COVENANT AND GRANT AGREEMENT FOR
PARK DEVELOPMENT
This Grant Agreement is entered into between King County ("County") and the
City of Renton ("City"), which parties hereby agree to the following:
A. Purpose
The purpose of the Agreement is to provide funds to assist the City to
acquire recreational facilities for public use.
B. Nature and Location of Development
The property which will be acquired by the City under this Agreement is
located within the Springbrook Elementary School service area. The Acquisition
Will be completed by May 31, 1994.
C. Park Property
The Acquisition will be real property situated in Section 6, Township 22,
Range 5 in the County of King, State of Washington.
D. Restrictions on Property
The City, its officers, agents, employees, grantees and assigns, covenants
that the property described above shall be maintained by the City in a manner
that allows and provides the opportunity for public use of the property.
The covenant shall run for fifteen (15) years from the date of this
Agreement, and shall run with the land.
E. Procedure for Acquisition and Funding
King County shall pay to the City the cost of the Project to a maximum of
SIXTY FIVE THOUSAND THREEJUNDRED EIGHTY EIGHT AND NO/100 DOLLARS ($65,388.00) .
The cost to the County for administering this Project has already been deducted
from the fees collected pursuant to KCC 19.38.
F. Ownership, Access and Maintenance
Upon the Acquisition of the property, all ownership rights and maintenance
responsibilities shall be the City's.
G. Bidding and Contracting
The City shall be responsible for complying with all applicable public
bidding and contracting laws; provided, that if the County would - have been
required to award any contract awarded by the City hereunder through a
competitive bidding process, the City shall itself follow such a process;
provided further, that any such competitive process followed by the City shall
at a minimum follow the statutory requirements the County would have had to have
followed in awarding such contract, including those relating to public

advertising, licensed contractors, contractor bid and performance bonds,
retainage, the payment of prevailing wages, and the award of such contract to the
lowest responsible bidder. In addition, the City shall ensure that all
applicable requirements of King County Code Chapters 4.18 (relating to minority
and women's business enterprises) and 12.16 (relating to affirmative action),
which chapters are attached hereto as Exhibits C and D, are strictly followed,
particularly with respect to any contracts the City may award hereunder.
H. Hold Harmless
The City agrees to hold harmless, indemnify and defend at its own expense
the County, its officers, agents, and employees, from and against any and all
claims, judgments, actions, suits, liability, loss, costs, expenses, or damages
arising out of or in any way resulting from the negligent acts or omissions of
the City, its officers, employees and/or agents, in the course of its performance
under this Agreement.
The County agrees to hold harmless, indemnify and defend at its own expense
the City, its officers, agents, and employees, from and against any and all
claims, judgments, actions, suits, liability, loss, costs, expenses, or damages
r omissions arising out of or in any way resulting from the negligent acts 0 o of
the County, its officers, employees and/or agents, in the course of its
performance under this Agreement.
If any claim, judgments, actions, suits, liability, loss, costs, expenses,
or damages. arise out of or result from the joint negligent acts or omissions of
both the County and the City, each party shall be responsible for its own share

of any resulting liability.
