SUMMARY OF ACTION:
The City Council has been asked to take a position regarding the Renton School District "Building for a
Lifetime of Learning" School Improvement Bond measure to be before voters on the April 2012 ballot.
The bonds would be used by the School District to construct a new middle school, renovate the
Lindbergh pool, remodel, upgrade and improve existing school facilities, fields and play areas; improve
energy conservation; acquire additional property and make other capital improvements.

SUBJECT: 2012 Title IV Docket #8 Amendments Review
ISSUE:
Should the 2012 Title IV Docket #8 Amendments be referred to the Planning &
Development Committee and the Planning Commission?
RECOMMENDATION:
Refer the 2012 Title IV Docket #8 Amendments to the Planning and Development
Committee and Planning Commission for review.
BACKGROUND SUMMARY:
RMC 4‐8‐070G outlines the types of review the Planning Commission shall conduct. The
review of the Development Regulations (Title IV Docket) process is specifically listed.
Land Use Regulations review occurs upon Council request. The Planning Commission
will make recommendations regarding the Land Use Regulations to the Council. Final
recommendation of the Title IV Docket will be the authority of the Council.
Title IV Development Regulations
This process is codified in RMC 4‐9‐025, Title IV Development Regulation Revision
Process. Staff has compiled a series of amendments to Title IV of the Renton Municipal
Code (Development Regulations) that initiates several new regulatory initiatives that
respond to important issues facing the City. The proposed list of amendments includes
City and citizen initiated amendments as shown in the 2012 Title IV Docket #8
Amendments Table and was arrived at after consultation with the Planning Commission
and Planning & Development Committee.
CONCLUSION:
The proposed schedule for review of the Title IV Docket #8 Amendments is for the
Planning Commission review to occur during March through September 2012.

2012 TITLE IV DOCKET #8 AMENDMENTS
City (Staff, Council, Planning Commission) Initiated Amendments
Technical Amendments including:
Amend refund provisions to the code
A new Fee Schedule Brochure has recently been adopted and resulted in unintended changes to the refund
section that remains in the code. Consider removing this provision all together from the code or amending.
Definitions for adjacent and abutting
Review the code and define accurately when the term adjacent should be applied and when the term abutting is
applied. These terms are used interchangeably in the code but have different definitions.
Definitions for mobile homes, manufactured homes, and RV’s
Update the definitions for mobile homes, manufactured homes, and RV’s and identify where these different
types of residences may be permitted, based on recent legislative changes (RCW 35A.21.312(3) and court
decisions).
Definition for Reviewing Official
“Reviewing Official” is not formally defined for all of Title IV. There is a reference to a definition in RMC 4‐2‐
050D.1.d, but for that section only.
Omit zoning classification or add all the classifications for which the design guidelines apply.
Major Amendment decision by the Hearing Examiner is appealable to the City Council
Allow for an additional extension to the Preliminary PUD when an extension for the plat is approved
Add Designated Manufactured Homes back as permitted uses in residential zones
Revise land use appeal provisions to provide that the 14 day appeal clock starts to run from the date of decision
“issuance” as opposed to 14 days from the date of the decision
Off‐site street frontage landscaping installation timing for plats
CED Authority within the code
Review and identify the CED Administrator or their designee as the appropriate authority for approving projects
within the authority of CED.
Update City street lighting manual
The last update was 1993 and many significant streets related projects have occurred since, including complete
streets standards and developments like The Landing. The update will provide higher quality standards including
upgrading and standardizing fixtures for all users (ie. pedestrians and vehicles) in a consistent and cost effective
manner.
Undergrounding Ordinance
Existing code is outdated and needs a comprehensive overhaul. Specifically, developing provisions for when,
where, and how above ground utilities are authorized. Also, consider establishing provisions for the installation
of empty conduits when roads are being built for future utilities use. Provisions for the removal of telephone
poles after the undergrounding.
Vesting
Renton land use and development code is currently contained within a section that is titled “Development
Regulations”. Vesting law has shown that “development regulations” are part of the bundle of items that a
person can vest to. However, many of the sub‐sections contained within our “development regulations” are not,
in fact, what has been shown to be subject to vesting law. For example, a person can vest their project for the
number of lots, but not the landscaping that would be required to be installed. This item would shift the sub‐
sections that should not be subject to vesting to a new category called “building standards” and leave the
applicable “development regulations” as development regulations that can be vested. Include R‐10/R‐14 non‐
conformity provisions. In addition, consider R‐10 and R‐14 non‐conformity provisions which would include
eliminating or redefining or moving RMC 4‐10‐050.5B to the vesting provisions of the code. This provision
establishes vesting standards for non‐conformity that are inconsistent with the balance of the code.
Amending variance decision criteria in code to be less restrictive
The existing code establishes an extremely high standard of review for variances. Consider lowering the standard
of review to allow the City greater flexibility with respect to variance requests. (See Griffin Homes case)

