.ORDINANCE NO. 1431
AN ORDINANCE OF THE CITY OF RENT ON, WASHINGTON,
RELATING TO CIVIL DEFENSE, ESTABLISHING A CIVIL
DEFENSE COUNCIL, DEFINING ITS DUTIES AND POWERS,
FURTHER ESTABLISHING A CIVIL DEFENSE ORGANIZA-
TION, DEFINING ITS NLEMBERS AND THE DUTIES AND
POWERS CONNECTED THEREWITH, PROVIDING PENALTIES
FOR THE VIOLATION THEREOF, AND REPEALING ANY OTHER
ORDINANCES IN CONFLICT THEREWITH.
THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN
AS FOLLOWS:
Section 1. PURPOSE. The declared purposes of this ordinance are
to provide for the prepgration and 'earrying out of the plans for the
civil defense of persons and property within this city in the event of
a disaster, and to provide for the coordination of the civil defense
functions of this city with all other public agencies and affected
private persons, corporations and organizations. Any expenditures
made in connection with such civil defense activities, including mutual
aid activities, shall be deemed conclusively to be for the direct pro-
tection and benefit of the inhabitants and property of the City of
Renton.
Section 2. DEFINITIONS. A. Civil Defense. As used in this
ordinance, the term "civil defense{ shall mean the preparation for
and the carrying out of all emergency functions, other than functions
for which military forces are primarily responsible, to prevent, mini-
mize, and repair injury and damage resulting from disasters. It shall
not include, nor does any provisions of this ordinance apply to any
condition_ relating to a labor controversy.
B. Disaster. As used in this ordinance, the term "disaster"
shall mean actual or threatened enemy attack, sabotage, extraordinary
fire, flood, storm, epidemic, riot, earthquake or other similar public
calamity.
Section 3. CIVIL DEFENSE COUNCIL, MEMBERSHIP. The City of
Renton Civil Defense Council is hereby created and shall consist of
the f ollowing:
a. The Mayor of the City of Renton, who shall be designated
the Director and act as Chairman.,

b. The Executive Director of Civil Defense shall be ap-
pointed by the Mayor and shall be designated and act as Vice -
Chairman; such Executive Director, under supervision of the
Mayor, shall develop Civil Defense and disaster plans and or-
ganize the civil defense and disaster programs of the City; he
shall further have such other duties as may be designated and
assigned to him by the Director.
c. Such deputy directors and chiefs of operating civil
defense and disaster departments, services or divisions as may
be provided for by resolution in pursuance of this ordinance.
d. -Such representatives of civic, business, labor, veter-
ans., professional or other organizations having an official
group or organization civil defense and disaster responsibi-
lity as may be appointed by the Mayor, provided, however, that
the members of said Civil Defense Council shall number not less
than seven (7) nor more than fifteen (15) .
Section . CIVIL DEFENSE COUNCIL. POWERS AND DUTIES. It shall
be the duty of the Rent on Civil Defense Council, and it is hereby em-
powered to review and recommend for adoption by the City Council civil
defense and disaster and mutual aid plans and agreements and such ordi-
nances and resolutions, rules and regulations as are necessary to im-
plement such plans and agreements. The Civil Defense Council shall meet
upon call of the Director or in his absence from the City or inability
to call such meeting, upon the call of the Executive -Director.
Section 5. DIRECTOR OF CIVIL DEFENSE. POWERS AND DUTIES. There
is hereby created the position of Director of Civil Defense. The Direc-
tor shall be and is the Mayor of the City of Renton, and as such Director
he is hereby empowered as follows;
a. To request the City Council to proclaim the existence
of or threatened existence of a disaster and the termination
thereof, if the City Council is in session, or to issue such
proclamation if the City Council is not in session and the
Director was unable, after diligent effort, to call a special

