RE: � & H GARDEN PLAZ� REZONE R-�16-$7 The Hearing Examiner , �y report and r�comm�ndatian dat�d August 18, 1987, rec�mmendPd that the City Council delay �ction on this rezoning requ4st pending the outcome o� the tlorth Renton tra�fic study. Th� first phase of th�t traf�ic study, which addresses the �irect impacts of th� proposed action, has now been r�ceived. The City Council took public testimony on this item on four s�parate occasians, the First three instances bein� part of regular City Council meetings, and th2 last instance, on November 5 , 1987, being a special City Cauncil meeting to continue the public �earing on this rezone. The Planning and Developm�nt Committee has subsequ�ntly held its meeting on November 12 , 1987. The City Council at its special meeting on November 5, 1987 , arrived at � consensus to approve the rezone, makin� a findin� that the traffic impacts caused by the rezane and subsequ�nt construction could be mitigated, �ondikioning th� rezone on passage o� � binding site plan under site plan applic�tion SA- 017-87 and requiring restrictiv� time lines be established for application for a building permit �nd the beginning o� construction. The entire matter was th�n forwarded to the Planning and Development Committ�e to draft the conditins o:E approval of the rezone. The P�anning and D�velopment CommittQe recommen��d c�rtain traffic mitigatiQn for this rez�ne which w�J a��pt�d by th� City Council . B�sed upon that decision and subject to the f_ollowing conditians, the rezone should be granted: Traffic Mitig�tion: The Planning and Development Committee recommends that the traffic mitigation for this project be as d�tailea in Attachment "A" heret� which is incorporated by reference as if fully set forth. Attachment "B" , Znterim Traffic Mitig�tion Program, which is incorporated by re�er�nce herein as if fully s�t forth, provid�� a map of th� improvements to be installed as a condition of this rezone. Ocuppancy Levels: The Hearing Examiner not�d that the vehicle trips per one thousand gross square feet of office �pace is estim�ted to be twelve. In a moderate increase to the employee to fl�or area ratio would result in higher than norm�.l traffic impact�. Shauld th� occup�ncy level rise such that the vPhicle trips per one thousan�l gross �quare feet rises above tw�l.v�, th�n the traffic impact� of this building will be re-�nalyzed. 1 Tim2 Lin2s: The applicant must �pply ta the City of Renton for a building permit within six months �f th� effectiv� day of this rezone. Fallowing the �pplication, the applicant must dilig�ntly pursue the building permit. Followin� issuance of the building permit the applicant must begin construction within �ix znonths after the issuanc� of the building permit ancl must �iligently pursue the construction permitted under th� building permit. Zn orc�er to renew the building permit, the applicant must make substantial construction und�r the building permit or have shown good caus� for extension of the building permit and ha� the Building and Zoning Director extend that permit. Joint Committee: Since this rezone ia the first step in the con�truction of what is anticipated to be four or mor� buildings in this general are,� , and because o.f th� feeling by the neighbors that there is a l�ck of cammunication and exchange of inform�ation, there sh�ll be formed a City-citizen--applicant-Boein� Company Committee to exchange information on tr�affic mitigation and oth�er issues presented by this devel.opm�nt and future development by the applicant or the Boeing Company in this general area with the citizens having at least three but not more than five representatives and e�ch of th� other parties having at l�ast one but not more than three particip�nts. The purposes of this Committee shall be : 1 . To provide a means to communicat� the plans and intentions of the developer and the Boeing Company to the City and the North Renton neighborhooc�. 2. To define issues raise� by future devnlopment limite� primarily to planning, zoning and traffic issues. 3 . To try and resolve as many of these issues as possibl�. 4. To narrow the issues that cannat be resolved so that they m�y be presented to the City Council or other decision maker in a succinct and org�nized fashion. Neighborhood Protection: Neighborhood protection from traffic may serv� th� exiating single L-amily r�sidences. H�wever , such things as traffic diverters or blockage of traffic lanes are aften controversial . The City staff is ther�fore dir�cted to r�view possible methods of preserving the single £amily neighborhoods by means of various devices or methods to restrain traffic flaw through the single family neighborhoods, to hold public meetings to gather public input and report to the City Council on recommended measures to be implemented. 2 ERC: �his r�z�ne shou�d be sub�ect to the c�nditions imposed by the ERC to the extent that they are not inconsist�nt with the conditions imposed by the City Council . H��ring Examiner Report: The Report and R�commendation of the ��aring Examiner dated August 18, 1987 under File No. RO1�-�7 is adnpted by the City Council with the fallowing modific�tions: Conclusion N�. 