Amend Water Class Map to omit Class One Waters
Because Type 1 waters are regulated by the Shoreline Management Act and consequently, the City’s new SMP,
we only need to identify and regulate Types 2 to 5 waters/streams in the balance of the code.
Reconcile overlaps and conflicts between various district boundaries
Clear up conflicts and overlaps between individual overlay maps and consider adopting a single zoning overlay
map for the City.
Adopt Hearing Examiner (HE) Rules and Procedures
Currently, there are no established rules and procedures for how the City Hearing Examiner conducts business.
This proposal will include a review of other city’s Hearing Examiner codes and make a recommendation for an HE
code for the City
Clarify the criteria that is applicable to the processing of a ham radio Conditional Use Permit (CUP).
Currently, the City code is unclear which criteria to evaluate in the review of ham radio CUPs.
Extend temporary use permits to longer than one year. Add provisions for extensions.
Allow provisions in the code for temporary use permits to be granted for more than one year when the
temporary use permit is granted for a limited period of time during the year (such as Seahawks Training Camp)
and remains consistent with the current code.
Administrative Code Interpretations
CI‐21: Clarification of sign allowances for existing legally non‐conforming businesses that are located within
residential zones; CI‐22: Requirement for Submittal of a Floodplain Habitat Assessment (also known as a
“Biological Assessment” or “Critical Areas Study”) and Mitigation Report for projects located within the
floodplain that is consistent with the FEMA 2010 Floodplain Habitat Assessment and Mitigation Regional
Guidance); CI‐23: Clarification of the expiration period for the Hawk’s Landing Master Site Plan approved by the
Hearing Examiner on September 10, 2009. City File number LUA09‐060, ECF, SA‐M, SA‐H; CI‐24: Permissible
zones for limousine service; CI‐25: Permissibility of adding macro and mini facility antennas to existing
conforming wireless support structures as an outright permitted use
King County Transfer of Development Rights (TDR) and Interlocal Agreement
Pursue policy and regulatory changes that would limit the authority of King County to utilize TDRs within the
City’s PAA when inconsistent with the City’s planning and zoning for the area.
Accessory Dwelling Units (ADU) Review
Review approved ADUs and based on the review, consider changes to ensure future ADUs are consistent and
compatible with the residential neighborhoods in which they are located.

SUMMARY OF ACTION:
The Facilities Division provides maintenance and small project management services to Fire District 40
as part of the agreement between the District and the City's Fire and Emergency Services Department.
The District is undertaking, at their expense, the reconstruction of Fire Station 17, which is 41 years old.
The District wishes to use project management services also provided by the Facilities Division. They
will pay a fee of five-percent (5%) of the total construction costs for the work, including change orders.
The fee is estimated to be $60,000.
STAFF RECOMMENDATION:
Authorize the Mayor and City Clerk to sign the Memorandum of Understanding with King County Fire
Protection District 40.

