TRAFFIC SIGNAL P(3LE F•ASEMENT
THiS EASEMENT, dated the 30th day of July , 1.968,
�..�„ by and between UNION OIL COMPANY OF CALIFaRNIA, a corporatioa, hereinafter

� termed "Grantor", and CIZ`Y OF REi�TON, a municfpal corpora�ion of King
� County, Washington, hereinafter termed "'Grantee",

W Z T N E S S E T H:
' FOR GOOD AND VALID CONSTDIItATI4N, the receipt and adequacy of which
� heraby are aclmowledged, Grantar, hereby grants to Granree the non-exclusive
easement and right of way tio construct, maintain, operate, repair, renew and
remove traffic signal pole and necessary fixtures and appurtenances, as
Grantee may from time to time require, hereinafter termed "�aci2ities", sub-
ject to the terms and provisions herein, that certain real property s£tuated
in the County of Ki.ng, State of Washington, described as follows, to wit:
The north 5 f�et of the east Z.50 feet of Lot
13, Block 10, Renton Farm Piat, according to �
the Plat recorded in Voiume 1(} of Plats, Page
97, Records of King County, Washington.
_ Reservations: Grantor hereby reserves the right to enter upon
said easement and right of way, from time to time, to construcC, maintain,
aperate, renew and remove, in, upon and across said easement and righti of way,
pipelines, electrical, power and telephone lines, roads, fences and necessary � I
fixtures and app�rtenances, and the right to use said property for any and a11
purposes, provided, however, that Grantor shall not use said property or con-
struct or mainCaia any such equipment, fixtures or improvements on said
easement and right of way in a manner which would unreasonahly interfere with
the use of said easement and ri.ght of way by Grantee.
Prior RigLhts: It is understood and agreed that the pexmi.ssion and
privileges herein granted are subordinate to and subject to all valid and
existiag 2icenses, leases, grants, excegtions and reservations affe'cting said
premises. �

, Terms and Char�es: Crantee shall pay, before the same become delin-
quenC, all taxes, charges, rates and assessments ievied upon or against any
and all Facilitiies placed by, or for, Grantee on said property, and the Grantee
sha11 reimburse Grantor for any sums paid by Grantor to protect Grantor's I

� titile from the lien of any such tax or assessment.

p Construction and Maintenance: Grantee shall and will construct, xe-
e?'
� canstruct, maintain and operate said Facili.ties so as noti to interfere with
any existing pipeline or pipelines, power lines, telephone lines or other
,
structures in or on said premises, nor obstruct the use or enjoyment of sa3.d
premises by Grantor. Grantee sha11 restore the surface of said premises as
nearly as possible to the same state and condition it was in prior to any
construction hereunder.
�eraCions: Grantee, in the exercise of the rights granted to it
hereunder, sha11 not do or permit �o be done any welding or operations �n-
volving sparks or flame within a distance of 300 feet from any oil or gas
weli, or oil, gas or gasoline container, or place of discharge to aCmosphere ,
of oi2, gas or gasoli.ne, whether iocated on the premises or on adjacent lands,
withou� prior consent of Grantor, and then only sub�ect to and in accordance I
with the provisions hereof and such other conditians as may be expressed in
said consent.
Termination: ZC is hereby agreed that the easement and right of way
hereby granted sha11 terminate in the evenC thar Grantee shall fail for a
period of one year to maintain and operate the Facilf.ties constructed here-
under. �I
Indemnification: Grantee hereby releases and discharges Grantor '
from all claims and demands by Grantee for loss of or damage to Grantee's II
property, and agrees to indemnify Grantor against and save Grantor harmless
from ail costs and expenses, including at�orney's fees, and all Iiability,
and claims and demands of others, for Zoss of or damage to property, or

Grantee and sha].1 not be assigned by Grantee, in whole or in part, without
the prior written consent of Grantor. No such written consent by Grantor
hareunder shall be cteemed a waiver bq Grantor of any of the provisions hereof �
not specifically waived by such consent,
.Notice: Any notice provided for herein to be given by either party
to the other may be served by depositing a seal.ed envelope containing a copy
of such notice, addressed to said other party at their principal place of -� I
business, in the United States mail, postage prepaid. {
Successors and Assi�ns: Except as atherwise provided harein,
the terms and conditions of the agreement shall inure to the benefit of
and be binding upon the successors and assigns of the parties hereto.