1 is madified by striking the last sentenc� thereof. Conclusion No. 2 is stricken in its entirety. Conclusions No. 3 and 7 are am�nd?d by adding a sentence to each of them which state�: Tying this rezQne t� the companion sit� plan approval SA- 017-87 will eliminate the problem that could be create� by unre�tricted B-1 zoning . Conclusion �o. 4 is modified by adding a sentence : A portion of this block is already B-1 zoning. B-1 zoning exists extensively along Park Avenue. This particular rezane is not an 2xtension of B-1 zoning into an �xisting single family neiqhborhood as B-1 develope� uses �xist as cl�se or closer to the single family neighborhoods. Generally L-1 zoning is a more intensive use and B-1. zoning can serve as � buffer between that more intense use and the single family u�e. Conclusion tdo. 5 is stricken �nd therQ is substituted for it the following lan�uage: Th� L-1 use in the same block as this rezane is an H-1 use unc3�r the City° s eYisting zening code. If that us�, in fac�, is p�rmitting chemicals and sawdu�t to be expelled into th� atmosghere such th�t it would prove dam�ging to automobile finishes, th�n such a use is incompatible with the nearby singl� family neighborhood and is prdbably in violation of air pollution laws. To the extent that the increase3 usage of City streets wi11 interfer� with the loading and unloading �f_ trucks used by this adjoining L-1 use, it should be noted that the streets are generally for travel and not for loading . The existing L-1 use does not have a preemptive right to the use of City righ�-of-way. Conclusion Nfo. 16 ia eliminated. 3 Cnnclusion No. lB is eliminated. The r�comm�ndation is modified to read The requested rez�ne should be granted subject to the following con�itions: 1 . Mitigation of the traffic impacts �s detailed in Exhibit "A" attached her�to and incorporated by reference as if. fully set forth. 2 . Approval of site plan SA-017-87. 3. The applicant will abide by the restrictive time lines which include applying for the building permit within six znonths of the effective day of this rezon�. Following the application, the applicant must diligently pursu� the building permit. Following issuance of the building p�rmit the applicant must be�in c�nstruction within sa.x months aft�r the issuance of the building permit and must diligently pursue the construction permitted under the building permit. In order to renew the building permit, the applicant must make sub�tantial construction under the building p�rmit or have shown good cause for extension of the building permit and had the Building an� Z�ning Director extend that permit. 4. The applic�nt' s participation in a City-citizen-applicant- Boeing Committee organized as detailed above �nd for the purp�ses detailed above. 5 . Compli�nce with the ERC conditions to the extent they are not inconsistent herewith. 6. Signing of a restrictiv� covenant that if the employee flaor area ratio rises above that which would gen�r�te twelve vehicle trips per �ne thousand gross square f_eet, th�t the owner would submit ta n�w environmental review. 7 . Cooperation with the City staff in determining wh�t traffic measures should be taken to pre�erve the integrity of the adjoining single family residential neighborhoods. Datzd: November �, 1987. CITY3: 61/11j13/87 4 ATTACHMEDIT "A" PLANNING AND DEVELOPMENT COMMITTEE RECOMMENDATION RE: TRAFFIC MI'I'IGATION E & H REZONE AN� SITE PLAN APPROVALS The Planning an� Development Committe� met on November 12, 19�7 to try and structure an acceptable traff_ic mitigation �rogram for the E & H rezone and site plans. The Committee set the policy that it wished to avoid additional traffic impacting the residential neighborhoods including along Garden Av�nue North. With this in mind, the Committee makes the following recommendati�n concerning an acceptable traffic mitigation program: 1 . There shall be formed a joint City/Citiz�n Committee concerning traffic diversion from the single family rvsidences of North Renton which sha11 be all streets in 1Vorth Rentan, except for North 3rd, North 4th and Park Avenue N. The purpose of this effort will be to arrive at a joint staff-neighborhood recammendation to th� City Council as to the traffic diversion steps that would be the most effective to preserve this single family neighborhood. If a single recommendation cannot be obtained , then a regort should be submitted to the Council detailing the two or three best methods with the Council making the final decision. This recommendationshall be made by July l, 1988. 2. On Park Avenue N. there should be no parking during peak traffic hours. This wi11 permit four lanes of traffic, two northbound, two southbound. 3. Install a "C" curb on Park A�e. from the north property line of Park Plaza through the int�rsecti�n of North 5th prohibiting left turns on Park Ave. North. Left turns would also be prohibit�d at North 6th. The developer shall alsa provide an additional 10 ' of right-of-way along the west property line from North 6th to North 5th for potential future widening of Park Ave. �Iorth to 5 lanes. 