displays;
"' - instruction to Roeing, Longacres and Paccar. Inc. to obtain
their water supplies from the City of Seattle;
„�, - converting the West Hill , Scenic Hill , Rolling Hills, and
Talbot Hill areas to Seattle supply (four supply stations);
■.
- activate the Tiffany Park and Fred Nelson Pump Stations;
- if necessary, and if possible. activate Kent, Tukwila, and
Seattle (Longacres) Interties;
..
- coordinate with law enforcement officials on enforcing
manditory water restriction; and
� - coordinate all resources toward resolving the water shortage.
B. Customer Conservation. Mandatory restriction on all outdoor water
"` use shall be imposed for all customer classes. Violators shall be
i ssued citati ons i n accordance with the Amended Secti on 3-219 of
Chapter, Title III of Ordinance No. 1628. In addi.tion, both
�• residential and commercial customer classes shall be asked for a
voluntary reduction in indoor water use.
„� C. Notification. An aggressive public notification campaign will be
necessary to inform the customer of the water supply situation and
the mandatory water restriction measures. The notification shall
include both the mass media and water conservation literature will
"' be made available to all customers. The Public Works �irector
shall notify the May or and Council of the situation.

3.5 STAGE 5: CRITICAL WATER SHORTAGE
Stage 5 of the Water Conservation Plan is implemented when the expected or
""' projected water shortage from primary sources is between 6,000 and 12,000
gpm (8.6 and 17.3 MGD) .
•• RESPONSE:
A. Water Utility The Water Utility shall impose water rationing to
,� all customers and obtain water, if possible, from other
surrounding water purveyors. These measures include:
,�.
- All measures outlined in Stage 4;
- activating the Kent, Tukwila, and Seattle (Longacres)
interties;
�
- installing interties between Water Districts 90 and 107;
- shutting off service to all public restrooms, public swimming
� pools , and non-essential public facilities;
- establishing customer categories for water allocations; and
�.
- reducing system pressures in the entire system as a result of
a lack of available water in storage reservoirs.
�
B. Customer Conservation. Most customers' supply will be rationed at
this stage. Customer class will be established and maximum water
..
allocations for each class will be set up.
C. N otification. Public notification of the water shortage will be
essential and the seriousness of the situation should also be
� reflected in the public information efforts.
The public notification shall include both mass media and
� newsletter. The notification shall 'inform customers of their
customer class, rationed water consumption, enforcement measures,
and effective means of reducing water.

the situation.

3.6 STAGE 6: CRITICAL ItATER SH4RTAGE AND STANDl3Y S4URCE FAILURE
.. Stac�e 6 of the Water Conservation Plan is implemented when the expected ar
projected water shortage from primary sources is between 6,000 and 12,000
gpm ($.6 and 17.3 MGD) and there has been a complete failure of all standby
�
sources.
RESPONSE:
+� A. Water ilti1ity The Water Utility shall impose mandatary maximum
water rationing ta all customers and obtain water, ifi possible,
fram other surrounding water purveyors to the extent possible.

- all measures autlined in Stages 4 and 5;

4.0 NOTIFI(:ATION
+�r Notification involves the City Council , Mayor, customers, and the media.
This section presents the basic elements involved in the notification
process.

4.1 CITY COUNCIL NOTIFICATION
�' The City Council and the Mayor must be notified if any of the six
conservation response stages are implemented. Notification by telephone is
adequate to provide immediate information about the shortage. However, a
„�. formal notification by memorandum is required. The information in the
notification shall include:

- nature and extent of the water shortage;
- identification of the stage of response;
+r - proposed or initiated conservation measures;
- corrective measures being taken; and

- expected duration of the water shortage.

4.2.1. Notification Mediums
�. Mass Media. This primarily involves the television and radio
broadcasti ng stati ons and newspapers. Thi s i s an effective method of
distributing information to the customers about a water shortage and
the necessary conservation measures which must be taken. However, the
" Water Department has little control over the final content of the
information or how and when it is broadcast. Examples of mass media
whi ch can be used are 1 ocal news broadcasts and tal k shows at
� television and radio broadcasting stations, featured articles in local
newspapers, public service announcements, and paid advertisements. A

The Public Works Director has the authority under current City Ordinances
to issue notices, disc onnect wate r service and issue citations to customers
�.. found to be in violation of any water restriction. Therefore, the primary
responsibility for enforcement of water restrictions should be with the
Public Works Director. He shall have the complete assistance of the Public
� Works Field Superintendent and his field crews for locating customers
violating water restrictions.
" The secondary responsi bi 1 ity for enforcement of water restricti ons should
be (1) the fire department, and (2) the police department. The Public
Works Director shall request the assistance of the fire and police departments.

"" vB. Civi1 Penalty; Any person violating the order described in the prior
subsection shatl be subject to a fine as determined by the Public Works
Director in an amount not exceeding Five Nundred Dollars ($500.00) for
.. residential customers, and not exceeding Five Thousand Do3lars
($5,QOQ.OQ) for all other customer classes. Written notice of the
violation and the imposition of the civil penalty, together witk� a

� C. Foreclosure: Such civil penalty shall be a lien against the real
estate if the real estate at the location of the violation is owned by
the vi olator, or the violator is the agent , empl oyee , officer or
r, di rector of the real property owner. Such 1 ien may be forecl osed in
the same manner as materialman' s liens under State law. In all
instances the civil penalty shall also be enforceable as a fine against
�
the person violating the prior subsection.
D. Water Shut-off: In addition to the foregoing civil penalty, in the
event of a violation of the restrictions imposed by this Section, the
+� water service to the vi ol ati ng user may be shut off after reasonable
notice t o the user and not turned on again until such penalty has been
paid. "Reasonable notice" for the purpose of this subsection shall
�,,, mean not less than ten (10) days notice delivered by first class mail
to the billing address of the user, unless the Public Works Director
shal�l have determined that the violation is a substantial and imminent
danger to the existing water supply. In such event , " reasonable
"�` notice" shall consist of the best , practical notice, if any, which can
be delivered to the offending user under all of the circumstances.
�r• E. Appeal : Any person or legal entity aggrieved by the civil penalty or
its amount, or the proposed shut-off of water service, may appeal the
propriety of the penalty or its amount, or the proposed shut-off of
,,� water service, to the City of Renton Finance Director within ten (10)
days of the date of the determination by the Public Works Director.
The consideration of the Finance Director on the appeal shall be
1 imited to a determi nati on of the exi stence of the al 1 eged vi ol ati on,
"�" the amount of the civil penalty assessed, if any, and/or the determina-
tion , if any, to shut-off water service. The decision of the Finance
Di rector shall be final unless a writ of review is obtained fran the
� King County Superior Court within twenty (20) days after the date of
the Finance Director' s decision.
�
Section 3-218, as amended: Violation Charge
�' If any person shall violate any provision of Section 3-217, the Public
Works Director shall , after reasonable notice to the user, shut off the
water furnished to the premises upon which such violation is made, and
,�. shall charge Twenty Dollars ($20.00) for shutting off and turning on
such water. "Reasonable notice" for the purpose of this subsection
shall have the meaning set forth in Section 3-219 (d) . The determina-
tion to shut off water service pursuant to this Section shall be
`� appealable to the City of Renton Finance Director pursuant to Section
3-219 (E) .
