W I T IV E S S E T H I
WHEREAS OWNER has heretofore applied unto CITY for a certain
variance permitting OWN£R to erect and construct a certain building on
OWNER° S property� which propertye however, does not abut upon a public street
� as required by the laws and ordinances of the CITY OF . RENTON and

� WHEREAS CITY, by and through its Planning Commission9 is w�.11ing
to issue and deliver unto OWNER a variance, subject to certain terms and

� NOW THEREFORE9 it is hereby agreed and .covenanted as followse
� lo CITY agrees to issue and deliver unto OWNER a variance to
permit OWNER to construct certain improvements on property described in said �
varianc�o It is realized that such proposed improvement does not aubt upon
a public street as requ�.red by the laws and ordinances of the CITYo OWNER9
therefore, agrees and covenants to execute and del,i�er, simultaneously with
this AGREEMENT and its execution9 a proper QUIT CLAIM DEED granting and conm
veying unto the CITY �the following described propertyo

2o OWNER further covenants and agrees to construct, improve and
pave said right-of�way a11 as more particularly specified in CITY°S somcalled
Subdivision and Platting Ordinance Noo 1688 , all at OWNER° S sole cost
and expense9 or in the alternative , OWNER agrees to affirmatively particim
pate in a I�ocal Improvemen-t Dist�rict rela-�ive to improvement of said right-
of�way and other adjoining street rightsmof�way� and said Local Improvement �
District may be initiated on the part of the CITY or by petition by OWNER
and o�her property owners in subject area� and OWNER covenants and agrees to
join in any such petition and/or tc� support any such Resolution for such im�
provements and to pay his fair share thereof as may be determined by the
CITY, all as provided by lawo It is expressly understood and agreed that
the CITY° S acceptance of said Quit Claim shall no� be cnnstrued as an imm
postition of ,liability on the CZTY to make any such improvements ; that such
