The surety deuice for the installation will be released once successful installation of the project
has been confirmed. The maintenance and monitoring surety will be reieased upon successfui
campletion of the 5-year mitigation pian. In order to assure the quickest possible release of
yaur surety device for maintenance and monitoring, please ensure prompt monitoring and
maintenance are performed for the duration of yaur manitoring period. If at any time during
your minimum five-year monitoring period the mitigation project fails below performance
standards, the monitoring period wiil be placed on hoid. �nce the mitigation project regains
compliance with approved performance standards, the maintenance and monitoring timeframe
wiN restart for a period necessary to establish that performance standards have been met.

Mitigation Installatian and Approval: Once the wetiand mitigation has been installed (piants,
signage, fencing, etc.} pursuant to the appraved plan, please have yaur wetlands specialist
provide me with written verificatian that the instaHation is in canformance with the approved
plan.
As Built Plans for the Mi#igatian Area: A copy of the as-built plans of the appraved mitigation
plan, prior to recording; unless an installation surety device is provided or if plantings are
installed as exactly per plan.

Monitoring and Maintenance Period Start Date: Once the mitigation project has been
installed, please provide me with the wetland consultant's written confirmation of installation
pursuant to the final approved mitigation plan. The date the City receives this written
confirmation will constitute the beginning of the minimum 5-year maintenance and monitoring
period.
Wetland Information Needed on Final Plat Map: RMC Section 4-3-050G3 requires that all
critical areas and their buffers be placed in either a Native Growth Protection Tract or Native
Growth Protection Easement.

ASSIGNMENT OF FUNDS
SEATTLE BANK, formerly known as SEATTLE SAVINGS BANK, a Washington state-
chartered stock savings bank (the "Bank"), has on deposit the sum of EIGHTY-TWO
THOUSAND ONE HUNDRED FORTY and No/100 Dollars ($82,140.00) to cover the
following:
Project: Ribera Balko Short Plat(City of Renton File LUA02-129)
Location: 4225 NE 4th Street, Renton, WA
Required work: Monitoring and Maintenance of structures, improvements and
mitigation required by conditions of permit.
The Bank hereby certifies and agrees that these funds will not be released without written
instructions from an authorized agent of the City of Renton(the"City"). We further agree that
these funds will be paid to the City within ten(10) days of receiving Notice that the City has
determined that the work has not been properly performed. The Bank shall have no duty or right
to evaluate the correctness or appropriateness of any such notice or determination by the City
and shall not interplead or in any manner delay payment of said funds to the City.
Langley 4`h Avenue Associates, LLC (the "Applicant") hereby agrees to this Assignment and
that its obligation to perform the required work is not limited to the amount of funds held by the
bank.
This Assignment is irrevocable and cannot be cancelled by the Bank or applicant. These funds
may not be assigned, pledged, used as security or otherwise made available to the Applicant,
Bank or a third party without the prior written consent of the City.

Dear Mr. Ebensteiner:
Mitigation Plan Approval: We have reviewed and approved the final wetland mitigation
plan/monitoring proposal for the Whitman Court PUD, which incorpocates the completion of .
the mitigation for the Ribera Balko Short Plat, received by the City on October 2,�2014. I have
enclosed an approved copy for your records. The mitigation project shall be installed in
conformance with the approved .plan prior to recording or a separate surety device shall be
provided.

Mitigation Installation and Approval: Once the wetland mitigation has been installed (plants,
signage, fencing, etc.) pursuant to the approved plan, please have your wetlands specialist
provide me with written verification that the installation is in conformance with the approved
plen..You may be planning on installing the mitigation project after the plat records or the Final
PUD is approved; in order to provide you with the. amount of security necessary for the
installation of the plantings, signage, fencing; we will need a copy of the signed installation
contract for this work. Once the City approves the contract proposal, the applicant will need to �
provide an installation surety device (a letter of,credit or irrevocoble set_oside letter) set at an
amount totaling 125%of the cost to guarantee the installation of the mitigation project. ,
As Built Plans for the Mitigation Area: A copy of the as-built plans of the approved mitigation
plan, prior to recording; unless an installation surety device is provided or if plantings are
, installed as exactly per plan. "
Monitoring and Maintenance Surety Amount: In order to provide you with the amount of
security necessary for the maintenance and monitoring of the wetland mitigation plantings,
signage, and fencing, we will need a copy of the signed maintenance and monitoring contract �
for this work. A draft (followed by a final) maintenance and monitoring contract (or contracts)
for our review prior to execution of the coritract shall be provided. The draft contract language
must ensure compliance with both the performance standards of the Altmann Oliver Associates,
mitigation plan as well the maintenance and monitoring standards of the Renton Municipal

Code. The scaqe of the contract must clear(v cover the cost af q(ant maintenance and
rep/acement as weli. The langua�e in the contract must aiso �uarantee that "structures.
