ORDINANCE NO. 1428•
AN ORDINANCE providing for the construction and
installation of a system of sanitary sewer lateral
lines and a trunk sewer line in the Earlington area
of the City of Renton, all in accordance with
Resolution No. 817 of the City Council of the City
of Renton; creating a local improvement district
therefor; providing that payment for said system
of sanitary sewer lateral lines be made by special
assessments upon property in said District, payable
by the mode of "Payment by Bonds"; transferring
$30,000.00 from the "Sewer Disposal Fund" to the
"Construction Fund" of said District to pay for the
trunk sewer line; calling for bids for the purchase
of Local Improvement District Warrants to be issued
in connection therewith; and authorizing the call
for bids for the construction work.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF TEE CITY
OF RENTON, WASHINGTON, as follows:
Section 1. Pursuant to Resolution No* 817 of the City
Council of the City of Renton, adopted on the 7th day of
August, 1951, declaring the intention of the City Council to
order the improvements hereinafter described, a hearing on
such Resolution having been duly and regularly held on the
4th day of September, 1951, after notice thereof having been
given in the manner provided by law, it is hereby ordered
that the following system of sanitary sewer lateral lines be
immediately constructed and installed, together with all
necessary manholes, accessories and equipment appropriate
thereto, and other work incidental thereto, to -wit:
Line B:
An 8" Sewer Line as follows: Beginning at a point 20'
southerly and 35' easterly of the intersection of the northerly
margin of Langston Road with the westerly margin of 91st Ave.
South in the City of Renton, Washington; thence westerly,
parallel and 20' southerly of said northerly margin 1145';

thence westerly 410' to a point of the centerline of 86th
Avenue South and 5' southerly measured at right angles to
the centerline of Langston Road; thence -westerly and 5'
southerly of said center line with a 6" sewer line 550'
more or less. . .
Line Bl:
An 8" sewer line as follows: Beginning at a point 5'
easterly and 20' southerly of the southeasterly corner at
Block 2 of CROSBY HEIGHTS Addition to the City of Renton;
thence northerly and parallel to the easterly line of said
Block 2, 330'; thence westerly and parallel to the southerly
margin of Block 1 of said addition and 25' therefrom with a
6" sewer line 260' more or less.
Line B2:
A 6" sewer line as follows: Beginning at a point on
the easterly extension of the centerline of the alley through
Block 2 of CROSBY HEIGHTS Addition to the City of Renton and
5' easterly of the.east line of said Addition; thence westerly,
along said alley and extension 260' more or less.
Line B3:
A 6" sewer line as follows: Beginning at a point 51
easterly and 20' southerly of the southwesterly corner of
CROSBY HEIGHTS Addition to the City of Renton; thence northerly,
parallel and 5' easterly of the westerly line of said addition
3201.

A 6" sewer line as follows: Beginning at a point 20'
northerly and 5' easterly of the centerline intersection of
Langston Road and 88th Avenue South in the City of Renton,
Washington; thence northerly, parallel and 5' easterly from
the center line of 88th Avenue South 245'.
Line B5: (Easterly Portion)
Af8" sewer line as follows: Beginning at a point of the
easterly line of McL•aughlin's Lots 110' southerly of the north-
east corner thereof thence south 77°51'15" east; east 1801;

A 10" sewer line as follows: Beginning at a point 20'
southerly and 35' easterly of the intersection of the
northerly margin of Langston Road with the westerly margin
of 91st Avenue South in the City of Renton, Washington;
thence southerly and westerly along State Highway No. 2 and
30' northerly of,the centerline of said highway 1330'; thence
continuing along said highway with an 8" sewer line, 700' to

Line D:
An 8" sewer line as follows: Beginning at a point 30'
northerly and 40' easterly respectively of the centerlines
of State Highway No. 2 and 88th .Avenue huth; thence westerly

