MAINTENANCE AGREEMENT RE PRIVATE SEWER PUMP STATIONS i ;-,
WHEREAS Ch�pter 173-240 WAC requires municipalities to
�- - own and operate all sanitary sewer systems within the
Municipal boundaries, including non-gravity sidesewers, and
WHEREAS certain properties may not be, served by gravity
sidesewers but require ir?dividual or group pump stations,
and
WHEREAS the maintenance,, operation and repair
� liabilities for tYiese systems are substantially greater than
� those for gravity sidesewers, and
� WHEREAS refusal by �he City of �tenton to permit these
� small pump stations would prevent the development of certain
� properties, and
� WHEREAS the undersigned is the owner of one such
� property and wishes to develop or has developed that
� property on service provided by a small pump station, and
WHEREAS WAC 173-240-104 permits the City of Renton to
rzquire the owner of properties served by a small pump �
station to provide operation, maintenance and repair to that
��stem,
NOW THEREFORE the City .•of R�nton and the undersigned do
agree aa follows: �

. 1 . The undersigned will operate, maintain and repair the
� pump station serving the undersigned' s property, which
. � property is more particularly described as follows:
�..} ` See Attachment "A" which is incorporated herein by 'I
reference as if fully set forth.
2. Should the under.signed not adequately operate, maintain
� � or repair the pump station, then the undersigned grants
. to the. City of Renton or its agent, authority to enter '
upon the property legally described in Attachment "A"
and the property where the pump station is located in
order to keep the station in good operating order ,
maintenance and repair. The City of Renton shall be
the sole judge of when it is necessary for the City or
its agent� to enter upon the undersigned' s property or

� the property wherein the pump station is located.
3. The undersigned agrees, should the City find it
necessary to undertake the operation, maintenance and
repair of the pump station, to pay all costs and fees
associated with the maintenance, operation and repair
of the pump station, including �ppropriate markups for
City of Renton overhead and other charges.

4 . The undersigned agrees that the City may charge to the
� property owner as part of the property owner' s next
utility billing a12 amounts incurred under this
agreement f�r City costs and fees for maintenance,
, operation and repair of the pump station.
5. If the pump station serves more than one residence,
Q� then each property served by the pump station shall be
4D jointly and severely liable for the full amount of the
� costs of maintenance, operation and repair and the City
� shall not be obli ated to prorate the expenditures in

� any f ashion, that function being left to the property
owners as a private agreement not involving the City of
�
� Ren ton.
� 6. Should the City feel that the maintenance, operation
� and repair of the private pump station becomes a
continuing problem, then the undersigned agrees to
enter into a maintenance contract with an independent
firm for the maintenance, operation and repair of the
station, which contract shall provide for private
payment by the undersigned to the independent firm.
However , should the undersigned not pay, then the
undersigned agrees that the billing £or the

independent firm may be added to the utility bills as
an additional charge.
' 7. Any charges made to the utility bill which are not
paid, will result in a lien against the property as
provided for all utility bills and the cost thereof may
be foreclosed in the manner provided for all past due
utility bills as more specifically detailed under the
Renton Municipal Code.
8. Should the City of Renton find it necessary to use an
attorney to collect upon any unpaid utility bill or
any unpaid fees, charges, markups or costs hereunder,
then the undersigned agrees to pay a reasonable
attorney' s fee for such collection effort even if such
effort does not result in a lawsuit being filed.
9. This agreement shall be recorded, shall run with the
land and shall be in full force and effect as long as
the property described in Attachment "A" is being
serviced by a mechanical system for sewer pumping. .
