HomeMy WebLinkAboutORD 1344ORDINANCE NO. 1344 AN ORDINANCE PROVIDING FOR THE I1t2PROVEP!PENT OF MORRIS STREET FROM SECOND AVENUE TO THIRD AVENUE BY PAVING SAID STREET, INSTALLING CURBING AND DRAINS, AND DOING SUCH WORK AS MAY BE NECESSARY IN CONNECTION THEREWITH, IN ACCORDANCE WITH PLANS PREPARED BY THE CITY F2TGINEER, PURSUANT TO RESOLUTION NO. 728; CREATING A LOCAL TP,iPROVEI!41EITT DISTRICT THEREFOR; AND PROVIDING METHOD OF PAYP:IENT FOR SA.T.12 BY SPECIAL ASSESSMENTS. BE IT ORDAINED by the City Council of the City of Renton: SECTION I: VEERF,AS pursuant to Resolution No. 728 adopted by the City Council of Renton, declaring its 9_ntention to order the improvement of Morris Street from Second Avenue to Third Avenue, in the City of Renton, by paving and other work, and pursuant to petitions filed for such improvement, a public hearing was duly held on March 15, 1949, at a meeting of the City Council in the Renton City Hall at the time and place specified in said Resolution, which was previously published in accordance with law; and at said hearing no one appeared in opposition to the making of such improvement, and no protests were filed or received, and after such hearing the City CouncAil Voted and decided to proceed with such improvement in the manner hereinafter specified, and authorized the City Engineer to proceed with the calling of bids for the same, and bids have been called and received; NOW, THEREFORE, the said actio;i of the City Council and City Engineer is hereby ratified and confirmed, and it is ordained that Morris Street, from Second Avenue to Third Avenue, in the City of Renton, be improved by paving said street with concrete, installing curbing, drains and turn -outs, and that such other work be done as may be necessary therewith, according to the plans and specifications therefor prepared under direction of the City Engineer, as modified and as on file in the office of the City Clerk and City Engineer. SECTION 2: The cost and expense of said improvement including all necessary and incidental expenses, other than such portion thereof as may be paid by or from State aid or contributions, shall be borne by and assessed against the property included in the assessment district hereinafter created, in accordance with law. The City of Renton shall not be liable in any manner for any portion of the cost and expense of said improvement, other than to apply thereon such funds as may be received and allocated thereto in the nature of State aid, assistance or, contributions. SECTION 3: That there is hereby established a local improvement district to be called 'Local Improvement District No. which district is described as follows; All the property between the terminii of said improvement abutting upon, adjacent, vicinal, or proximate to such portion :of said Morris Street, to a distance back from the marginal lines thereof as provided by law. SECTION 4: That the costa nd expense of said improvement, over and above such amounts, if any, as may be received, allocated and paid thereon from contributions, aid, or assistance from the State of Washington, shall be defrayed by special assessments payable by the mode of "immediate payment's as defined by law and by ordinance of the City of Renton. Warrants bearing interest at the rate of 5 (five) per cent per annum until paid shall be issued to the contractor for the redemption of as many of the warrants issued on the local improvement district fund on estimates of the City Engineer, as may not be redeemed in cash. SECTION 5, This Ordinance shall be in full force and effect five days from and after its passage, approval and legal publicat- ion.