An 8" sewer line beginning at a point 35' northerly and
26' westerly respectively of the intersection of the center-
line of State Highway No. 2 with ,State Highway No. 5 in the
City of Renton, Washington; thence northerly and parallel to
Highway No. 5 1501; thence continuing northerly with a 6"
sewerline 280' more or less.
Line Il:
An 8" sewer line beginning at .a point 26' westerly and
5' southerly respectively of the centerline intersection of
State Highway No. 5 and .South 136th Street in the City of
Renton, Washington; thence southwesterly and parallel to the
centerline of South 136th Street 1801; thence continuing
southwesterly with a 6" sewer line 1451; thence northerly

and 234' easterly respectively of intersection of the north
margin of Second Avenue in the City of Renton, Washington,
with the centerline of State Highway No. 5 in the City of

Line J2:
A 6" sewer line beginning at a point 26' easterly and
207.5' northerly respectively of the intersection of the
centerline of State Highway No. 5 and the north margin of
the City of Seattle pipeline right of way in the City of
Renton, Washington; thence easterly parallel to right of way
1951; thence northerly 230' more or less.

the center line of Tobin .Avenue 4601; thence southerly and
parallel to the centerline of State Highway No. 5; thence
with a 6t/ sewer line 170' more or less.
Line Kl:
A 611 sewer line beginning at a point 350' west and 51
south cf the centerline intersection of Tobin Avenue and Lake
Street in the City of Renton, Washington; thence southerly
and parallel to the easterly margin of State Highway No. 5
355' more or less.
all in accordance with plans prepared by the City Engineer and
Commissioner of Streets and on file in his office and in the
office of the City Clerk,

It is further ordered that a trunk sewer line, desig-
nated as "kine A", shall be immediately constructed and
installed, together with all necessary manholes, accessories
and equipment appropriate thereto, and other work incidental
theretogto consist of a 12" sewer line beginning at a point
139' south of the centerline intersection of Second avenue
and Shattuck Street in the City of Renton, Washington; thence
westerly and 5' southerly of the south margin of the City of
Seattle pipe line 540' to the Channel of Black River; thence
southwesterly along said channel 490' more or less; thence
westerly and 35' northerly of the centerlines of Third Avenue
and ,State Highway No. 2 775' more or less to a point 20'
southerly and 35' easterly respectively of the intersection
of the north margin of Langston Road with the westerly margin
of 91st Avenue South, all in accordance with plans prepared by
the City Engineer and Commissioner of Streets and on file in
his office and in the office of the City Clerk.
Section 2. The cost and expense of said improvements,
including all necessary and incidental expenses, shall be
borne by and assessed against the property included in the
assessment district hereinafter created, in accordance with law,
and the City of Renton shall not be liable in any manner for
any portion of the cost and expense of such improvements; Pro-
vided, however, that the City of Renton shall bear and pay the
cost and expense of constructing and installing said trunk
sewer line, the estimated cost of which is $309000.00, and said
sum of $30,000.00 is hereby transferred from the "Sewer Dis-
posal Fund" to the ''Construction Fund" of the local improvement
district hereinafter established.

Section 3. There is hereby established a local improve-
ment district to be called "Local Improvement District No. 239",
which district includes all the property within the following
described area? all within the limits of the City of Renton,
Washington, to -wit:
Beginning at the intersection of the center lines
of Lake Street and Tobin Avenue; thence westerly
along the center line of Tobin Avenue, west line
of Rainier Avenue, the northerly line of Tax Lot
131, the easterly line of 91st Place South and the
northerly line of Tax Lot 111, to the easterly
line of 91st Avenue; thence southerly to the south
line of the Seattle Pipe Zine R/W; thence westerly
along said south line to the easterly line of 84th
Avenue South; thence southerly to a point 140'
north of the southwest corner of Block 49 Earlington;
thence westerly 1661; thence southerly to the south
line of South 138th Street; thence westerly and
southerly along said south line and the easterly
line of 81st Avenue South to the center line of
State Highway No. 2; thence easterly along said
line to the easterly lineof the Black River; thence
northerly along the said easterly line to the
south line of Lots 1, 2, 37 4, and 5, Block 2 of
Victoria A. Kelly Addition; thence easterly along
said south line to the center line of Lake Street;
thence north to the.point of beginning.
Section 4. All property included within the limits of
the local improvement district above created shall be con-
sidered to be the property specially benefitted by the local
improvements and shall be the property to be assessed to pay
the cost and expense thereof, except the cost and expense of
said trunk sewer line as aforesaid. The nature of the improve-
ments is such that the special benefits conferred on the pro-
perty are not fairly reflected by the use of the termini and
zone method of assessment, and it is hereby provided and
ordered that the assessments shall be made against the pro-
perty of the district in accordance with the special benefits
that it will derive from the improvements without regard to
the zone and termini method provided by statute.

