NOW, 'THEREF4RE, in consideration of the sum of 4ne Dollar, (51,00) and other good and valuable
consideration, the receipt and sufficiency of which is hereby acknowledged, the �rantors, for themselves, their heirs,
administrators, executors, successors and assigns, �o hereby grant unto the City of Renton, Washington, hereinafter ca�ed
the Grantee,its successors and assigns, for the use and benefit of the pubhc, an easemerrt and right of way, appurtenant to
Renton Municipal Auport for the unobstruc�ed passa�e of all aircraft �`aircraft" being defined for the purpase of this
instrument as arry contrivance now kzo�vn or hereafter invented, uscd or desig�ed for navigation of or fli�t in the aair), by
whomsoever owned and operated, in all airspace above Grantors' properiy above an imag�nary plane rising and extending in
a generaIty southerly ci�rection oveT Grantors' progez�, said imaga�ary pla�e ratuling fr�� a�tproxitna�e:�� t�e�tty-:t�c (29 j
feet abnve mean sea level above Point A on Exibit A at the rate of one foot vertically for each thirty-four (34) feet
horizontally, to approximately thirty-nine (39) feet above mean sea level above Point B in Exhibit A, to an infinite heig�t
abave said imag�nary plane, together with the ri�t to cause in a� airspace above the surface of Grantors' properry such
noise,vibrations, fumes, dust, fuel particles, and all other ef�ects that may be caused by thc operation of aircraft landing at,
ar taking off from, or operaang at or on said Renton Municipal Airport, and Grantors do hereby �Ily waive, remise, and
release arry ri�t ar cause of action �vhich they may now have or which t�ey may have in the future against Grantee, its
s�.iccessors and assi�ns, due to such noise,vibrations, fiunes, dust, fuel particles, and all other effects that may be caused or
may hav�be�n caused by the operation of aircraft la�liing at, or takuig off from, or operaring at or on said Renton Municipal
.a.u�port.

The easement and right of way hereby granted includes the c4ntinuing right in tlie Grantee to preuent t�le
erection or growth upon Grantors properly of any building, structure, tree, or other object, extending into the
airspace above the aforesaid imaginaty plar�e, and to remove from said airspace, or at the sole optian of t��e
Gi-antee, as an alternative,to mark and light as obstructions to air navigation, any such building, struucture, tree or
other objects now upon, or which in the future my be upon Grantors property, to�ether with the right of ingress to,
egress from, and passag,e o�er Grantors property for the abave purposes.
Ta HAVE AND TD H�LD said easement and right of wa.y, and a11 rights appertaining thereto unto the
Grantee, its successors, and assigns, until said Renton Municipal Airpart shall be abandoned and sha11 cease ta
be used for public airport purposes.
AND for the consideraiian hereinabove set forth,the Grantors,for themselves, their heirs, administrators,
executors, successors, and assigns, do hereby agree that for and during the life of said easement and right of way,
they will not hereafEer erect, permit the erection or grovvth of, or permit or suffer to remain upon Grar�tor's
propet�ty any building, structure,tree or other object extending into the aforesaid prohibited airspace, and that t�iey
shall not hereafter use or permit or suffer the use of Grantor's property in such a manner as to create electrical
interference with radio communication betc�een any installation upon said airport and aircraft, or as to make it
t''�ifficult for flyers to distinguish between airport lights and oth�rs, or as to irapair visibility in the vicinity of the
�irport or as otherwise endanger the landing,taking off or maneuvering of aircraft, it being understood and agreed
�hat the afaresaid covenants and agreements shall run with the land.

erection or growth upan Grantors property of any building, struch�re, tree, ar other object, extending into the
airspace above the aforesaid imaginary �lane, and to remove from said airspace, or at the sole option of th:
Grantee, as an alternative,to mark and light as obshvctions to air navigation, any such buildin�, structure, tree or
other objects now upon, or which in the future my be upon Grantors property, to�ether with the right of ingess ta,
