� CoMpany a Railroad Protective Liability�Policy in the form attached to

In the. event the construction or maj.ntenance of s aid highway
and grade crossing may interfere with o'r create a hazard to the comrninication,
� signal, or electric-power lines� called "facilities" in the r est of this .
paragraph� of the Railway Company� The 4Jestern Union Telegraph Compar� or
any, other party using the Railway Company's proper-�y, the City or .its �
contractor shall give the Railway Compar�y sufficient advance notice of such -
possible interference or hazard to enable the; Railway Company or its per-
mittees to permanently relocate or temporarily relocate and permanently
restore the affected facilities at its or their option. In the even� the
Railway Compar�y, its permittees or any of them shall permanently relocate
or temporarily relocate and permanently restore the affected facilities, �
the �l�y shall; �ay all cost of such work, includin� maintenance of any
tem�rarily relocated facilities, upon receipt of bills therefor. '1'he
�� 3' shall also pay to the Railway Company or its permittees, as the
case may be� the cost of repairing or replacing the facilities on account '

AlI the work herein provided to be done by the Cit� or any

� satisfactory to the Railway Company and shall.be performed at such time
and in such manner as not to interfere unnecessarily with the movement of
� � trains or traffic upon the tracks of the Railway Company. The City : . �
sha12 require its Contractor to use all� care �nd precaution necessary to '
avoid accident, damage or interference to the 'Railway Company tracks 'or
to trains or traftic using its tracks and to notify the Railway Company - �
a sufficient time in advance whenever the Contractor is a?;out .to perform '
. • work on or adjacent to the right of way and t�acks, to enable the Railway
Company to flzrnish flagging and such other protective services as might
be necessary to insure safety of Railway Company's operations; and tHe

RAILWAY COMPANY ,
Flagging and other protective services and devices wiil be grovided by the �
Company to protect its facilities, property and movements of its txains or
engine.
In general, the Company will furnish such flaggtng or other protec�ive services
and devices;
{a) For any excav�tion below elevation of Crack subgrade, i£, in the opinion of .
the Company�s reprssentative, track or other railraad facfliCies may be
subject to settl�nent or rnovement. -
(b) Durin� any clearing, grubbing, grading or blasting in proximity to the
xailroad, which, in the opinion of the Company�s representstfve, may
endanger or fnterfere �rith the railroadts faciiities or operation.
(c) When any of the Contractor�s operatians are carried on or within Che Rail-
road Company�s right of way and in the opinion of the Company's representa-
tive could endanger Company�s facilities or create a hazard to the Company's
operations.

Attached is an easement �rom the Northern Pacific Railroad for
the street crossing of Lind �ts��87th Avenue So.) to Grady Way.
This is part of an approved Urban Arterial Project and the easement
cost of $4950.00 will be funded from this fund. The City Attorney
has reviewed this instrument and it is the recommendation of the
Engineering Department that it be accepted by the City and the
Mayor and City Clerk be authorized to sign.

Letter from City Engineer Wilson submitted Easement from the Northern

SCHELLERT , SECONDED BY BRUCE, TO CONCUR IN THE RECOMMENDATION OF THE CITY

AUDIENCE COMMENT �
Mr. Dick Stredicke , 3916 - 10th Ct . North , inqui�ed regarding street
improvements noting great need �or the Grady Way work approved earlier
and for work on E stree� going North to Sunset . It was pointed out by
the Mayor that this is State Highway and that the City has done some
work on 5'�nset; that hearings held by the State regarding widening to
a 4-Iane facilitj have been in progress and improvements are anticipated .
Del Bennett , Traffic Engineer ,noted that in meeting with the State Highway
Department plans cal.Zing for paxticipation in Sunset Highway work are for
hlau 1971 bids , signals at 12th and Sunset being designed in advance and
�o be budgeted for 1970 but any substantial work and the widening b� the
State , aZong with the Map1e Va11ey Highwar� (December) , to be in 1971 .
5treet Commissioner Vic TeGantvoort reported that the City wi11 be doing
some 1eve11ing and maintenance work on Sunset durinq Ju1y , but .the new
construction is sc�heduled as xeported. Barei inquired regarding work on
Benson which Traffic Engineer Bennett reported could be expected within
the next biennium: .

Mr , Frank Storey inquired regarding pedestrzan walkway at North Renton '�
Interchange proximity ,and was advised that nothing new has transpired,
the State having previously advised that when the City built �pproaches
the State would produce its wo�k . Mayor Custer noted that funds which �
had been anticipated for possible use on this project had to be expended I
for unexpected maintenance and snow removal and the limited work the
city could do would not be what is desired , Iimited access , barrier
instalZations and feasible improvements and anticipated use having been
the subject of much discus�ion , antici�ated cost of $80 , 000. 00 requiring
some warrant of utilization, lqcation also to be determined . Mre Storey
noted that with the opening of the Lake Wn . Beach Park he felt it to be
a matter of time before someone is hurt .
APPOINTMENT
Letter from Mayor Custer requested concurrence in the appointment of
Tony Romano to rank of Lieutenant in the Renton Police Department , the aiX-
months probationary period ,as required by Civz1 Service Ru1es and Requla--
t'i ons ,to commence a s of Ju 1 y 1 6 , .Z 969 . MOVED BY GRANT , SECONDED BY BAREI ,
TO CONCUR IN THE APPOINTMENT. CARRIED. Letter from Police Chief Williams
approving the appointment and Civi1 Service Commission Certification were
attached .
OLD BUSINESS BY COUNCIL
Mayor Cust�r requested to meet with the Committee of the Who1e following
this evening 's council meeting and President Perry confirmed such meeting.
SANITATION COMMITTEE MEMBER PERRY submitted report recommending that King
County Franchise No . 617 concerning sewer trunk to Sierra Heights School be
accepted and officials be authorized to execute any necessary documents .
MOVED BY SCEHLLERT, SECONDED BY BRUCE, TO CONCUR . CARRIED.
STREET AND ALLEY COMMITTEE CHAIRMAN GARRETT reported recommendation that
request of Shelton Avenue residents to block off 1Z00 B1ock for picnic
on August 2 , from 3 :00 p.m, until 9 : 00 p.m . be granted under supervision
of the Street Conimissioner . MOVED BY BAREI, SECONDED BY MAXIR�, TO CONCUR
WITH EXECUTION OF HOLD HARMLESS kGRE'EMF,NT. MOTION CARRIED. '
