assigns of lots and property within the tract of real property legally described as: �

of King County,Washington;said short plat being the west half of tract 29 of C.D.Hillman's Lake Washington Garden
of Eden Division No. l,according to the Plat thereof recorded in Volume 11 of plats,page 63,in King County,Wash-

This agreement is for the use and benefit of the land and is a covenant running with the land.
' � All parties to this agreement.acknowledge and recognize that the City of Renton has no re-
++� sponsibility to build, improve, maintain or otherwise service the roads contained within the above
� described short plat.
� '��:e parties t�this 2greement agree and covenant that said owners, their grantees, successors
� and assigns will maintain the e�sting blacktopped private drive which is within the above described
� tract of property according to the following terms and conditions:
� 1. Any person(s)who own(s) one or more lots serviced by said road as described above I
shall be a member of the Road maintenance Agreement Association(hereinafter
RMAA). RMAA shall be responsible for maintaining the above described road.
"Maintenance" as described in this agreement, shall include the removal of �
obstructions, plant overgrowth and miscellaneous debris, the filling of holes, adding ,
gravel, �rading and the performance of any other labor or furnishing of materials
� necessary to maintain the road in reasonably good condition.
2. Expenditures. Expenditures for ma.intaining said private road must be authorized by a
vote of RMAA members. Voting shall be on the basis of one(1) lot - (1)vote. �

NOT WITHSTANDING TI�FOREGOING, said private road must be maintained by the
RMAA in reasonable good condition including drainage, filling of holes, removal of
obstructions and grading.
3. Liability, for costs. RMAA members shall be liable for expenditures for road
maintenance as specified above on the following basis:

I This agreement is provided to obtain a variance from the City of Rentan raad standards.
As such, it is enforceabie by the City of RentQn.
