ORDINANCE NO. 1258
AN ORDINANCE 4RANTIN0 A FRANCHISE TO GEOPAS BACON d/b/a PINEHU'RST TRANSIT
COMPANY, IFOR;THE ESTABLISHMENT, MAINTENANCE AND OPERATION OF A MOTOR HHS TRANS-
PORTATION SYSTEM IN THE CITY OF RENTON, . FOR THE TRANSPORATIOH FOR HIRE OF PAS-
STN%zRS AS A COMMON CARRMt ANIS FIXING# THN 'TERUS AND CONDITIONS OF SUCH GRANT.
The City Council of the City of"Renton do ordain as follows:
SECTION 1: DEFINITION OF TERMS:
Whenever used in this Ordinance the following terms shall
have the meanings herein specified.
Company.
The term Ocompany" means George Bacon d/b/a Pinehurst Transit
The term "City Council" means the present governing body of
the city, or the incumbants of any office hereafter created by law or by
charter performing similar functions.
The term "streets" means the streets, avenues, alleys,
bridges and other public ways in the City or within the jurisdiction of the
City of Renton, however they may be designated.
The term "motor bus's means any trackless vehicle propelled
by power generated by gasoline, oil or otherwise, but does not include any
vehicle using overhead wires.
SECTION 2: NATURE OF THE GRANT:
The Authority, right, privilege and franchise is hereby
granted to the company, its successors and assignee, for a period of one
year from and after the date of acceptance by the company of this ordinance
to establish, maintain and operate a motor bus service for the transportation
for hire of passengers only,,over the streets of the City of Renton and the
area within its jurisdiction; all in accordance with the terms and conditions
of this ordinance, and only in accordance with routes and schedules provided
in Section 3 hereof.
SECTION 3: SCHEDULES AND ROUTES:
The following schedules and routes are agreed upon by the
Company and the City Council:

North to North Logan, thence along North Logan to the Boeing Plant. From the
Boeing Plant south along North Lagan to Logan Street, thence.south.along Logan
Street to 3rd Avenue, thence east along 3rd Avenui to point of beginning with
the alternate southbound route as follows; from the Boeing Plant south along
Nd rth Logan to 5th Avenue forth, thence east along 5th Avenue Forth to North
Wells, thence; to point of beginning 'along either of the routes mentioned in they
Renton to North Renton Route.
Ri NTON TO URLINGTON FLATS

Leaving 3rd Avenue and Wells Street, thenoe.weet along 3rd Avenue to
Burnett Street, thence south along Burnett Street to 7th Avenue, thence west
along 7th Avenue to the State Highway No. 2, thence south along State Highway
No. 2 to 149th Street and return to 3rd Avenue and Wells Street along the same
route via Stats Highway No. 20 7th Avenue, Burnett Street and 3rd Avenue.