session of the Council or to procure a quorum thereof, sub-
ject, however, to confirmation by the City Council at the
earliest practical time.
b. To request the Governor to proclaim a state of extreme
emergency when in the opinion of the Director the resources of
the City are inadequate to cope with the disaster.
c. To control and direct the efforts of the civil defense
organization of the City for the accomplishment of the purposes
of this ordinance.
d. To direct coordination and cooperation between divi-
sions, services and staff of the civil defense of the City, to
resolve questions of authority and responsibility that may
arise between them.
e. To represent the civil defense organization of the
City in all dealings with the public or private agencies per-
taining to civil defense and disaster.
Section 6.
POWERS OF DIRECTOR IN CASE OF DISASTER AND/OR EMERGENCY.
In the event of the proclamation ofa state of extreme emergency by the
Governor or the State Director of Civil Defense, the Director is hereby
further empowered as follows:
a. To make and issue rules and regulations, with approval
of the Council, on matters reasonably related to the protection
as affected by such disaster; if the Director is unable to call
a special session of the Council or to have a quorum thereof,
such rules and regulations may then be issued by the Director
subject to confirmation by the City Council at the earliest
practicable time thereafter.
b. To obtain vital supplies, equipment and such other
properties found lacking anal needed for the protection of the
life and property of the people, and to bind the City for the
fair value thereof, and if required immediately for the protec-
tion of lives and property, to commandeer the same for public
use, and all the foregoing without regard to time consuming

procedures and formalities prescribed by law excepting man-
datory constitutional requirements.
C. To require emergency services of any city officer
or employee and, in the event of the proclamation of a state
of extreme

region in which
this City
is located,
to command the
aid of
as many citizens
of this community as he thinks necessary in the execution of
his duties; such persons shall be entitled to all privileges,
benefits and immunities as are provided by state law for
registered civil defense worker volunteers;
d'. To requisition necessary personnel or material of any
city department or agency.
e. To execute all of the special powers conferred upon
him.by this ordinance or by resolution adopted in pursuance
thereof, or any other powers conferred upon said Director by
any statute, mutual aid agreements as approved by the City
Council, or by any other lawful, authority.
Section 7. CIVIL DEFENSE ORGANIZATION. All officers and em-
ployees of the City, together with those volunteer forces enrolled to
aid them during a disaster, and all groups, organizations and persons
who may by agreement or operation of law, including persons comman-
deered under the provisions of Section 6-c of this ordinance, be char-
ged with duties incident to the protection of life and property in
this City during such disaster, shall constitute the civil defense
organization of the City of Renton.
Section 8, DIVISIONS, SERVICE and STAFF OF THE CIVIL DEFENSE
ORGANIZATION. The functions and duties of the Renton Civil Defense
Organization shall be distributed among such divisions, services and
special staff as the City Council shall prescribe by resolution.
The City Council shall upon adoption of this Ordinance or at
any time thereafter adopt such resolutions as may be necessary to set
forth the form of organization, establishment and designation of divi-
sions and services, the assignment of functions, duties and powers,
the designation of officers and employees which shall make up and
comprise the civil defense organization. Whenever possible the form
of organization, titles and terminologies shall conform to the recom-
mendation of the Federal Government and Department of Civil Defense of
the State of Washington.
Section 9e Any person who, during a period of disaster, as
heretofore specified, wilfully obstructs, hinders or delays any member
of the civil defense organization in the enforcement of any lawful
rules and regulations issued in pursuance to this Ordinance, or in the
performance of any duty imposed upon him by virtue of this Ordinance or
who does any fact forbidden to any lawful rules or regulations issued pur-
suant to this Ordinance so as to unnecessarily imperil the lives or prop-
erties of the inhabitants of this City, or to prevent, hinder or delay the
defense or protection thereof shall be guilty of a misdemeanor and upon
conviction thereof shall be fined in the sum not exceeding $100.00 or
by imprisonment for not to exceed thirty (30) days, or both.
Section 10. Any and all persons employed, authorized or
associated in any capacity with any civil defense organization or group
as heretofore defined shall, except if time does not permit, during a
disaster in time of emergency, before entering upon his duties, take an
oath, in writing, before a person authorized to administer oaths in the
State which oath shall be substantially in compliance with the require-
ments of Section 15 of the Washington Civil Defense Act of 1951.
