ORDINANCE NO. 1374
THE CITY OF RENTON, WASHINGTON.. CHANGING THE CLASSIFI-
BLOCK 3, TOWN OF RENTON,FROM RESIDENTIAL TO COMMERCIAL
WHEREAS, under Ordinance No. 1164 and the maps adopted in con-
junction therewith, as ammended, the tracts hereinafter described have
been heretofore zoned as Residential Use District; and
WHEREAS, under the provisions of Section XV of said Ordinance
a proper petition for change of zone classification of said tract to
Commercial Use Distrht has been filed with the Clerk of the City of Renton,
and the Planning Commission of said City has recommended such change of
classification upon the conditions as follows:
(a) That the owners of said tract, Lot 1, Block 3, Town of Renton,
obtain and furnish evidence of proper easements for ingress and
egress to said Lot 1; from owners of adjoining property;
(b) That the owners of said tract (Lot 1, Block 3, Town of Renton)
undertake and contract that the certain wooden frame garage
structure with living quarters in rear thereof, now situated
on said Lot 1, which fails to conform to City code requirements
for structures in Commercial Use District, shall be entirely
removed from said Lot 1 within a period of two years from and
after March 1, 1950.
(c) That the present owners of said Lot 1, Block 3, Town of Renton
furnish to and deposit with the City of Renton a proper perform-
ance bond in the principal sum of $;1,000.00, with proper surety,
conditioned that said sum of `1,000.00 shall be paid to and for-
feited to the City of Renton upon the expiration of two years
from March 1, 1950 in the event that said present wooden frame
garage structure be not entirely removed from said tract prior
to expiration of said two year period; and
WHEREAS, a public hearing has been held on said Petition by the
City Council pursuant to notice thereof regularly given and published;
and no protest having been made against the prayer of said Petition; and
the present owners of said tract being present at said City Council hear-
ing February 21, 1950, and having stipulated and agreed that they accept
the aforesaid conditions recommended by the Planning Commission and ac-
cept rezoning subject to full compliance with said conditions, and agreed
to abide by and perform the same; and said owners, John M. Myers and John
tFiilliam Tusa having furnished to and filed with the City of Renton their
performance and indemnity bond No. 2482931 issued by Hartford Accident &
Indemnity Co. as surety thereon, dated January 30, 1950 in said principal
sum of $1,000.00 conditioned as aforesaid; and they having also furnished
to the City of Renton evidence of having obtained easement for ingress and
egress from Puget Sound Power & Light Co., a Massachusetts corporation,
providing access to said tract; and the Council having concurred in and
adopted the aforesaid recommendations and conditions made by the Renton
Planning Commission; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF RENTON:AS-FOLLOWS
SECTION„1: That Lot 1, Block 3, Town of Renton, be and.is here-
by rezoned and reclassified as a Commercial Use District, and the City
Engineer is hereby directed to change the maps of the zoning Ordinance
of the City of Renton to show this change.
SECTION 2: That the rezoning herein granted and made is upon
the express condition that the aforesaid ingress and egress easement be
maintained, and that the certain wooden frame garage structure aforesaid
noir situated on said tract be entirely removed from the said tract within

two years from and after March 1, 1950, and upon the further condition
that aforesaid bond and indemnity of $1,000.00 under Hartford Accident &
Indemnity Co., bond No. 2182931, dated January 30, 1950 be paid and for-
feited to the City of Renton at the expiration of said two year period in
the event aforesaid structure be not then removed entirely from said tract.
SECTION 3: This Ordinance shall be in full force and effect
five (5) days from and after its passage, approval and publication.
PASSED by the City Council this 28th day of February, 1950.
