(F.ARLINGTON SEWER L.I.D., - RESOLUTION OF INTENTION)
W EREAS a petition has been duly presented to the City Council of
the City of Renton and filed with the City Clerk and City Engineer petitioning for
the improvement of the area hereinbelow described, setting forth the nature and
territorial extent of such proposed improvement, to -gaits the construction and install-
ation of a sanitary sewer system and doing of all incidental work as may be necessary
in connection therewith, stating that the mode of payment_be.by assessments against
the properties benefited, the cost to be based on an area basis and proportioned in
regard to the area of each piece of property in the district; stating the fact that
the signers thereof are the owners of properties in said described territory as set
out and described in said petition; all of said area and territory being situated
within the City of Renton; the signers of said petition being the owners according
to the records in the office of the County Auditor of property to an aggregate amount
of a majority of the lineal frontage upon the improvement to be made and of the area
within the assessment district to be created therefor; and the City Engineer and
Commissioner of.Streets and the City Council having ascertained that the facts set
forth in the said petition are true and having caused an estimate of the cost and
expenses of such improvement to be mads, transmitted to, and filed with the City
Council of Renton together with all papers and information in possession of said
officers touching such improvement, with the estimated cost thereof: and their re-
commendations thereof, together with a description of the boundaries of the pro-
posed district and a preliminary estimated assessment roll and statement of propor-
tionate amount of the cost and expense of such improvement which shall be borne by
properties within the proposed assessment district, and a statement of the aggre-
gate assessed valuation of the real estate exclusive of improvements in said district
according to the valuation last placed upon it for purposes of general taxation;
and said petition having been found sufficient and such officers having also trans-
mitted to and filed with the City Council a diagram, drawing or print showing thereon
the lots, tracts or parcels of land and other property which will be specially
benefited thereby.. and the estimated amount of the cost and expense of such improve-
meat to be borne by each such lot, tract or parcel of land or other property; and it
having been determined that said petition is signed by the owners of more than sixty
percent (60%) of the lineal frontage upon the improvement to be made and three -

quarters (3A) of the area within the Units' of the proposed improvement district
and that the costs and expenses of the proposed improvement., and the assessments.,
which nay be assessed against the properties within such improvement districts may
exceed by one hundred percent (100%) the assessed valuation of the real estate ex-
clusive of improvements thereon within such districts, according to the Valuation
last placed upon it for the purpose of general taxation; and
WHEREAS the City Council has made investigation and study of said
petition and of said proposed local improvement and of the benefits accruing therefrom
to the respective lots., tracts parcels and real estate and other propertyp and of
the fair and proper mode and method of assessment and payment for the same., all as
hereinafter resolved and stated, and the City Council having held hearings thereon
after notices sent thereof to all of owners of properties within the proposed dis-
trictp and the City Council having found.. and hereby finding and d eterminingj, that
the making of such proposed improvements as hereinafter resolved and stated and the
benefits accruing therefrom are necessary for the immediate preservation of the
health# w elfare and safety of the City of Renton and its residentsj, and that the
matters.. things, findings and determinations hereinabove and hereinafter recited are
true.. correct and existing; NOW THEREFORE
BE IT RESOLVED BY THE CITY COUMIL OF THE CITY OF RENTON AS FOLLOWS:
1• That it is the intention of the City Council of the City of Renton.,
acting upon its own initiative,, findings and determination aforesaid and also acting
upon and in accordance with the persuasions, contents and request of said petition as
well as studies, findings and determinations made in connection therewith. to order
the improvement of the areas, territory and properties and streets hereinafter
mentioned by constructing and installing therein sanitary sewers., with all manholes
accessories and equipment appropriate thereto# and the doing of all such other work
incident thereto as may be necessary or appropriate in connection therewith.. all in
accordance with plans prepared by the City Engineer and Commissioner of Streets and
filed in his office and in the office of the City Clerk# and in accordance with any
alterations$, changes and enlargements which may be hereafter made or adopted in
respect to said plans; the areas,, territory,, properties and streets hereinabove
mentioned and routes of such improvements being situated within the limits of the City
of Renton., Washington and embraced within the following description thereof$ to -wits

