ORDINANCE N0. 3224
AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
AUTHORIZING THE ACQUISITION OF CERTAIN REAL PROPERTY
AND REAL PROPERTY RIGHTS BY EMINENT DOMAIN, PROVIDING
� FOR THE PAYMENT THEREOF; AUTHORIZING THE CITY ATTORNEY
TO PREPARE A PETITION FOR CONDEMNATION IN THE SUPERIOR
COURT IN APdD FOR THE COUNTY OF KING AND THE PROSECUTION
THEREOF FOR THE ACQI]6ITION OF SUCH PROPERTY AND PROPERTY
RIGHTS FOR CONSTRUCTION AND IP�Il'ROVEM�NT OF LIND AVENUE
BETGTEEN S . W. 16TH STREET AND S .W. 43RD STREET IN
RENTON, WASHINGTON.

THE CITY COUNCIL OF THE CITY OF REIJTON, WASHINGTON, DO ORDAIN
AS FOLLOWS :
SECTION I: It is acknowledged that the acquisition of the
following described real property is part of the City' s Plan and
design for the improvement of its city streets , and is within the '
limits of L.I .D. No . 302 formed for street improvement purposes by
Ordinance No . 3138, passed May 16 , 1977 .. �
SECTION II: It is hereby determined that the acquisition
of the following described real property and real property ri���t is
necessary and for a public purpose and use - the con�tructio_� �i;�d
improvement of Lind Avenue between S ,W. 16th Street and S .jd. 43rd
St. , as specifically set forth in said Ordinanee No . 3138; and that
such real property is located within the corporate limits of the
City of Renton, the same being described as follows , to-wit :
- The east 40 feet of the North 1/2 of the
Southwest 1/4 of the Southwest 1/4 of Section 19
Township 23 N. , Range 5 E. , W.M. , tog�ther with a
temporary construction easement within the Westerly
� 20 feet of the Easterly 60 feet of the North 1/2
of Southwest 1/4 ,of the. Southwest 1/4 of Section
19, Township 23 N. , Ra.nge 5 E . , W.M. , all situate
in King County, State of Washington.
(The ostensible owners of the aforedescribed real property
are Mildred M. Su�nmers , formerly Mildred M. Kerpick, and
BEMP Associates - Patrick T. Easter, Rosemary Easter,
Jack K. McCann, Mary McCann, Delbert C. Bennett, Bette
Bennett and Marcus K. Partin), . � _ ,

It is further acknowledged that the .City ,is �authorized by ,the laws
and statutes of the State of Washington torcondemn and damage lands

�I within its corporate limits necessary for the abovestated purposes .

SECTION III : The City Attorney is hereby authorized and
directed to commence condemnation proceedings against the owners
and all other parties in interest in the abovedescribed land as
provided by law; to prepare �Che necessary petition in condemnation a�d
commence and• prosecute such action in the Superior Court in and for
the County of King against all of the owners and interested parties
in the hereinabove described property, and to acquire the 'afore-

described property and property rights for. the City of Renton; and
such proceedings shall be to ascertain the just compensation .for the
taking of such property and property ri�h�s and/or the damaging, if-
any, of such property caused by the City's acquisition 'of such �
property and property rights . , " .
SECTION IV: Compensation for the acquisition of said property
and property rights shall be made from assessments on properties within
the limits of L .I.D. No . 302, and/or from such other funds of the
City of Renton as may b e available therefor.
` SECTION V: Nothing in this Ordinance shall be construed as a
waiver by the City of Renton of its rights to decline to take and .
pay for said property and property rights after the amount of
compensation has been ascertained, and within the time allowed by law.
SECTION VI : This Ordinance shall be effective upon its
passage, approval and five days af ter its p ublication.