with an alternate route from 3rd and Wells street meet along 3rd Avenue to
Rainier Avenue thence south along Rainier Avenue to State Road No. 2, thence
south along State Road No. 2 to BE 149th and return along the same route or
vis, 7th Avenue, Burnett Street and 3rd Avenue.
RENTON TO RENTON HILL
From 3rd Avenue and Fells Street, east along 3rd Avenue to Renton Avenue,
thence south along Renton Avenue to 7th Avenue, thence cast along 7th Avenue
to High Street,- thence south along High Street to Sth Avenle, thence west
along 8th Avenue to Grant Street, thenoe north along Grant Street to 7th
Avenue, thence return to 3rd Avenue and Wells Street by the same route via
7th Avenue, Renton Avenue and 3rd Avenues.
R=TON TO MAPLXWOOD
From 3rd Avenue and Wells street, thence along 3rd Avenue to Houser Way
to the entrance of Cedar River Park, thence through Cedar River Park to the
Maple Vally Road to Maplewood and return along the same route, with alternate
route along Mill Street, Bronson Way ,and Maple valley Road.
RENTON TO GALS XW HAZLEWOOD
From 3rd Avenue and Fells via 3rd Avenue, Mill Street, Bronson tray,
Sunset Highway, 112th Avenue southeast, Southeast 97th street, 108th Plane
Southeast, Southeast 94th Street, 100th Avenue Southeast, 91st Street Places
104th Avenue :Southeast, Southeast 84th Street and Lake Washington Blvd. to
Hazelwood. Fro# Hazelwood via Lake Washington Blvd., 100th Avenue SE, SE
9rth Street, 108th Plaoe SSS, BE 97th Street, 108th Avenue SEs Sly 112th Street,
112th Avenue 83, '?Sunset Highways Bronson flay, 2nd Avenues Burnett Street
and 3rd Avenue to 3rd and Wells.
SECTION 4: FARES:
The fare on all schedules within the limits of the
City of Renton shall be ten cents (10¢) for one complete trip with the
rider being entitled b a transfer to all points within the City limits
of Renton. Fares to and from points outside the City limits of Renton
shall be gqual to and correspond at all Imes with tariffs now on rile
or hereafter filed by Lake Shore Lines Inc., whether in its,name or the
name of any owned or controlled operation and which now are or may
hereinafter be approved by the Department of Transportation of the State
of Washington.
SECTION 5: BUS LETTERING:
Busses of the Company shall be lettered "Renton
Transit System.".
SECTION 6: BITS ZONES:
The City Council may at the request of the Company
designate certain zones or areas as Bus Zones, and establish and enforce
traffic regulations to expedite the movement of the companyts busses.
The cost of constructing such Bus Zones shall be borne by the Company.
SECTION 7: INSURANCE:
The.Company shall comply with all of the provisions
of the statutes of the State of Washington with reference to liability
and property damage insurance, and shall at all times maintain in full
force and effect all policies or bonds of liability insurance or
property damage insurance or bonds of indemnity as are or may be re-
quired by the laws of the State of Washington, and shall keep same on
file with the proper officers of the City of Renton or the State of
Washington.
SECTION 8: COMPANY TO SAVE CITY BART SS:
The Company shall at all times indemnify and save
harmless the City of Renton from and against any and all damages, lawful
claims and demands for injury to person or property which may be made
against the City of Renton in any manner growing out of the ownership,
maintenance or operation of the motor buses and any and all other
equipment and structures of the company, and in case suit shall be
filed against the City of Renton dther independently, or jointly -with
the company to -recover for any such claims or damages, the company upon
notice to it by the City of Renton, shall defend the City -of Renton
against such action.
SECTION 9: FRANCHISE FEB:
The Company and its successors and assigns shall
pay the City of Renton for the franchise and privileges granted herein
an annual franchise fee based upon a percentage of the guoss proceeds
received by the company in the operation of their buses under this
franchise, said fee to take effect from the date of operation under this
franchise and be payable every two months thereafter.
The percentage of the gross proceeds above
referred to shall be the same as that set by the Washington State Depart -
went of Transportation in granting franchises. It is understood by the
Company and the City Council that the present state rate is ane -fifth
of one percent (1/5 of 1%) and any increase or reduction.in the state
rate will increase or decrease the Franchise rate herein.
The City Council shall have the right to audit the
books and accounts of the company at any time for the purpose of ascer-
taining the gross earning of the company under this franchise.
SECTION 10: FORFEITT3RE:
This franchise is granted on proposals sub-
mitted by the Company that it will and can furnish the service as set
out in Section 3, hereof over the routes and on the schedules as therein
set forth and the failure of the company to pay the franchise fee or the
failure of the company for any reason to maintain the schedules and
routes as set forth in Section 3 hereof shall give the City Council the
right to declare a forfeiture of all of the rights and privileges
,granted under this franchise, provided, however, that the company be
first given a written notice of the violation of agreement and intent
to declare a forfeiture and allowed a period of thirty (30) days to
correct the violation or default. No :Crfeiture shall be declared if
violation or default is caused by strikesq lockouts, civil disorder or
acts of God.

Sale, assignment or transfer of the franchise or
an interest in the company by any method including operation of late
without the prior consent of the City Council by ordinance shall give
the City Council the right to declare a forfeiture of this franchisee
Upon termination by forfeiture of this franchise
all tghts and privileges of the company in this franchise shall cease
and the company shall have no claim against the City of Renton:
SECTION 11: COMPANY MAY AMUM REASONABLE REGULATION'S:
The Company, its successors and assigns, shall
have at any time and at all.times the right to make such reasonable
rules and regulations for the operation and management of its passenger
service as herein provided for, provided, hoviever, that such rules and
regulations shall not conflict with the laws of the State of Washington
or the ordinances of the City of Renton.
SECTION 12 ASSIGN=, TT. , TRAITS9 ETC.
This franchise shall be deemed to be personal and
no sale, assignment or transfer of the franchise or an interest in the
company by any method including operation of law shall be valid or
binding upon the City of Renton without the express consent of the City
C6yn.cil having first been obtained by ordinance.
SECTION 13. ACCEPTANCE OF FRANCHISE:
This grant is made upon the express condition that
the company within fifteen (15) days after the adoption of this
Ordinance shall file with.the Clerk of the City of Renton a written
acceptance of the same, and when so accepted by the company shall con-
stitute a contract between the City of Renton and the company for all
of the uses, services and purposes herein set forth, and the company by
its acceptance of this Ordinance binds itself to provide and maintain
the necessary motor buses, and to establish, operate and maintain the
transportation service contemplated in this ordinance in accordance ttbh
the lams and statutes of the State of Vashington and all rules and re-
gulations of the Department of transportation of the State of fiashington
now in effect or hereinafter enacted or promulgated relative to main-
tenance and care of equipment and passenger care, comfort and safety, ,

beginning not later than fifteen (15) days from the date of acceptance
of this Ordinance by the Company, unless such be extended by the City
Council, and continuing without substantial interruption except for
causes beyond the control of the company, until the expiration of the
term of the grant hereof.
SECTION 14: EFFECTIVE DATE:
This 6rdinance shall be in full force and
effect five days from and.after its passage, approval, and publication
in the official newspaper of the City of Renton.

1256 of the City of Renton, Washington, passed by
the City Council December 10th, 1946, please be
advised that the undersigned, doing business as
Pinehurst Transit Company,.accepts the franchise
rights granted under the ordinance and I will pro-
ceed immediately in the establishment and operation
of the Renton Transit System under the terms and
conditions of the franchise ordinance.