Beginning at the intersection of center line Lake Street and
Tobin Ave.; thence Westerly along the center line of Tobin Ave.,
west line of Rainier Ave., the northerly line of Tax Lot 131,
the easterly line of 91st Place South and the northerly line of
Tax Lot 111, to the easterly line of 91st Ave.; thence southerly
to the south line of the Seattle Pipe Line R/W; thence westerly
along said south line to the easterly line of 84th Ave. South;
thence southerly to a point 1401 north of the SW Corner of
Block 4, Earlington; thence westerly 1661; thence southerly to
the south line of South 138th St; thence.westerly and southerly
along said south line and -the easterly line of 81st Ave. South
to the center line of State Highway No. 2; thence easterly along
said line to the easterly line of the Black River; thence
northerly along the said easterly line to the south line of lots
11 2, 3, 40 and 5, Block 2 of the Victoria A. Kelly Addition.;
thence easterly along said south line to the center line of Lake
Street; thence north to the point of beginning;
Also in connection therewith to order the improvement of Third Avenue and Langston
Road in said City of Renton from the intersection of said Third Avenue with
Shattuck Street to the intersection of said Third Avenue and said Langston Road
at the easterly boundary of the above described district, by the construction
and installation of trunk sewers therein, with all appropriate manholes, access-
ories, equipment pertaining thereto, and the doing of such other work as may be

necessary incidental or appropriate in connection therewith.
2. That all persons that may desire to object thereto are hereby notified
to appear and present such objections at a meeting of the City Council to be held
in the Council Chambers, in the City Hall in the City of Renton at 8 otclock P.M.,
on the 4th day of September, 1951; which time and place is hereby fixed for hear-
ing all matters relating to said proposed improvements and all objections or pro-
tests thereto, and for determining the method and mode of payment for said im-
provements,
3. That the City Engineer and Commissioner of Streets shall in the manner
provided by law submit to the City Council at or prior to said date of hearing,
all data and information required by law to be submitted.
4.. That the cost and expenses of said improvements shall be borne by and
assessed against the properties liable therefor as provided by law, and in the
mode and method provided by law; and the City of Renton shall not be.liable in any
manner for any of the cost and expenses of such improvements except only that the
City of Renton shall bear and pay the cost and expenses of constructing and in-
stalling above last mentioned trunk sewer on Third Avenue and Langston Road from
the intersection of said Third Avenue with Shattuck Street to the intersection of
said Third Avenue and Langston Road with the eastern boundary of the above des-
cribed proposed Local Improvement District at 91st St. South; and the mode and

method of assessments to be levied against properties as hereinabove provided
shall, except to such extent as may be subsequently otherwise ordered or modified
by the City Council, be by assessments against the properties.specially benefited
by such improvements, as such benefits may be determined by the City Engineer and .
Commissioner.of Streets or by the City Council, having regard to topographical
conditions, and.on an area basis proportioned as near as may be, with any appro—
priate adjustments or modifications, with regard to the square—foot area of the
several lots, tracts -and parcels of real estate, and other properties within and
throughout the entire area of the improvement district to be created in -the making
of such improvements.
4. All property included within the above described limits of and for
such local improvement district, as the same may be hereafter altered, modified or
enlarged shall be considered and held to be the property and all the properties
specially benefited by such improvements and shall be the properties to be assessed
to pay the costs and expenses thereof as hereinabove provided, as may be chargeable
against the properties specially benefited by such improvements. It is hereby found
and determined that the special benefits conferred upon the above properties may
not be fairly reflected by use of termini and zone method of assessments, and that'
assessments may be made against properties in the district without regard to zone
and termini method.
ADOPTED AND PASSED by the City Council of Renton this 7th day of
August, 1951•