SUBJECT:Memorandum of Understanding between the City of Renton
and King County Fire Protection District #40 for Construction
Project Management Services
Issue:
Should the Council authorize the Mayor, City Clerk and City Attorney to sign a
Memorandum of Understanding compensating the City of Renton to provide project
management for the reconstruction of Fire Station 17? King County Fire Protection
District #40 (District 40) would compensate the City of Renton five percent (5%) of the
total reconstruction costs to provide these project management services.
Recommendation:
Council authorize the Mayor, City Clerk and City Attorney to sign the Memorandum of
Understanding with District 40.
Background:
·The City provides fire and emergency services to District 40 per the terms and
conditions of CAG-08-015.
·This agreement also includes facility management services for the maintenance and
repair of Fire Station 17, which Is wholly owned by District 40.
o Repairs up to $5,000 each are the responsibility of the City.
o Repairs over $5,000 and capital improvements are the responsibility of the
District.
·About a decade ago, voters in the district approved a levy that included funding of
the reconstruction of Fire Station 17, which was built in 1971.
o Certain functions of the station have been obsolesced by the building of Fire
Station 13 nearby as well as the systemic approach created through the
operation of the District by the Renton Fire and Emergency Services
Department.
o The station suffered seismic damage in the Nisqually earthquake, and also
needs to be upgraded to meet current seismic code levels.
o The mechanical systems need replacement.

o The sleeping quarters and bathrooms need to be altered to achieve
appropriate gender separation.
o The kitchen, day room, and workout areas need updating.
·Altogether, the reconstruction will cost approximately $2,000,000 for soft and hard
costs.
·The project is scheduled to enter the construction phase this summer.
·The District recognizes the experience of Renton’s Facilities Division in project
management of Fire Stations and requests that the City perform this function on
behalf of the District. The total compensation fee will be roughly $60,000 depending
on the accepted construction bid and change orders.
·Over the last five years, the Facilities Division has cross trained managers to perform
project management of increasingly complex projects. This has created more
internal capacity and flexibility to manage capital projects.
·The level of the City’s Facility Capital projects is expected to be limited in 2012,
providing an opportunity to participate with the District in the Fire Station 17
project.
·The District’s alternative would be to hire an outside project management company.
This alternative is not preferred by either party. If chosen, there would still be a
significant investment of City facility employees’ time to fill the project manager’s
learning curve regarding the City’s specifications and requirements for fire stations.
·The District was involved in the creation of the Memorandum of Understanding, as
was the City Attorney and the City’s FIT Administrator.
Conclusion:
This Memorandum is the most efficient way for the District to receive project
management services and it fairly compensates the City for providing them. The result
will benefit citizens in both the District and the City, and it will enhance the overall
operations of the Renton Fire and Emergency Services Department.

MEMORANDUM OF UNDERSTANDING
By and Between
The City of Renton, Washington
And
King County Fire Protection District #40
This memorandum of understanding is entered between the City of Renton, Washington
(CITY) and King Country Fire Protection District #40 (DISTRICT), a State of Washington municipal
corporation, to mutually address the project management of the proposed reconstruction of
Fire Station 17, located at 14810 Petrovitsky Road, Renton, WA 98058.
WHEREAS, on March 1, 2008, the DISTRICT entered into a long-term contractual
relationship with the CITY, described in CAG-08-015, to provide fire and life safety services to
the citizens of the DISTRICT, and
WHEREAS, the Contract provides that the District shall be responsible to fund all major
capital repair and replacements (above $5,000.00), and
WHEREAS, the City’s Facilities Division has the requisite experience and expertise to
provide project management services on behalf of the DISTRICT for the reconstruction of Fire
Station 17 that are entirely consistent with the operational and maintenance standards of the
Fire and Emergency Services Department , and
WHEREAS, the City’s Facilities Division is positioned to coordinate auxiliary requirements
for I.T., Signals, and emergency ham radio operations,
NOW THEREFORE, the parties agree as follows:
1.The CITY agrees to provide a Project Manager, in this case the Facilities Director and his
designees as necessary, to fulfill the responsibilities of project management as listed
below. The duty of the Project Manager will be to represent the best interests of the
DISTRICT and the Fire and Emergency Services Department during the design
development, construction, and commissioning phases of the Fire Station 17
reconstruction. This duty shall include participation in all design meetings with the
Architect and plan review sessions with the permitting authorities; support to the
Architect for the plan specifications and bidding requirements documents; review of the
bids and the bid documentation; attendance at the regularly scheduled construction
meetings with the Architect and the Contractor; review of proposed change orders and
recommendations to the DISTRICT via the Commissioners on the Facilities
Subcommittee regarding acceptance or rejection of those change orders; review of the
Architect’s stamped pay applications with recommendation to the DISTRICT; and
coordinate all ancillary activities that will allow Fire Station 17 to continue full time
service with maximum effectiveness and efficiency and minimum disruption; review
with technical staff the commissioning of all mechanical systems; insure the delivery of
required Operations and Maintenance manuals.