Section 5. There are hereby created and established
in the office of the City Treasurer of the City of Renton,
for Local Improvement District No. 239, the following funds,
to -wit:
(a) "Local Improvement Fund, District No. 239",
into which fund shall be deposited all payments
made upon assessments in said District for the
redemption of the warrants and bonds herein
authorized; and
(b) "Construction Fund," into which fund shall
be deposited the amounts received from the sale
of the Local Improvement District Warrants of
the District herein authorized to be issued and
sold and the amounts transferred from the "Sewer
Disposal Fundtt to pay the cost and expense of
constructing the trunk sewer line as aforesaid,
and against which fund warrants shall be issued
to the contractor or contractors in payment of
the work to be done by them in connection with
said improvements and against which fund warrants
shall be issued in payment of all other items of
expense in connection with said improvements.
Section 6. Local Improvement District Warrants shall
be issued from time to time, in such amounts as the City may
determine, to obtain the fund with which to pay cost and ex-
pense of the improvements, except the cost and expense of the
trunk sewer line as aforesaid. Such warrants shall be payable
out of said "Local Improvement Fund, District No. 23911, shall
bear interest from date thereof at a rate not to exceed 5%
per annum, all warrants to bear the same rate of interest,
and shall be redeemed either in cash or by local improvement
district bonds herein authorized to be issued.' Bonds bearing
interest at the same rate as said warrants and payable on or
before twelve (12) years from the date of issuance shall be .
issued in exchange for and in redemption of any and all war-
rants drawn on the "Local Improvement Fund, District No. 239"
and issued hereunder not redeemed in cash within a. period of
not to exceed sixty (60) days after the first publication of
Notice of Collection of assessments by the City Treasurer.
Said bonds shall be redeemed by the collection of special
assessments to be levied and assessed upon the property

within said District payable in ten (10) equal annual in-
stallments with interest at a rate not to exceed five per
cent (5j) per annum and not less than the said bonds shall
bear, under the mode of "Payment by Bonds" as defined by
law and the ordinances of the City of Renton. The exact
amount, form, date, interest rate and denomination of said
warrants and bonds and the interest rate on said special
assessments shall be fixed hereafter -by ordinance of the
City Council.
Section 7. The City Treasurer of the City of Renton
is hereby directed to cause to be published in the Renton
News Record of the City of Renton and in the Daily Journal
of Commerce of the City of Seattle, in both of their res-

pective issues of June -51 1952, and June
19 1952, a Notice
of Warrant Sale calling for sealed bids for the purchase of
said Local Improvement District Warrants, redeemable in cash
and bonds as herein provided, to be received by the City
Treasurer- at her office in the City Hall, Renton, Washington,
until 8:00 o'clock p.m., Pacific Daylight Time, on the 17th
day of June, 1952, at which time all bids received will be
publicly opened by said Treasurer and the City Council. The
bids submitted shall specify either (a) the lowest rate of
interest and premium, if any, above par at which said bidder
will purchase said warrants, or (b) the lowest rate of interest
at which the bidder will purchase said warrants at par. The
City reserves the right to reject any and all bids submitted.
The City will furnish the warrants and the bonds issued in re-
demption thereof, together with the approving legal opinion of
Weter, Roberts & Shefelmar bond counsel of Seattle, iivashington,
without cost to the purchaser.

Section 8. The City :engineer of the City of Renton is
hereby authorized and directed to call for bids, -in the
manner provided by law, for the construction and installation
of the improvements authorized herein, and said call for bids
shall include a statement that payment for said construction
and installation will be made in cash warrants drawn upon the
"Construction Fund" of Local Improvement District No. 239 of
the City of Renton. The call for bids shall request bidders
to submit bids covering the construction and installation of
any or all of the following:
(a) the system of sanitary sewer lateral lines
separately,
(b) the trunk sewer line separately,
(c) the system of sanitary sewer lateral lines and
trunk sewer line combined.
PASSED by the City Council and APPROVED by the Mayor
this 27th day of May, 1952.