4. There shall be d�signed a turn movement southbound on Park Avenue N. at N. 3rd to minimize conflicts in the left turning mavement onto N. 3rd and the developer shall pay for any change in the signal at that location. 5. Garden Avenue N. , northbound, shall have no through traffic to Lake Washington Soulevard. The intent is tra discourage regional traffic from crossing the Garden/Park/Lake Washington Boulevard intersection and proceec�iny down Lake Washington Boulevarde 6 . North lOth shall not be built at this tim�. 7. Fund a study to �valuat�e alternative 2Q-year development land use scenarios for the impact �n the transportation 7. Fund a study to �valuate alt�rnative 20-year dev�lopment land use scenarios f�r the impact on the transportation system. The study should place as much emphasis on neighborh�od mitigation �s it �oes on traffic mitig�tion. 8. Bond $1. 2 million ($197 per trip) to fund transportation improvements recommended from the study and adopted by Council. 9. Reconstruct th� intersection of Lak� Washington Blvd./Par}c/Garden to provid2 an additional eastbound lane on Park Drive. 10. Realign Garden Ave. North at �orth 8th to remove the 2xisting dog leg. 11. R�chann�lize North 5th Street from Garden Ave. North to Park Ave. North to 3 lanes to provid� left turn lane. 12. Signalize the intersection of North 6th and G�rden Ave . £1or th. 13. Frovide passenger drop off l�nes on Park Ave. North and North bth Street in front of the Park Plaza and Garden Plaz� Buildings. 14. Prior attempts by the iity to change the zoning or comprehensive planning in this area has led to protests �ne� the abandonment of such an e�.f_ort. Until this a.rea takes on a multi-f�mily character , or until the owners in the area are willing to accept single family zoning, then it is necessary to pratect the single family neighbornoods from int.rusiva traffic to �h� maximum extent possible while still permitting maximum flexibility by maintaining the existing arteriala. CITY3 : 63/11/13/87 PLANNING AP1D DEVELOPMENT COMMITTEE RECOMMENDATION RE: TRAFFIC MITIGATION E & H REZONE AND SITE PLAPd APPROVALS The Planning and Developm�nt Committee met on November 12 , 1987 to try and structure an acceptabl� traffic mitigation program for the E & H rezone an�l site plans. The Committee set the nolicy that it wished to avoid additional traffic impacting the residential neighborhoods including �long Garden Avenue North. With this in mind, the Committee makes the following recomm�ndation concerning an acceptable traFfic mitigation program: i. There shall b� forme3 a joint City/Citizen Committee concerning traffic diversion from the single family residences of North R2nton which shall - be all streets in North Renton, except for North 3rd, North 4th and Park Avenue N. The purpose of this effort will �e to arrive at a joint staff-neighborhood recommendation to the City Council as to the traffic diversion steps that would be the most effective to preserve this single family neighborhood. If a single recommendation cannot be obtain�d , then a report should be submitted to the Council detailing the two or three best methods with the Council making the final decision. This recommendationshall be rnade by July 1, 1988. 2. On Park Avenu� N. there should be no parking during peak traffic hours. This will permit four lan�s of trafiic, two northbound, two southbound. 3. Install a "C" curb on Park Ave. from the north property line of Park Plaza through the intersection of North 5th prohibiting left turns on Park Ave. North. Left turns would also be prohibited at North 6th. The developer shall also provide an additional 10 ' of right-of-way along the west property line from xlorth 6th to North 5th for potential future widening of Park Ave. PJorth to 5 lan�s. 4. There shall be designed a turn movement southbound on Park Av�nue N. at 1V. 3rd to minimize conflicts in the left turning movement onta N. 3rd and the developer shall pay for ,. any change in th� signal �t that location. 5. Garden Avenue N. , northbound, shall have no through traffic to Lakz Washington Boulevard. The intent is to discourage regional traffic from cressing the Garden/Park/Lake Washington Boulevard intersection and proceeding down Lake Washington Boulevar�. 6 . North lOth shall not be built at this time. 7 . Fund a study to evalu�te alternative 20-year develogm�nt land us` scenarios for the impact on the transportation system. The �tudy should place as much emphasis �n neighborhood mitigation as it does on traffic mitigation. 8 . Bond $1. 2 million ($197 per trip) to fund transportation improvements recommended from the study and adopted by Council . 9. Reconstruct the intersection of Lake Washin�ton Blvd ./Park/Garden to providQ an additional 2astbound lane on Park Drive. 10. Realign Garden Ave. North at North 3th to remove the existing dog leg. 11. Rechannelize North 5th Street from Garden Ave. North to P3rk Ave. North to 3 lanes to p.rovid.e left turn lane. 12 .