2.The DISTRICT agrees to reimburse the CITY 5% of the project’s Construction Costs as
these are detailed by TCA Architecture Planning, those costs entirely subject to
Commissioners’ approval.
The parties agree that this Memorandum of Understanding is made in the spirit of cooperation
in order to facilitate the orderly progression of planned capital improvements to Fire Station 17.

SUMMARY OF ACTION:
Reid Middleton, Inc. is the Airport's consultant for the engineering and design of the Taxiway Bravo
Rehabilitation Project. Reid Middleton has provided a Scope of Work for a new contract to complete the
Engineering and Design Engineering Phase II. The contract amount is $415,297, which will be partially
funded through a 95 percent FAA grant of $150,000, awarded in September 2011. The remaining
$265,297 is budgeted in the Airport CIP Taxiway Bravo Rehabilitation Project with a 2012 budget
amount of $2,079,000.

RECOMMENDATION:
Authorize the Mayor and City Clerk to execute the consultant agreement with Roth Hill,
LLC, in the amount of $201,400, for engineering services for the 2012 Hydraulic Model
Update project and approve the proposed 2013 Capital Expenditure for this project, in
the amount of $200,000.
BACKGROUND SUMMARY:
The Wastewater Utility established its current sanitary sewer hydraulic model in 2002.
This model was developed in conjunction with flow monitoring performed by the King
County Wastewater Treatment Division (WTD) in 2000 and 2001. WTD has just
completed its 10-year update of the flow monitoring, referred to as Decennial Flow
Monitoring. With this updated flow information, the time is right for the City’s
Wastewater Utility to update its sewer model with this new flow data.
Roth Hill, LLC established our original sewer model and has the qualified staff to perform
the update to the model. They will calibrate flows based upon current flow monitoring
and provide better long-term estimates for projected growth based upon 2010 census
data provided by the Puget Sound Regional Council, Renton planning staff, and King
County planning staff. This will allow the Wastewater Utility to better project when
capital projects will be needed in our system due to flow constraints. It also allows us to
evaluate potential changes in zoning and land use to determine what impacts they might
have on the sanitary sewer system.

To update the model it will take two years, both 2012 and 2013. The Wastewater Utility
has a current 2012 budget of $100,000 in its Hydraulic Model project account
(426.465140) and is proposing an additional $200,000 in 2013. This addition in 2013 will
cover the contract amount of just over $200,000 plus provide additional funds that may
be needed if it is determined that additional flow monitoring is required to properly
calibrate the sewer model. In order to approve the contract, Council must also
authorize the proposed spending in 2013.
Roth Hill, LLC was selected from the approved 2012 Utility Systems Annual Consultant
Roster to perform this work.
CONCLUSION:
It is appropriate for the Wastewater Utility to calibrate its sanitary sewer model about
every 10 years to assure the accuracy of the model. The proposed consultant
agreement covers services for both 2012 and 2013 and the total dollar amount exceeds
$100,000. As such, it is necessary for Council to both authorize the Mayor and City Clerk
to execute the contract and to approve the proposed 2013 capital funding for the 2012
Hydraulic Model Update project, in the amount of $200,000.

SUMMARY OF ACTION:
The Wastewater Utility requires engineering consultant services to design the replacement of the Misty
Cove lift station located just north of the Seahawks’ facility, along Ripley Lane North. The contract
covers review of existing and proposed future uses in the service area for the lift station. A site
analysis, including evaluation of co-locating this facility with the Misty Cove Condominium complex will
also be included.
