hereinafter called "Grantor(s)", and the CITY OF RENTON, a Mimicipal Corporation
of King CoLmty, Washington, hereinafter calle�d "Grantee".
4VITNESSETH:

paid by Grantee, and other valuable consideration,
do by these presents, grant, bargain, sell, convey, .and warrant wito the s.aid
Grantee, its successors and assigns, a temporary construction easement for a public
utility (street improvement} with necessary appurtenances over, through, across and
upon the following described property in King Coimty, Washington, more particularly
described as follows :
The northerly 32 feet, measured perpendicularly to the Southerly margin of
Northeast 27th Street, of the easterly 45 feet, measured perpendicularly to the East-
erly line, of the following described property:
The West 197.25 feet of the South 37.5 feet of Tract 258, C. D. Hillman's Lake j
Washington Garden of Eden Division #4, according to plats recorded in Volume 11 of Plats, �
page 82, records of King Cotmty, Washington.
LESS portion west of southerly production of west line of East 163 ���t 0� �'���t
278 and West 108 feet of East 163 feet of Tracts 278 aad 279 and E�st 190.07 ���� o�
Tract 280 measured along the south line;
LESS West 15 feet and East 178 feet.
LESS the East 55 feet as measured along the south line.
Said temporary construction easement shall remain in force during construction
and i.mtil such time as the street improvement b .en accepted for operation and
maintenance by the Grantee but not later than �

Sai d heretofore menti oned grantee, i ts successors or assi gns , shal l
have the right, without prior notice or proceeding at law, at such times as '
may be necessary to enter upon said above described property for the purpose
of constructing, maintaining, repairing, altering or reconstructing said
utility, or making any connections therewith, without incurring any legal
�j obligations or liability therefore, provided, that such construction, main-
� taining, repairing, altering or reconstruction of such utility shall be
� accomplished in such a manner that the private improvements existing in the right
_ right(s)-of-way shall not be disturbed or damaged, or in the ever�t they are
f� disturbed or damaged, they will be replaced in as good a condition as they were
� immediately before the property was entered upon by the Grantee.

i ncl udi ng the ri ght to retai n the r��gh�'to=use�'the;surface of sai d ri gh.t-of-way
• if such use does not interfere wi-��i"in-s�tal�lation and maintenance of the utility

ing on the Grantor, his successors , heirs and assigns. Grantors� covenant that
